Mercer Town Board of Supervisors – October 7th 2010 – Minutes

Chairman Kichak called the meeting of the Town of Mercer Board of Supervisors to order Thursday October 7th 2010 at 6:30 pm in the Haines Civic Building (Town Hall).

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Charles Schroepfer, Christan Brandt, Opal Roberts and Atty Schellgell. Absent: Bonnie Banaszak

A member of the audience made a comment about the condensation of his comments in the minutes regarding the traffic situation on Lakeshore Drive, stating that some of the statements he had made had not been included. The Clerk explained that she had included the main points and that this had not been an item that needed a motion or vote.
Motion made by Lambert, seconded by Schroepfer, to approve the minutes from the September 16th 2010 Town Board meeting. Carried.

Open comment: Jim Schmitt, whose residence is on Flambeau Dam Road, stated that this road needs speed limit signs. Most people are not aware that the speed limit on town roads is 35 mph unless otherwise posted. Kichak replied that the town will order 35 mph signs to place on Flambeau Dam Road.

New Business: a) Discuss Nazarene Church issues about Highway 51 project.
Mr & Mrs Stuhr were present to explain the changes the church would like to the project plan. They do not feel that a sidewalk needs to be along the church property since this sidewalk will only go to the swamp and end there. A curb is indicated on the plan which will block off the entrance to the church parking lot so they would like for this to be removed from the plan. They asked if the town would extend a four foot sidewalk for approximately 48’ in front of the church. After discussion the board decided to postpone this matter until the next regular board meeting.

b) Discuss Mercer Lake Association email.
The Mercer Lake Association had sent an email listing 10 specific requests for incorporation into the storm sewer project. The board decided to postpone this item until the next regular board meeting.
Motion made by Stenberg, seconded by Lambert, to postpone this item until the next meeting. Carried.

c) Request for Public Hearing to apply for Community Development Block Grant.
Motion made by Schroepfer, seconded by Stenberg, to hold a Public Hearing on October 21st at 6:00 pm at the Town Hall on applying for a Community Development Block Grant. Carried.

d) Request for Public Hearing to add Mecca to the Outdoor and Comprehensive Plans.
Motion made by Lambert, seconded by Stenberg, to hold a Public Hearing on October 21st at 6:00 pm at the Town Hall on adding the Mecca Trail to the Comprehensive Plan and the Outdoor Plan if the requirement for the publication of the notice for the hearing can be met by that time. Carried.

e) Cancel paving for 2010 road projects.
Due to the clean up of the trees and debris from the July tornado and the wet weather this season, the road preparation work has fallen behind schedule. The roadwork on the roads scheduled for asphalt paving will not be completely finished this fall.
Motion made by Lambert, seconded by Stenberg, to cancel the asphalt paving projects for the 2010 season. Carried.

f) Set date for budget workshops.
The board set October 13th at 9:00 am for the 2011 budget workshop.

g) Set date for Fall yard clean-up.
The board set the week of October 11th through the 16th as Fall yard waste clean-up week. The Hadley Pit will be open during that week for disposal of allowed yard waste.

h) Discuss the subdivision of the Jim & Chris Lee property.
Todd Maki, of Coleman Engineering, said the Lees had decided to delay this until next year.

i) Re-approve Weber Road 4-lot subdivision.
Todd Maki explained to the board that the subdivided property was not recorded at the county within the time limit after being approved by the Mercer town board. There was also a change in the access easement for the lots not adjacent to Weber Road.
Motion made by Lambert, seconded by Schroepfer, to approve the revised Certified Survey Map prepared for Citizens Bank contingent on the map showing the change in location of the access easement. Carried.

Old Business: none.

Legal: There were three Tourist Rooming House owners that had not obtained a town permit but were operating under a county Conditional Use permit. He contacted the Health Department and the Zoning Administrator and the permits for these properties will be revoked if a Mercer Tourist Rooming House permit is not applied for. His office sent letters out to owners of rental units that had not applied for an Accommodations Tax permit or were delinquent on the 2nd quarter tax payments. Schroepfer asked about the requirement in the ordinance that a property owner with a lot width of less than 200’ show that the operation of a TRH will not interfere with the adjacent properties. Schellgell explained that this is done on a fact and circumstances basis for each case. The town had received a notice of bankruptcy and he asked if the town was owed any personal property tax on the property. That would be our only concern. The Lions are working on the project to get water to the pavilion. He had been asked if this needed to go out on bids. The clerk explained that any contract under $25,000 only needed a notice in the paper that the town would be signing a contract, not an actual bid notice unless the board would like to ask for bids. The board was under the impression that most of this work will be donated.

Officer Reports: Clerk’s Report - Roberts presented the receipts list and vouchers.
Motion made by Lambert, seconded by Schroepfer, to approve the vouchers and issue the checks. Carried.

The clerk asked the board to sign a Thank You letter to the Mercer VFW for the new flag pole at the Town Hall. Received a copy of an email of the WIN-Slamm analysis for Mercer Lake but it was in a format the computer could not open. The town needs new voting booths so a three stall unit will be ordered. As a dam owner the town received a copy of Dam Safety News. The Bad River Water Watershed Association sent their 2010 Annual Report. An invitation to Sheriff Bruneau’s retirement party on October 16th. Iron County Pursuit (formerly the Stormy Kromer Pursuit) asked if the town would like to place an ad in the race book. The board agreed to the ad. The Daily Globe asked if the town would like to place an ad in the Winter Fun guide. The board said this should be a Chamber ad. Angelo Lupino was in the office and said that if the town would prepare the base for the handicapped entrance to the Veterans Memorial, he would supply and donate the paving.

Treasurer’s Report – Brandt presented the Treasurer’s report. The General Account has a balance of $436,253.46. Total of all funds is $1,732,594.16.
Motion made by Stenberg, seconded by Lambert, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: Banaszak is liaison with the DOT engineers and any questions should be addressed to her. He and Lambert are the garage supervisors and any questions about the garage should go through them. Schorepfer asked if a supervisor can go to the garage. Kichak replied that a supervisor can go to the garage but the orders for the crew come from either him or Lambert. Schroepfer stated that Kichak has not been appointed supervisor of highways, as per statute, so that became the responsibility of the entire board. Schroepfer said that the supervisors are all trustees of the town’s property and any supervisor should be able to go to any department and ask questions. Schellgell explained that the board makes decisions for the town but does not know if there is a term “trustees of the town”. Lambert said you can’t have five people telling the departments what to do. Schroepfer said he isn’t telling the crew what to do. If a question comes up he writes it on the board or talks to Kichak about it. Lambert stated that if Kichak is not the superintendent of roads then that needs to be rectified.
Work on Nokomis Road is about three quarters done. There are some large trees there that have to be removed. An email had been received about the condition of Cramer Lake Road. The water is so high that work on this road is difficult. The culverts have been cleaned out to try to relieve the problem. The same condition exists on Moose Lake Road and Three Ten. The only place the town can place speed bumps are in the park. They cannot be placed on town roads. Bill Brundage said the traffic speed has to be amended in some fashion. The stop sign did not work. Kichak said he talked with the Sheriff’s department to try to get more enforcement on the streets and speed limit sign will be installed. Stenberg asked if the town can lower the limit on Lakeshore Drive to 25 mph. Amending the speed limit ordinance will be placed on the next regular agenda. Mowing on the gravel roads is still being done. Patching is also being done. He talked with Scott Construction and the double seal on Murray’s Landing will be postponed until next year at the same rate as quoted for this year. Two quotes were received for the wood in the old dump. Geno Mallum offered $400.99 and Mike Lambert offered $226.00. Mr Mallum will need to sign a hold harmless agreement.

Supervisors: Schroepfer – has anything been decided about Mazol’s bridge? Kichak replied that he needs to contact a bridge engineer. Action Floors asked if the town could get them a load of sand for the parking lot this winter. Kichak stated that since action Floors employs a lot of people we could donate the sand. WE Energies quote for the gas line comes out to $700.85 when the extra charge for work during the winter is deducted. The board decided to have the natural gas line installed to the old garage. The library made approximately $5,000 on the Fall Celebration. K&M Concrete needs to put a seal coat on the library sidewalk. He also asked K&M what it would cost to pour support posts for the roof over the fuel pumps. This will cost $125 per 12” tube and 6 are needed. Kichak told him to have this done. The rebate form for the shop lights has been sent in. A chemical clean-sweep has been advertised in the paper. The garage needs to get rid of a number of hazardous waste items. Lambert said to call and ask for more information. The state has changed the street sign requirements. The Sanitary Board met yesterday with their engineers to discuss the Highway 51 project. The 154 grant funds may cover the highway project but the other work areas on the side streets need to be funded. The Sanitary District has a non-exclusive easement for installing and maintaining water & sewer lines. The utility-DOT meeting left a lot of questions.

Banaszak – none.

Lambert – he had checked into the cost of the yellow bags at Waste Management. The difference in cost is due to the cost of the waste hauling from Mercer as compared to Hurley.

Stenberg – interest has been shown in the Business Park. McNutt has the walls up on his building. Has anyone looked into the trees that had been harvested in the Guy White subdivision? Some of the property owners are very upset with the timber harvest on the subdivision land.

Public Comment: After the discussion during the road report about the speed limit on Lakeshore Drive, Jim Schmitt suggested the limit on all the roads in the Flambeau Dam Road area be 25 mph. Lambert replied that the board should leave it at 35mph.

Motion made by Lambert, seconded by Stenberg, to approve the Operator’s licenses for Joseph S Chivers and Peggy M Chivers. Carried.

No action taken on closed session.
