Mercer Town Board of Supervisors – November 18th 2010 – Minutes

Public Hearing – Amend Outdoor Recreation and Comprehensive Plan to add Mecca Trail System

Chairman Kichak called the Public Hearing on amending the Mercer Outdoor Recreation Plan and the Town of Mercer Comprehensive Plan with the addition of the MECCA Trail System to order on November 18th 2010 at 6:00 pm in the Mercer Town Hall.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Chuck Schorepfer, Opal Roberts and Atty Schellgell. Eight members of the audience were in attendance.

Kelly Martinko, representing the Mecca Ski Association, explained the requirement that the Mecca Trail system be included in the Outdoor Recreation Plan and the Mercer Comprehensive Plan in order to apply for future grant opportunities. The Mercer Cross-County Association (MECCA) was established in 1972. The MECCA trail now incorporates the use of the trails year round for non-motorized sports including running races, mountain biking, birding and nature hikes. Martinko submitted the Mecca Development Plan (see attached). In September of 2010 Article 8 was added to the by-laws in the event of the dissolution of the club, reverting all property and funds to the Town of Mercer Parks and Recreation Committee.
Schroepfer asked about the land acquisition item under the Development Plan. Martinko stated that there are some lands that the trail crosses that are owned by private parties and, in the event the land is being offered for sale, the club might be interested in purchasing the land. Nothing is specifically planned at this time.
Banaszak asked if the town will be responsible for the capitol outlay and maintenance of the trails if it is included in the town plans. Schellgell said it would not hurt to have the stipulation in the resolution but it will not be detrimental if it isn’t.

Motion made by Lambert, seconded by Schroepfer, to adjourn the Public Hearing at 6:08 pm. Carried.

Immediately following the Public Hearing the Mercer Planning commission held a meeting to discuss and pass a resolution recommending the Mercer Town Board amend the Mercer Outdoor Recreation Plan and the Mercer Comprehensive Plan to include the MECCA Trail System.

Mercer Town Board of Supervisors – November 18th 2010 – Minutes

Chairman Kichak called the meeting of the Town of Mercer Board of Supervisors to order Thursday November 18th 2010 at 6:10 pm in the Haines Civic Building (Town Hall).

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Charles Schroepfer, Opal Roberts and Atty Schellgell. Christan Brandt arrived at 6:13 pm.

Motion made by Banaszak, seconded by Stenberg, to approve the minutes from the November 4th 2010 Town Board meeting with the addition of “Parking stalls are to be marked on both sides, where appropriate, of Lakeview Avenue from US 51 to Railroad Street.” under her supervisor’s report. Carried.

Open comment: none

New Business: a) Discuss/Approve Resolution 2010-11 amending the Mercer Outdoor Recreation Plan and the Town of Mercer Comprehensive Plan to include the MECCA Trail System.

Motion made by Lambert, seconded by Banaszak, to approve Resolution 2010-11 to amend the Mercer Outdoor Recreation Plan and the Mercer Comprehensive Plan to include the Mecca Trail System, with the inclusion of the stipulation that the Town will never bear the cost of any maintenance, trail equipment, or relocation of the trail from this date forward. Carried.

b) Discuss/select engineer for contamination cleanup on Railroad Street site.
Request for proposals had been sent to CWE and AECOM. CWE had returned a RFP listing all phases for the contamination cleanup. AECOM had included only a portion of the project. Banaszak suggested the board postpone this until AECOM could submit a more complete proposal.
Motion made by Banaszak, seconded by Schroepfer, to postpone this item until the next regular board meeting. Carried.

Highway 51 Project report: the new plans with the revised utility plans are available for review in the office. Banners would cost about $200 each if we put them out for bid. Jacquart is quoting a much lower cost so it will be recommended that the town seek additional funding for the banners some place else. The DOC office has called the clerk’s office with several questions about the CDBG grant application. Banaszak was told that Senator Jauch cannot be as helpful as in the past. She spoke with John Karban (Karban Cable) and he has been in contact with the DOT. He stated that he had not been informed that the state and town would be doing anything that would effect the cable system. He was told by EMCS that he had been invited to all the public information meetings held during the past two years. He responded that he was not aware that the project meetings had anything to do with utility relocation. He stated that the way the DOT, EMCS and the town has planned to accomplish their goals is very unfair to his cable company. There will be about 17 new benches and a dozen planters coming in and the question is where they will be stored. Dave Gentile said the storage shed at the park is almost empty.

Old Business: none

Legal: he sent out the letter to the Sanitary District in response to the one received from them which was discussed at the last meeting.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and budget report. The bill in the amount of $52,704 for the new truck equipment is in the voucher list.
Motion made by Lambert, seconded by Stenberg, to approve the vouchers and issue the checks. Carried.

Letter from Command Central explaining that Sequoia Voting systems has been acquired by Dominion Voting and all contracts with Sequoia will need to be assigned to Dominion.

Treasurer’s Report – Brandt presented the Treasurer’s report. The General Account has a balance of $302,790.91. Total of all funds is $1,600,499.86.
Motion made by Banaszak, seconded by Schroepfer, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: the new road signs are installed along US 51. Several more need to be ordered. All stop signs will need to be replaced to meet the new requirements. These will be ordered next year. He contacted Fink and was told the chipping in the brush pits will be done after hunting season. The old 194 truck should be put up for sale. He will see what kind of price we might receive for this. The road quipment is being prepared for winter work. Camp Nokomis Road has been readied for the winter. All roads will be checked for tree removal and condition.

Supervisors: Stenberg – MECCA is asking for a contribution of $1,500 for a 20x24 concrete slab for the construction of a storage shed. Maybe this can be an item in the room tax expenditure budget.

Lambert – Iron County zoning is working on a new camper ordinance for the county and would like to coordinate it with the various townships. They are researching the ordinances of surrounding counties. The county is planning to eliminate the conditional use requirement and go with a permit.

Banszak – the DOT has set up a meeting for December the 8th at 6:00 pm for the “In This Together” work session with town businesses and the board. A comment has been made that the town can pay for the water to the park pavilion since the town does not know what to do with all the room tax money we have received.

Schroepfer – he took some items to Park Falls today for the haz-mat pick up. We were the only county that did not have a scheduled hazardous material pickup in 2010 and he plans to talk to DeRosso about this. The request for the repair of the tennis court at the park and the suggestion it be out of room tax funds should probably be a decision of the Tax Committee. Gentile stated that the repair of the tennis courts is in the park budget for 2011.

Public Comment: Kathy Tutt has been in contact with the Sherman Township chairman and she will supply him with the breakdown of the procedure for transferring the students from Park Falls to Mercer. They have asked the Mercer board members to attend the meeting on December 22nd.

The next regular meeting of the Mercer Town Board of Supervisors will be held on Thursday the 2nd of December 2010 at 6:30 pm in the Haines Civic Building.

Motion made by Lambert, seconded by Schroepfer, to go into Closed Session at 6:37 pm pursuant to WI Stats. 19.85(1)(e) to discuss possible sale of Business Park lot. All aye. Carried.

Motion made by Lambert, seconded by Schroepfer, to return to Open Session at 6:45 pm. All aye. Carried.

Motion made by Lambert, seconded by Stenberg, to approve the sale of Business Park Outlot 3 to Gene Taylor for $6,000. $3,000 to be paid now and the remainder in six months. This sale will be with the stipulation that all Business Park covenants be observed. This lot is mainly wetlands and no changes may be made to it without the approval of the DNR. Carried.

Motion made by Lambert, seconded by Schroepfer, to adjourn the meeting at 6:49 pm. Carried.
