Mercer Town Board of Supervisors – October 15th 2009 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 15th of October 2009 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Brandt, and Opal Roberts. Absent: Atty Schellgell.
Motion made by Banaszak, seconded by Sendra, to approve the minutes from the October 1st 2009 town board meeting with the correction of the last sentence in paragraph two of New Business a) to read “The DOT says Schreiber Anderson might not be able to be the SRTS/TE engineering consultant; however, they only provided me with the general DOT-based cost estimates, as did a number of other firms I contacted while I was completing the SRTS grant application.”
Open comment: none.
New Business: a) Discuss/Approve Conditional Use permit for 30x50 pole building on property located within a F-1 (Forestry) District part of Gov. Lot 1, Sec 15, Twp 43N, Range 3E, owned by John Utrie.
The site is off-water and on seven acres.
Motion made Lambert, seconded by Banaszak, to approve the Conditional Use permit for the 30x50 pole building on property located within an F-1 (Forestry) District part of Gov. Lot 1, Sec 15, Twp 43N, Range 3E, owned by John Utrie. Carried.
b) Discuss procedure for reclaiming Business Park lot.
Chairman Kichak allowed the lot owner, David McNutt, to speak to the board. McNutt said he couldn’t find anywhere in the Business Park covenants where he had to build a primary building before he could build a secondary building. This paragraph was pointed out to him. He would like to start the storage building now and add the office next spring. He stated he has hired an engineering firm for the proposed building but has not obtained any of the state permits to date. He gave the board copies of a document showing what he had spent during the last year with a number of local businesses. Stenberg had objections to giving McNutt more time to construct the building. It has been over three years since he purchased the lot. We received Federal money for the Business Park and if we don’t use it for creating new jobs we would have to return the money. Even though the plans show an office, there is nothing to keep him from simply using it as storage for a time. Lambert stated he would not object to an extension of time, considering the state of the economy, if it was actually used as a place of business. Banaszak agreed with this statement. Sendra asked why McNutt hadn’t started the building shortly after he purchased the lot instead of waiting several years and then trying to get board approval to construct a storage building.
Motion made by Lambert, seconded by Banaszak, to postpone this item until Atty Schellgell could be present to answer questions the board has about the process for reclaiming the lot. Stenberg voted “no”. Carried.
c) Discuss snow removal on sidewalks.
Dr Nehring was present to ask the town to give the removal of snow from the curb and sidewalk during winter a high priority. We have an aging population and it is difficult for them to climb over snow banks. The town did a good job of this snow removal last year and he hopes it will continue this winter for the sake of the businesses in town. Kichak said the major roads have top priority, then the secondary roads and then the crew has instructions to remove the snow along the edge of the sidewalks and curbs in the downtown area.
Old Business: a) Discuss/approve amendment to Land Use Ordinance
Atty Schellgell had provided the wording for the ordinance amendment about the penalties for failure to obtain a permit in a timely manner and the “Revocation” paragraph was added. (see attached)
Motion made by Lambert, seconded by Banaszak, to adopt the amendment to the Land Use Ordinance by adding the wording suggested by Atty Schellgell and the Revocation paragraph. Carried.
b) Set date for Fall yard clean up.
Kichak had the crew push back the brush and yard waste in the Hadley Pit to make room for the clean up. This will run from October 19th to the 24th from 8:00 am to 3:00 pm.
Legal: none.
Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and budget reports.
Motion made by Lambert, seconded by Stenberg, to approve the vouchers and issue the checks. Carried.
Communications: Thank you note from the Mercer Chamber of Commerce for passing the Accommodations Tax Ordinance. A Thank you note from Martha Pierpont for the help with their road issue. The water supply in the cemetery have been turned off. Two of the pumps are not working and need to be repaired for next year. Need to decide what chapter in the Code of Ordinances under which the Accommodations Tax will to be placed. Letter from Jon and Donna Doud about the roads in Moose Creek Acres. As of December 1st 2009 the state will take over the new building inspections for residences. Rick Clem will no longer be our building inspector. Mercer Township has 32,894.03 acres in County Forest Law as of July 1st 2009. Vilas County sent a CD on their Comprehensive Plan. Their Public Hearing will be November 7th at 9:00 am at the Conover Town Hall.
Treasurer’s Report –Brandt presented the Treasurer’s report. The General Account has a balance of $101,600.36. Total of all funds is $1,341,570.28. Associated Bank is offering a higher interest rate on the Money Market fund than Wells Fargo. The board recommended she select the financial institution most advantageous to the town.
Motion made by Lambert, seconded by Banaszak, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: Received a shouldering quote of $8.75 per yard from Pitlik & Wick. This is the same price as last year. Catherine Lake road preparation work is done and ready for chip seal next year. Work on Long Road is next. Hertel is still mowing the outlying roads. Streets will be swept again to remove the leaves and pine needles. Plow trucks are ready for winter. Several washouts have been repaired on Moose Lake and Swamp Creek. Salt shed is done and ready to use. If weather permits we will begin to fill it with salt/sand.
Supervisors: Sendra – The Friends of the Library Celebration held on October 3rd raised $4,950. She has reported several blinking street lights. At the Sanitary District meeting a 10 year plan was presented for the water tower, which is presently in very good shape. She and Banaszak met with the County Forestry and Parks Committee this morning seeking their support for the writing of a grant for funding for a pedestrian trail from Mercer to the Iron County border near Manitowish Waters. They need Kichak’s help in determining the best route for this trail.
Banaszak – The town received the TRM grant of $150,000. There may be a contaminated site in one of the areas and Jay Knoke will keep abreast of that. We also received the Forest Fire Protection grant for building Dry Hydrants in the amount of $4,971. The town will need to provide matching funds in next years budget for this. Schreiber Anderson has been retained by the DOT as the Safe Routes to School and the Downtown design project. She spoke with Chuck Rasmusson of the DOT about the turning lanes and the possible narrowing of Highway 51. He sent a very nice email saying there may be options that allow 51 to provide as its primary roll a regional route roadway work in providing land and service to the adjacent properties. The cost of providing that dual service may require a local contribution. She will be closely monitoring the CWE engineering costs.
Lambert - He met with representatives from the Ambulance, Sheriff’s Department, and the Lake of the Falls and Flowage areas on October 7th to discuss establishing a First Responders team. They would like to have ten First Responders stationed around the township. The Ambulance service will pay for this. The advertising for applications is being placed in the papers. The Iron County Health Department will buy two defibrillators for them and pay for the training. He would like a line item in the 2010 budget, in case it is needed, to help with the project.
Stenberg – He thanked Chuck Schroepfer for having the crew place reflective strips on the power poles along County J. Kichak said the County needs to relocate several of these poles to make a safer roadway.

Cemetery Deeds: Cemetery lots for Joseph and Shirley McRaniels.
Motion made by Lambert, seconded by Banaszak, to approve the sale of two cemetery sites to Joseph and Shirley McRaniels. One located in Sec 4, Block 11, Plot 2, Site 7 and one located in Sec 4, Block 11, Plot 3, Site 2. Carried.
