Mercer Town Board of Supervisors – November 5th 2009 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 5th of November 2009 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Brandt, and Opal Roberts. Absent: Atty Schellgell.
Motion made by Banaszak, seconded by Sendra, to approve the minutes from the October 15th 2009 town board meeting with the correction of the date. Carried.
Open comment: Vic Ouimette presented the board with photos of the damage being done to the new pavement and shoulders of Fisher Lake Road East by the logging trucks. He also explained that the snowmobile trial is rutted and, if it freezes that way, will be a safety hazard to the snowmobilers. He suggested a weight limit be placed on new roads for 30 to 60 days. Norb Urbanski stated that the taxpayers paid a lot of money for that roadwork for it to be destroyed so soon after completion. Lambert asked if Kichak could have Joe Vairus check on the logging operation and the condition of the road and shoulders. Kichak said he will get him out to Fisher Lake Road tomorrow.
Dianne Keefe said a letter from the Mercer Lake Association was in the board packets. The MLA would like to present the town with a check for $17,700 for conducting a study of the Town’s storm water runoff as per the 2008 agreement between the MLA and the town. The December 3rd meeting was set for the presentation of the check.
New Business: a) Discuss/Approve Action Floors building plan.
The Planning Commission had approved the storage building plans presented to them by Action Floors and recommended approval by the town board.
Motion made Stenberg, seconded by Banaszak, to approve the Action Floors commercial storage building plans. Carried.
Lambert requested a copy of any future commercial building plans be given to the town board.
b) Discuss annual camper permit for Donald Huizinga on Cramer Lake.
Mr Huizinga was present to explain to the board that he owned over 160 acres and Cramer Lake. He would like to park a fifth wheel on the property year round but would only inhabit it on the occasions when they were here during the time from April to October. He has demolished the old building that was previously on the site and will utilize the septic system for the fifth wheel. He plans to rebuild within the next several years. Sendra said we might be setting a precedent by allowing this. We had denied a previous request for the placement of a fifth wheel.
Motion made by Lambert, seconded by Sendra, to deny the year round placement of a recreational vehicle.
Mr Huizinga asked the reason for the denial and after more discussion about the property and the proposed usage of the recreational vehicle. This is a unique situation since the vehicle would not be visible to any of the surrounding property owners, no one objected to the placement of the camper, and it would not be used for a residence.
Upon further consideration, Lambert rescinded his previous motion and Sendra rescinded her second of that motion.
Motion made by Lambert, seconded by Sendra, to approve the placement of a fifth wheel camper on the property owned by Donald Huizinga for a two year period. Carried.
c) Set date for Budget haring.
The Clerk will publish and post the proposed 2010 Town Budget and Public Hearing. The Public Hearing on the proposed budget and 2009 tax levy will be held on Monday, November 23rd 2009 at 7:00 pm in the Town Hall.
Old Business: a) Discuss procedure for reclaiming Business Park lot.
Atty Schellgell was not present and had not sent any documents to the Clerk.
Motion made by Banaszak, seconded by Lambert, to postpone this item until Atty Schellgell can be present to answer questions on this subject. Carried.
Legal: none.
Officer Reports: Clerk’s Report - Roberts presented the receipts list and vouchers.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.
Communications: John Kosidowski was in to ask for gravel and grading of Murray Landing Road. Nicolet College has set $522,312.32 as their portion of the Tax Levy. Letter from Mercer Lake Association for presentation of check. One of the health insurance companies is increasing our premium by 6%. WPS sent a newsletter with the information that a dependent of an insured employee, as long as he is a dependent, will be insured to age 27. A Thank You note from the Downtown Development Committee for the storage of the benches. WTA sent a Local Decision Makers’ Guide to Wetland Conservation.
Treasurer’s Report –Brandt presented the Treasurer’s report. The General Account has a balance of $71,502.76. Total of all funds is $1,213,113.68.
Motion made by Banaszak, seconded by Stenberg, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: The crew is out on Swamp Creek and Lake Six Roads to remove rocks and grade. The trees along Long Road are cut and stumping will be done if weather permits. The crew has been hauling salt/sand to the new salt shed and it is now full. Due to the good weather predicted for this week-end Hadley Brush Pit will be open Saturday and Sunday, the 7th and 8th. The rain has created potholes in the roads and these will need patching. The plow trucks are ready for winter snow removal. Lambert said the Sheriff’s office had called him during the last period of high winds and said there were trees across some roads. He tried calling Hammond and finally reached Brunell and had him remove them.
Supervisors: Stenberg – Mr DeCherrie wanted to know if the town would be plowing his road this winter or will it have been abandoned by then. Midwest Timber drivers are still using Portage Avenue as a truck route.
Lambert – the school had a question about who owned the alley from Lakeshore Drive to the back of the school. They would like to use it for ATV parking.
Banaszak – the meeting with the DOT set for last Monday that was cancelled has not been rescheduled. Our engineer, Jay Knoke, is analyzing the traffic data provided by the state. She and Sendra will be attending a Governors summit on November 12th and one of the subjects is northwoods trails.
Sendra – The Sanitary District will hold their budget meeting this Saturday. On October 22nd she attended the Manitowish Waters bike trail committee meeting. A proposed bike trail project map for MW was drawn up by the DNR. The next step is a Public Hearing. It includes a trail along US 51 then crossing to Hwy 47 and then into Mercer. A bridge will be built at the wayside and the trail will follow Sandy Beach Road from there to 47. She and Banaszak will meet with members of the bike trail committee on Saturday November 14th at the MW Committee Center. They will begin the process of writing the grants for the Regional Bike Trail System. The Iron County Forestry & Parks Committee will be coming out with a draft of their outdoor recreation plan for 2009-2013 and Regional Bike Trails will probably be part of that plan.
For Consideration and Approval: a) Temporary Beer Permit
Motion made by Lambert, seconded by Stenberg, to approve the Temporary Beer permit for St Isaac Jogues Church Annual Hunter’s Chili Fest to be held on November 21st 2009. Carried.
Operator’s Licenses to approve:
Motion made by Stenberg, seconded by Banaszak, to approve the Operator’s License for Betty Hiley-Dietz. Carried.
Cemetery Deeds: Cemetery lot for Harvey Conley.
Motion made by Lambert, seconded by Banaszak, to approve the sale of one cemetery site to Harvey Conley located in Sec 4, Block 11, Plot 2, Site 6. Carried.
