Mercer Town Board of Supervisors – September 18th 2008 – Minutes

Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 18th of
September 2008 at 6:30 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Opal Roberts, Christan Manners/Brandt, and Atty Schellgell.

Motion made by Sendra, seconded by Lambert, to approve the minutes from the September 4th, September 10th and Spetember 15th 2008 board meetings. Banaszak abstained being absent for the September 4th meeting. Carried.

Open comment: Tina Brunell, of the Mercer Chamber of Commerce, asked the board to approve a parade route for the ATV Pumpkin Rally to be held on October 10th. The proposed parade route will start at Carow Park, proceed west on County Road J to Railroad Street and end at Lakeview Avenue. Atty Schellgell advised that the ATV ordinance would need to be suspended for the one day to allow ATV’s on County J. Sheriff Bruneau was in attendance and said he had no problem with the parade route as proposed.
An audience member asked who is responsible for establishing the 5-year road plan. Kichak said he gives the school bus routes top priority. He also judges by number of residences and road condition.

Motion made by Lambert, seconded by Stenberg, to go to item 7a on the agenda. Carried.

Old Business: a) Discuss law enforcement officer for Town of Mercer.
Lambert explained that the town is considering the hiring of a law enforcement officer and Sheriff Bruneau was present to state his opinions as to the requirements and feasibility of having this officer. Several of his points were that the town may find they need more than one officer; Mercer is assigned a large portion of the scheduled patrol hours already; the town has the authority to enforce the town ordinances; and the cost would be approximately $70,000 not including the car. Banaszak said this has grown from a simple feasibility question into a big issue. Lambert agreed that the town would eventually need their own officer but with the economy as uncertain as it is at present, now may not be the time to place it in the budget. Dianne Keefe stated that a neighborhood watch program was mentioned but was told there had to be an officer appointed to supervise this. Bruneau replied that neighborhood watches have not worked out well for rural areas. The Sheriff’s office can enforce town ordinances if the ordinance stipulates his office as the enforcement entity. Undersheriff Joy Kohegyi said that people do not realize how much work the department does behind the scenes. Al Schmidt commented that Mercer has more coverage than we realize with the state patrol and other officers. There would be additional costs for using the jail. The board will consider the Sheriff’s advice and thanked him for attending the meeting.

Motion made by Lambert, seconded by Sendra, to return to the original agenda order. Carried.

New Business: a) Award Dump Truck attachments bid.
One bid was received from Central WI Body & Hoist. There were several questions to Kichak by the board and Kichak stated he would meet with the garage crew about the optional attachments.
Motion made by Stenberg, seconded by Lambert, to approve the expenditure of not more than $59,594 to equip the new plow truck with the needed attachments, these attachments to be determined by Chairman Kichak. Carried.

b) Appoint building committee.
Banaszak had suggested the town appoint a committee to research the feasibility, location and funding for a new garage or the possible repair or renovation of the old garage. After discussion by the board, it was decided to wait on the appointment of a committee. Stenberg will consult several builders and get their opinion on the cost to repair the garage and bring this information to the November board meeting.

c) Discuss/Approve action taken at September 15th meeting..
Banaszak read the motion regarding the actions approved by the board at the September 15th meeting. The question was asked as to when these policies would go into effect. The daily activity record will need to be created and the internet use policy approved. The board set the next meeting as the date to approve these and determine the start date. Sendra said the garage needs a list of companies that are not to be used for materials or repairs.



d) Set budget work session dates.
The board set October 22nd and 23rd as the dates for the 2009 budget work sessions. Most of the budget requests have been returned to the clerk’s office.

Old Business: b) Discuss purchase of used pumper truck.
Adam Kussard and Chief Altman have consulted on used trucks and are of the opinion the one in southern WI may be the best deal. They will travel to Port Washington to do an inspection and determine what other equipment may be needed if the town decides to purchase this truck. It may need as much as $10,000 worth of equipment.

c) Approve accounts for the 4th of July Committee.
Motion made by Lambert, seconded by Banaszak, to approve the 4th of July Revenue and 4th of July Expense accounts to be set added to the municipal accounting program. Carried.

Legal: Doug Chidley had emailed Schellgell about the DOT Planning meeting held on the 11th. Banaszak has also been in contact with Mr Chidley and will answer his concerns with the information she possesses. She will contact Schellgell if she feels they need a legal opinion.
The board required a list of property and equipment that will be turned over to the Sanitary District as part of the Bill of Sale. SEH does not have a list that specific. The board requested he create a list that will protect the concerns of the town.
If a list can be made of the town ordinances that require the stipulation of the sheriff’s office as the enforcement entity then he can draft an ordinance amendment to address this issue.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and the budget report. Kichak reported the plow truck is ready for the attachments and a check for $69,149.50 for the purchase of the truck will need to be included for approval in the vouchers list.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.

Communications: The clerk researched the costs and features of color copiers and will purchase a Konica-Minolta for $5,430. The money for this purchase has been set aside in the budget. Tina Brunell said the Chamber might be interested in the old copier.
Net new construction for Mercer for 2007-2008 is 1.258% so our levy limit will remain at 2%.
Copy of a letter from Midwest Forest Products to the Sanitary District that they will not pay the $224.51 bill because the damage to the water shutoff was caused by the town.
An email from Brenda Letellier asking for assistance with the problem of the paving of the roads in Moose Creek Acres subdivision. Kichak will determine the materials needed for the base and the gravel work should be done this year. Lambert said the emergency vehicles have to make every reasonable effort to serve the property owners on non-town roads. Schellgell advised the board to set a required completion date for the paving.

Treasurer’s Report – Treasurer’s Report – Manners presented the Treasurer’s Report. The General Account has a balance of $360,651.80. Total of all funds is $1,299,619.20.
Motion made by Stenberg, seconded by Sendra, to approve the Treasurer’s report. Carried.

In regard to the question of funds not covered by FDIC, Joyce Olson of Associated Bank explained the process for obtaining a “Bailment Agreement” to protect the municipal funds in excess of the $500,000 covered under FDIC. The Treasurer was instructed to proceed with the agreement.

Board Reports: Chair/Garage reports: Jeff Roth of the DNR informed the town that Fisher Lake has to be drawn down as of October 15th this fall. Lambert asked how far it has to be drawn down. Schellgell said it has to be done according to the contract with the DNR.
The two International dump trucks are in bad condition. They are in such bad shape that they can’t be sold for use in the US. Numerous towns and counties are contracting with gravel haulers instead of having their own equipment.
Patching is in progress since the weather is so mild. Trees are cut and stumped on Feely Lake Road. Rock was hauled today. There is a legal problem with the location of the road bed. The property owner will work with the town to resolve this. Schellgell said the town will still have to go through the legal procedure for discontinuing and establishing the location of the road bed. There have been some concerns by the property owners about the trees being removed on Crystal Lake Drive West. Pitlik & Wick will be here during the first couple of weeks of October to do the paving.
Angelo Lupino gave an estimate of what it will cost to construct the salt shed. Lupino suggested the concrete work be done by the company supplying the covering material.
The concrete slabs will be delivered and placed at the Echo Lake boat landing on Monday.

Supervisors: Stenberg – Has Kichak contacted Colman for the remapping of the Carow Park work? Kichak said he hadn’t so Stenberg will do this.
There is a party interested in a lot in the Business Park. His company has the potential to create 24 to 25 jobs. He has asked if the town will consider forgoing the cost of the lot. The contract with the EDA will need to be considered so see if this can be done.
There a question as to why Popko Circle cannot be used as an ATV trail. Lambert stated the insurance company would oppose this. There are ways to connect an ATV trail to Popko Circle but the county will not do this, it will have to be done by private citizens. Wayne Riebe stated that other counties are allowing ATV trails on town roads. Connecting with other ATV routes or trails are also a problem. Kussard said the county forestry is setting up a committee to look at trails for ATVs.
Sendra asked Stenberg what had been the result of his contact with Pat Zatopa. He reported that the change of location of the path to the shelter was okay but she still did not approve of the variance requirement for the shelter. She will allow the shelter to be removed from the grant but this may not be a wise move. The DNR is also working with the town and the state on the Highway 51 project and we want to stay on their good side.

Banaszak – on September 29th at 9:00 am a representative from Senator Jauch’s office will be at a breakfast meeting at Tom’s Café to inform the town of the amount of the grant. Senator Jauch will be here in October for the official grant presentation.
She is in the process of transcribing the minutes of the Planning meeting held on the 11th. Looks like Mercer has been designated a star town for getting the DOT to complete their project on time due to the various grants involved. A thorough storm sewer project should be planned since it looks like the town will not have to come up with a large money as a match for these grants. Kichak said maybe Beachway Drive could be included to solve the problem of runoff to the lake through several properties there.

Sendra – the Library Board chose Gary Sobec from Woodruff to design the addition for the library. The library is asking the town to fill in the ruts in the lawn caused by the ATVs before the fencing was installed.
The Friends of the Library extend an invitation to the board to attend the Annual October Celebration and Fundraiser to be held on October 4th from 5:00 to 7:30 pm at the library and Community Center.

For Consideration and Approval: a) Liquor/Operators Licenses: Temporary Beer permit for the Mercer Lioness Latin American Revue at the Community Center on the 25th of October 2008. Operator Licenses for Theresa Palmquist and Elizabeth Dull.
Motion made by Banaszak, seconded by Sendra, to approve the Temporary Beer permit for the Mercer Lioness. Carried.
Motion made by Banaszak, seconded by Sendra, to approve the Operator Licenses for the above named. Carried.
