Mercer Town Board of Supervisors – November 4th 2010 – Minutes
Chairman Kichak called the meeting of the Town of Mercer Board of Supervisors to order Thursday November 4th 2010 at 6:30 pm in the Haines Civic Building (Town Hall).
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Charles Schroepfer, Christan Brandt, and Opal Roberts. Atty Schellgell arrived at 6:32 pm.
Motion made by Banaszak, seconded by Stenberg, to approve the minutes from the October 21st 2010 Public Hearing and Town Board meeting with the addition of [wall will need to be replaced] “and paid for by the DOT” under Old Business a). Carried.
Open comment: none
New Business: a) Conditional Use permit for 36x36 building at 4818W Camp Nokomis Road owned by Patti Jukich.
Motion made by Schroepfer, seconded by Banaszak, to approve the Conditional Use permit for a 36x36 building at 4818W Camp Nokomis Road owned by Patti Jukich with the condition that it not be used for human habitation or a commercial business without proper permitting. Carried.
b) Conditional Use permit and Town permit for a Tourist Rooming House at 6694W Miller Road owned by Rod & Rebecca Donner.
Motion made by Stenberg, seconded by Banaszak, to approve the Conditional Use permit and Town permit for a Tourist Rooming House at 6694W Miller Road owned by Rod & Rebecca Donner. Lambert abstained. Carried.
c) Discuss/Approve Wilson Lake Circle property Certified Survey Map owned by Diane Markos
Motion made by Lambert, seconded by Schroepfer, to approve the Certified Survey Map for the property owned by Diane Markos as submitted by Coleman Engineering. Carried.
d) Discuss state required Commercial Electrical Inspections.
After discussion as to whether or not the town is interested in assuming responsibility for commercial electrical inspections the board decided to answer “no” on the state survey.
Old Business: a) Discuss/Accept roads in Moose Creek Acres subdivision.
The paving contractor, Angelo Lupino, was present to explain the repairs completed on the bridge. Kichak will meet with Lupino at the site tomorrow morning to explain where the gravel is needed for the washout. Yvonne Mitten stated that she and her husband did not think they should be required to pay for the road signs since they paid for the paving of the public boat landing. Kichak stated that the boat landing was required by the DNR, the town required that it be paved. Schroepfer asked about the bridge weight rating. Mitten said it was designed to highway specifications with a load limit of at least 80,000 pounds.
Motions made by Lambert, seconded by Schroepfer, to accept the roads in the Moose Creek Acres subdivision as per the subdivision plat map on the condition that the owners repair the washout and install the required street and road signs. Carried.
Legal: he spoke with the county zoning administrator about the three Tourist Rooming House owners who had not paid their annual TRH fee. One has been in contact with the Clerk’s office and the other two are in the process of having their conditional use permits revoked by the zoning administrator.
Officer Reports: Clerk’s Report - Roberts presented the receipts list and vouchers.
Motion made by Lambert, seconded by Banaszak, to approve the vouchers and issue the checks. Carried.
A ballot form was received from the USDA asking for a vote for a candidate for the Farm Service Agency Committee election. Email from the DNR regarding the options for the culvert on Trude Lake/Popko Circle. Notice from the Public Service Commission regarding the hearing on the Biomass Facility in Rothchild WI.
Treasurer’s Report – Brandt presented the Treasurer’s report. The General Account has a balance of $370,427.59. Total of all funds is $1,668,136.54. Room Tax receipts for the third quarter were $27,699.81. She asked for permission to place the Accommodations tax application and quarterly report forms on the town web site. The board approved.
Motion made by Stenberg, seconded by Lambert, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: The new truck is in and makes the other trucks look bad. The crew had to clean up downed trees and branches from the wind storm last Tuesday. The power companies did not get all the power restored until this weekend. Working on Nokomis Road and this should be done in a day or two. The rebuilt area will be graveled for the winter. The crack sealing has been completed. Miljevich will pay $8.00 per ton for mixed hardwood and aspen chips and $4.00 per ton for fuel wood chips. Fink will be in before hunting season to chip the brush in the pits. Lambert reported that a guard rail will be installed by the county on County FF in the area between Tip Top Resort and Six Pack Lodge. Dianne Keefe had talked with the priest in regards to the parking area at the boat landing by the church property and the church had no problem with this.
Supervisors: Stenberg – some communities are setting up emergency contracts with local contractors who could help during an emergency. Maybe this could be set up under the emergency plan. The government allegedly set aside $30,000,000 for the bio fuel plant in Park Falls. The government has made it so difficult to use this money that it is obvious that the government has no intention of helping develop these types of facilities. He urged people to contact their representatives and let them know how they feel about this. He asked about the stop sign on Lakeview and Garnet, with no stop sign coming up from the boat landing.

Banaszak – the banner wire across Hwy 51 and the poles by the Chamber will need to be removed. The DOT will remove them but will charge us. Kichak said that he will ask the county to help with their removal. A contamination site was found in the right-of-way on an old garage site near the town hall. The DOT will pay for the study to determine the amount of contamination but it will be up to the town to remove and dispose of the contaminated soil. There may be funds available to help pay for the clean-up of this site. Does the town want the parking stalls marked on Hwy 51? Lines or ticks? The board said the DOT can mark the stalls with ticks (corner marks). A handicap parking stall will be by the Wampum Shop. Does the town want another handicap stall by the dentist office? The board decided that the one by the Wampum Shop is sufficient. Parking areas will be marked from Lakeview Ave. to County J. South of Lakeview Ave. twelve stalls will be marked. The rest of the area to the south will be designated “no parking”. The board agreed to the parking plan. Does the town want any new marking on local streets? The board said diagonal parking should be marked on the Post Office side of Lakeview Avenue. No parking stalls to be on the opposite side of Lakeview Avenue. None are needed by the town hall. Margaret Street will be marked under the SRTS grant. After the plats are recorded on November 15th Atty Schellgell can begin to acquire needed properties. She asked Schellgell to give the town detailed bills on any work done for the Highway 51 project. She attended the Chamber Retreat. The town Banners need to be selected by next Tuesday. Two banners will be designed, one with the Mercer loon logo and one representing the Flambeau Flowage with their tagline. The work session with the businesses to discuss helping the business thrive during the highway project will be held on December 8th. The CDBG application was submitted with the inclusion of the Sanitary District. Knoke helped with this application and his bill will reflect this. Can the road crew trim the lower branches on the trees in the cemetery?
Schroepfer – the benches will need to be picked up. There is a roof leak in the old garage. He and Huffmaster fixed part of it but it needs to be looked at by a contractor. Installation of insulation should be done after the roof leak is repaired. WE Energies will install the gas line around the 15th. He asked Lambert how many kids would be transferring from the Park Falls School to Mercer if the move was approved. Lambert answered that eight students are involved at present, but it wasn’t just the students, it was acquiring the tax base. Stenberg said he had talked to Sherman Supervisor Bob Lepper and they asked the Mercer board to attend any meeting to be held on the matter.
Public Comment: Angelo Lupino explained his idea for the handicapped parking for the Vets Memorial. He also volunteered the use of his 2,000 gallon tanker with a spray bar to ice down the snowmobile trails in winter. Schroepfer suggested Lupino and the Vets Memorial group get together on the handicapped parking.

The next regular meeting of the Mercer Town Board of Supervisors will be held on Thursday the 18th of November 2010 at immediately following the Public Hearing (6:00 pm) and the Plan Commission meetings in the Haines Civic Building.
Motion made by Lambert, seconded by Schroepfer, to go into Closed Session at 7:28 pm pursuant to WI Stats. 19.85 (1)(e) to discuss possible sale of Business Park lot, and 19.85 (1)(g) to discuss potential litigation, and 19.85 (1)(c) to discuss payroll schedule a personal pay issue. All yes.
Motion made by Lambert, seconded by Schroepfer, to return to Open Session at 8:04 pm. All yes.
Lambert will talk to the interested buyer of the Business Park lot explaining the restrictions for this lot and this item will be placed on the next agenda. Atty Schellgell will send a letter to the Sanitary District legal council stating the town board’s position on the Sanitary District’s request for reimbursement. The clerk will change payroll dates as needed for the month of December due to her absence while on vacation.
