Mercer Town Board of Supervisors – November 6th 2008 – Minutes

Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 6th of
November 2008 at 6:30 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Opal Roberts, and Christan Manners/Brandt. Absent Atty Schellgell.

Motion made by Sendra, seconded by Lambert, to approve the minutes from the October 16th 2008 Board of Review, the October 16th 2008 board meeting, and the October 21st 2008 Union Contract meeting. Carried.

Open comment: Betty Snyder asked if the Run for the Vets could use the Mecca Ski trail next 4th of July.
John Sendra asked questions about the Subdivision Ordinance performance bond. These questions will be researched and this will be placed on the next meeting agenda.

New Business: a) Review Subdivision CSM – Jack English.
John Gerski of Coleman Engineering represented Jack & Gael English. This 11.82 acres is being divided into four parcels. This was a former resort and the buildings are being used as apartment rentals. The board had several questions about the number of buildings on lot 4. Lambert wanted to make sure the outlots could not be sold separately. Mr Garski said the CSM states that the outlots are not separate and shall be deeded and forever attached to their respective lots.
Motion made by Lambert, seconded by Stenberg, to recommend to the county approval of the CSM as presented to the town board with the stipulation that lot 4 cannot be further divided. Carried.

b) Discuss/Accept Turtle Rapids Subdivision Road.
Kichak stated the road was constructed to specifications. There were several questions about the condition of the public access to the river, junk on one of the lots and lack of power to the back lots.
Motion made by Banaszak, seconded by Sendra, to postpone this item until the next meeting. Carried.

c) Discuss/Accept Back Nine Subdivision roads.
Kichak checked these roads and rocks need to be removed from the shoulders and ditches.
Motion made by Lambert, seconded by Banaszak, to postpone this item until the next meeting to allow Mr Pierpont time to clean up the shoulders and ditches up to 8’ from the paving edge. Carried.

d) Discuss ATV route from Crystal Lake Dr W to US Hwy 51 on shoulder of County Road FF.
Kichak and Lambert had discussed this with the County Highway Department and, due to the narrow shoulders and curves on this stretch of FF, the county did not think this would be a safe route for ATVs.
Motion made by Lambert, seconded by Banaszak, to deny the use of the shoulder of County Road FF from Crystal Lake Dr W to US Hwy 51 due to the safety factor. Carried.

e) Discuss Mazol Subdivision snow-plowing.
Kichak said he does not want to set a precedent by plowing a subdivision road before it is paved and accepted by the town.
Motion made by Lambert, seconded by Stenberg, to deny Mazol’s request for snow plowing in their subdivision until the roads are accepted by the town. Carried.

f) Approve payment for Wheel Loader.
Motion made by Stenberg, seconded by Banaszak, to approve payment of $122,065 for the Cat Wheel Loader. Carried.

g) Approve contract for shoulder work on Feely Lake, Wilson Lake and Weber Roads.
Motion made by Lambert, seconded by Sendra, to approve the contract with Pitlik & Wick in the amount of between $5,000 and $6,000 for the shoulder work on the above roads. Carried.

h) Discuss log building on Tom Dart property.
Mr Dart has a business sign erected for which he has never obtained a sign permit. The Iron County Zoning Administrator has given him a time limit for the removal of the model log building he has constructed on his property at the corner of County Road FF and Lake of the Falls Road. The board instructed the clerk to send a letter to Mr Dart informing him the business sign has to be removed.

i) Approve Telecommunications policy.
This policy will go into effect after the approval of this meeting’s minutes at the next meeting. Anyone using the town computers and other communications devices will need to sign the agreement page of this policy.
Motion made by Stenberg, seconded by Lambert, to approve the Telecommunications Policy as presented. Carried.

j) Approve Resolution for Library Exemption.
This Resolution is required each year by Iron County.
Motion made by Banaszak, seconded by Sendra, to approve Resolution #2008-10 2008 Library Exemption. (see attached copy) Carried.

Old Business: a) Resolution to abandon alley.
Motion made by Banaszak, seconded by Sendra, to postpone this item until Atty Schellgell presents the board with this Resolution. Carried.

b) Discuss ATV route from Flambeau Dam Road to O’Mearas road along shoulder of County Rd FF.
Kichka and Lambert had also discussed this at the County Highway meeting and, since this is a newly constructed section of FF and a relatively straight stretch of road, the county had no objection to the shoulders here being used by ATVs for access to the trails.
Motion made by Lambert, seconded by Sendra, to add the shoulders of County Road FF from Flambeau Dam Road to O’Mearas Road to the ATV route ordinance. Carried.

c) Discuss garage repair/salt shed.
Stenberg had obtained several quotes for the electrical work and insulation for the garage. The installation of the four fans will cost approximately $1,300 and the insulation about $600. The board agreed these are reasonable quotes. Kichak will contact Mr Vick about the roof repair and a company for the servicing of the furnace.

d) Approve Resolution to borrow $410,000 from Trust Funds of the State of WI.
The Resolution as required by the State was presented to the board. (see attached copy)
Motion made by Lambert, seconded by Sendra, to approve the Resolution 2008-11 for the loan application for $410,000 to be used for the purchase of the fire department pumper truck, the new fire department Rescue Apparatus, and the new plow truck with attachments. Carried.

Legal: none

Officer Reports: Clerk’s Report - Roberts presented the receipts list, and the vouchers.
Lambert had a question about the charge per gallon by Ritchie Oil. They are charging the town $3.399 and 3.599 for diesel fuel. Shouldn’t these prices be dropping? At this rate, it would be less expensive to have the trucks fill up at the stations in town where diesel is below $3.00 per gallon. Kichak will call Ritchie Oil to ask why the cost for fuel isn’t dropping.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.

Communications: the Appraisal Transmittal for the Ratzburg/Wisnefski property for the Turtle Flambeau Scenic Waters Area from the DNR.
Letter from Mr Peter’s attorney requesting copies of any minutes where Mr Peter or his business was discussed.
Copy of a letter Senator Jauch had sent to members of the State Building Commission in support of the Little Turtle River Bridge project.

Treasurer’s Report – Treasurer’s Report – Manners presented the Treasurer’s Report. The General Account has a balance of $224,248.86. Total of all funds is $1,165,405.02.
Motion made by Banaszak, seconded by Sendra, to approve the Treasurer’s report. Carried.,

Board Reports: Chair/Garage reports: The old mower and logging truck have been sold. Wheel weights have been installed on the new loader and Kichak recommended the same be done on the old loader. The wheel weights work much better than the liquid filled tires. The board gave their approval for the expenditure of $750 for wheel weights. The big grader had broken down but is now in working order. Manhole has been repaired by the Pierce Realty office. Around the Corner Pub has a problem with the sidewalk heaving by their entry door. Kichak looked at this and determined this was caused in part by the storm drain near the sidewalk. The crew will try to make some cuts there to alleviate the problem. Work on Beaver Lodge Circle Road was halted due to the softness of the road. Fairview has been cleared and will be plowed this winter. The intersection of Forest Road with County FF is being reconstructed and moved to the actual town right-of-way. The gravel roads are being touched up in preparation for winter. The ad for gravel crushing is in the paper and the bids for this will be opened at the next meeting. The crew will do some of the insulating of the garage when work is slow.

Supervisors: Sendra – she and Bonnie attended the Manufacture’s dinner held at Club 51 and hosted by Action Floors. 67 people were in attendance. Action Floors has 105 employees including management.

Banaszak – The Iron County Zoning Planning Consistency report by NWRP is moving into phase three. NWRP will be attending the Mercer Planning Commission meetings and suggested the town ask Will Andresen to also attend when NWRP is present.
She will attend the Energy Conservation Seminar in Stevens Point on November 19th.

Lambert – the Hadley Pit was busy last Saturday and he will have it open on the 8th from 8 to 4.

Stenberg – Dan Houston said he had no objection to the park shelter being within 75 feet of the high water mark. Coleman will submit an updated map of the walking path for the park. Houston suggested the town ask for a hearing before the Board of Adjustments for the revised shelter location.

For Consideration and Approval: a) Temporary Beer Permit.
Motion made by Stenberg, seconded by Banaszak, to approve the Temporary Beer Permit for St Isaac Jogues Chili Fest on November 22, 2008 at the Parish Hall. Carried.

b) Operators License.
Motion made by Stenberg, seconded by Lambert, to approve an Operator’s License for Genesis Hemmingsen. Carried.

c) Cemetery Deeds.
Motion made by Sendra, seconded by Lambert, to approve the transfer of a cemetery site located in Sec 3 Block 15 Plot 5 Site 8, from Jerome Thompson to Thomas Thompson Jr. Carried.

Motion made by Lambert, seconded by Stenberg, to go into Closed Session per WI Stats. 19.84(1)(e) to discuss possible sale of Business Park Lot(s) at 7:43 pm. Carried. Roll call: All present.

Motion made by Lambert, seconded by Stenberg, to return to Open Session at 7: 52 pm. Carried. Roll call: all present.

Action on Closed Session.
Motion made by Lambert, seconded by Banaszak, to approve the sale of Outlot 11 and part of the southern section of Lot 12, along with a 60’ section adjoining the Taylor property in Lot 10. Mr Taylor will be required to pay the cost of the surveying of the above mentioned property. Carried.
