Mercer Town Board of Supervisors – November 20th 2008 – Minutes

Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 20th of
November 2008 at 6:30 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Opal Roberts, Christan Manners/Brandt, and Atty Schellgell.

Motion made by Sendra, seconded by Banaszak, to approve the minutes from the November 6th 2008 board meeting with a correction under Sendra’s supervisor report. Carried.

Open comment: At the Budget Hearing held last night, Gene Hickey had asked a question about the anticipated revenue from County timber sales. Kichak informed him that the county pays each municipality approximately 10% of the county timber sale profits according to a formula for the amount of county timber land in the township.

New Business: a) Subdivision Ordinance – Discuss Performance Bond section.
After review of Section 6 – Dedication of Roads, it was decided by the board that the statement “…shall post a construction performance bond in an amount sufficient to bring said roadway(s) into compliance with Town Road Specifications.” is specific enough to protect the town from unfinished roads in a subdivision. No amendment is needed.

b) Discuss/Approve sale of Business Park lot to Gene Taylor.
Mr Taylor had told Lambert that the survey of the property had been completed but, as of 3:00 pm, the Clerk’s office had not received a copy of this.
Motion made by Lambert, seconded by Banaszak, to postpone this item until the next meeting. Carried.

c) Open Gravel Crushing bids.
No bids had been received by the 3:00 pm deadline. The bid for the gravel crushing will need to be republished.

d) Discuss appointment of Sanitary District liaison.
Due to the sometimes contentious contact between the town and the Sanitary District, the board decided to appoint a liaison to the district who will attend the Sanitary Board meetings and report the proceedings to the town board. Kichak asked Sendra if she would be willing to act as liaison.
Motion made by Banaszak, seconded by Stenberg, to appoint Supervisor Toni Sendra as liaison to the Mercer Sanitary District. Carried.

e) Reappoint Opal Roberts as Library Board Trustee.
Motion made by Lambert, seconded by Sendra, to reappoint Opal Roberts as Library Board Trustee. Carried.

f) Discuss/Approve Amendment to Agreement with Ayres Engineering.
The stormwater modeling and assessment was budgeted for $17,700. Ayers has billed for $16,815. They are asking for another $4,700 to include additional geographic areas of Modeling and Assessment.
Motion made by Banaszak, seconded by Sendra, to postpone this until the next meeting. Carried.

Business Park Report: a) Close Business Park Accounts.
Diane Keefe reported that she has written out the final check from the Business Park checking account and all accounts are now closed. The documents for the EDA grant and the Business Park construction have been placed in storage.

Old Business: a) Resolution to abandon alley.
Atty Schellgell explained the procedure for the abandonment of this alley. He will present the board with the resolution at the next meeting. There was a question as to whether there are water and sewer lines in this alley.
Motion made by Banaszak, seconded by Sendra, to postpone this item until Atty Schellgell presents the board with this Resolution. Carried.

b) Discuss/Accept Back Nine Subdivision Roads.
Kichka stated he had looked at the roads in this subdivision and the rocks had not been removed from the right-of-way.
Motion made by Lambert, seconded by Stenberg, to deny the acceptance of the Back Nine Subdivision Roads at this time with leave for the developer to reapply at a later date.

c) Discuss/Accept Turtle Rapids Subdivision Road.
There was discussion about the paving of the boat landing in this subdivision. The board does not want to accept this road until the landing is paved. The town will plow to the first dwelling on this road to allow the school bus to pick up a student.
Motion made by Banaszak, seconded by Stenberg, to deny the acceptance of the Turtle Rapids Subdivision Road until the boat landing is paved and then the developer may reapply for acceptance of the road. Carried.

Legal: none

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers, and budget report.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.

Communications: the Bill of Sale for the transfer of the sewer and water system to the Sanitary District had not been approved by the board. There was a question about whether the board thought the addition of the phrase “as reflected in the Plat filed in the Register of Deeds Office, Iron County, WI” was sufficient to describe the property being conveyed. This will be placed on the next meeting agenda.
There was a recommendation from the garage crew that the Telecommunications Policy be revised to include the use of radio devices.
Iron County has done the bridge inspections and presented the report to the town. The deck abrasion from snowmobile use on the Fischer Lake Bridge is becoming a concern. It was suggested the town use protective panels to protect the bridge deck. The Cramer Lake Road Bridge needs replacement. The steel pipe for this bridge is 48 years old. The town will need to make plans for the replacement of this bridge within the next few years.
The DNR is requesting that the repairs be made on Shay Dam. The town needs to make a formal request for an extension of time to complete the required work.

Treasurer’s Report – Treasurer’s Report – Manners presented the Treasurer’s Report. The General Account has a balance of $413,980.40. Total of all funds is $855,999.14.
Motion made by Banaszak, seconded by Sendra, to approve the Treasurer’s report. Carried.,

Board Reports: Chair/Garage reports: The parts for the new truck are in. The truck should be delivered to Mercer by mid December. The tire weights it was suggested the town purchase at the last meeting will cost $1,800, not $750 as reported. The garage furnace has been cleaned and repaired. This should result in a savings in the propane costs due to the furnace operating at a greater efficiency. The crew has been cutting dead trees along the roads. When the insulation is delivered to the garage, the crew will begin installing it during slow work periods. Kichak will contact Jim Funk about the installation of the fans. The crew reported to him about the condition of the roads on their routes and work that may need to be done on these when possible. The “Forest Road” and “Stop” signs will be placed on FF at the relocated intersection. Fabco Cat had to do work on the grader.

Supervisors: Stenberg – none.

Lambert – The Health Department will be contributing $2,461 for the Mercer Bike/Hike path project.
He had a question as to why the town is not paying the $224.51 bill from the Sanitary District for the repair of a valve box by Midwest Timbers. There is no proof that town equipment caused this damage.
The board should have another meeting with the garage crew to iron out wording on some of the sections in the proposed Union contract.

Banaszak – She and Sendra attended the Energy Conservation Seminar in Stevens Point.
She was contacted by the DOT and was told that the DOT does not own the old Amerigas building, but the DOT had leased the land to Amerigas until they moved to their new location. The Sanitary District is concerned about sections of sidewalks over some of the water and sewer lines. The DOT in taking under consideration the suggestion that Hwy 51 be made three lanes in the area from the Sanitary District building to Harper Avenue.

Sendra – She asked if anything had been done about the Ledvina letter to Jim Schmitt concerning the posts and rocks on the town right-of-way. A letter has been sent to Mr Schmitt requesting that he remove these obstructions from the town road R-O-W.
