Mercer Town Board of Supervisors – September 2nd 2010 – Minutes

Chairman Kichak called the meeting of the Town of Mercer Board of Supervisors to order Thursday September 2nd 2010 at 6:30 pm in the Haines Civic Building (Town Hall).

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Charles Schroepfer, Christan Brandt, and Opal Roberts. Absent: Atty Schellgell

Motion made by Banaszak, seconded by Stenberg, to approve the minutes from the August 19th 2010 Town Board meeting with the correction “Mercer Stormwater and Assessment report” in place of “Highway 51” on the second page, and the August 31st Board of Review meeting. Carried.

Open comment: none.

New Business: a) Conditional Use permit for the operation of a business (gun sales) from a residence at 1918W County Road J owned by Jeanne Rossobo & Patrick Daley.
Motion made by Lambert, seconded by Schroepfer, to approve the operation of a home business at 1918W County Road J owned by Jeanne Rossobo and Patrick Daley. Carried.

b) Open/Award paving bids.
Three bids were received:
Angelo Luppino $125,334.00
Northwoods Paving $108,112.50
Pitlik & Wick $118,616.00
Motion made by Lambert, seconded by Stenberg, to award the paving bid to Northwoods Paving. Schroepfer voted “no”. Carried.

c) Discuss/approve heating unit proposal for old garage.
The board agreed that the heater needs to be replaced. Lambert suggested the board place a request for proposals in the Miner before choosing the heating contractor. Stenberg stated that this has to include reliable service after the installation.
Motion made by Stenberg, seconded by Lambert, to request proposals for the replacement of the heating unit in the old garage. Carried.

Legal: none.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, and vouchers.
Motion made by Lambert, seconded by Schroepfer, to approve the vouchers and issue the checks. Carried.

Stacy Offstad will be holding an Emergency Government Table-Top meeting in the Town Hall on September 9th at 2:00 pm to discuss the evacuation of the town in case of a disaster. Email from a Mr Hamilton whose property is in Oma Township but the fire protection, mail delivery and some plowing is done by Mercer. He asked about how he could go about being annexed by Mercer. The WI-DNR report has 34,894.03 acres in entered into County Forest Law as of June 30, 2010. The Public Service Commission found “no significant impact” for the Biomass plant project in Rothchild WI. The Price Electric magazine for September had two pages of photos of the tornado damage in the September edition.

Treasurer’s Report – Brandt presented the Treasurer’s report. The General Account has a balance of $437,738.64. Total of all funds is $1,733,375.76
Motion made by Stenberg, seconded by Banaszak, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: All chip sealing has been done except for Murray’s Landing Road. The company said the garage crew did an excellent job of preparing the road. Murray’s will be done by middle of next week. Excavator is on Turtle Road. Boat landings are fixed up. Vic Ouimette asked if it would be possible to have weight limits on the chip sealed roads. Kichak said the crew will be placing signs probably tomorrow. Mowing is still in progress. The chipper needs repair. Crew will place black top on the curve on Mercer Lake Circle where rocks are being kicked up onto the pavement. Have been having a problem with road signs being down.

Supervisors: Stenberg – Dave Gentile asked about being over budget on the park due to the work on the pavilion. The town had agreed to cover the overages on the renovation of the pavilion. He talked to George Carow and he wanted his family members to be involved in the dedication of the park improvement project so he suggested next summer, maybe the 4th July weekend.

Lambert – Bob Weinkauf complained about the people from a rooming house near him dumping garbage on his property. He had a call about kids riding their bicycles out of the park onto Popklo Circle West. Could some sort of sped limit or other sign be placed in that area? Kichak said a pedestrian sign could be placed there. The County Health Department will have flu shot available in Mercer during October 4th through the 8th at Action Floors, the school and the Senior Center. The notices will be in the paper. The Fire Department had a question about volunteer firemen getting hurt on the job and workmen’s comp. Tom Ketchum, our Horton Group agent sent an email answering the question. They would be covered for workmen’s comp as compared to the nearest paid (career) fire department and length of service as a volunteer. He asked Kichak about the yellow bag question. Kichak said he forgot to ask.

Banaszak – Several questions on the Highway 51 project. The cost for the polymer coatings on Harper and Lakeveiw Avenue will be paid for by the town. Will the snowmobiles be allowed to run on the sidewalk along Vaughn during the winter? Schroepfer said we have to keep them in the street. Maybe snow fencing can be placed to prevent this after the new sidewalks are done. A new set of cost estimates came in an email from EMCS today. The board needs to go over these before the meeting on the 27th. EMCS would like a conference call before the meeting. The board set September 13th at 1:00 pm as the date and time for the conference call. The board will met on the 8th at 1:00 pm to discuss any changes to the cost estimates before the conference call. The costs for outlets on the utility poles for decorations will cost the town approximately $88,000 to $100,000. Blake Theisen suggested the town not have outlets on the poles south of Garnet Street. EMCS sent copies of the utility plans and included reports they are sending to the DNR. We are not eligible to apply for 154 Grant funds for the storm sewer project. The EPA grant does not allow for this. We can use CDBG funds. Blake Theisen sent an email stating that the pedestrian signs and stanchions cannot be purchased by the town. This will be done during the bidding process for the project. The Targeted Runoff Management grant extension was approved until December of 2012. The Catholic Church will meet on September 15 at 5:30 pm to discuss granting the easement. The Treasurer has sent several Accommodations Tax packets to Tourist Rooming Houses and has had nothing back from several of them. Should a citation be issued or should the Tourist Commission address this problem first? Kichak said the Tourist Commission should discuss this. There are two rentals that need Conditional Use permits from the county. Tom Bergman will be contacted about these. What decision has been made about the fishing pier on Mercer Lake? The DNR would need to move the present pier to the north.

Schroepfer – the lights are going up in the garage and it is making a difference. He asked Banaszak the times for the meetings on the 27th. She said the utility meeting will be from 2:00 to 4:00 pm and the staging meeting from 5:30 to 7:30 pm.

Public Comment: Vic Ouimette said the side of the road has washed out by Hohners. Kichak said he will have the crew place some rock in this area.
