Mercer Town Board of Supervisors – May 7th 2009 – Minutes

Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 7th of May 2009 at 6:30 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Opal Roberts, and Christan Manners/Brandt. Atty Schellgell arrived at 6:33 pm.

Motion made by Banaszak, seconded by Sendra, to approve the minutes from the April 7th and April 16th 2009 board meetings. Carried.

Open comment: Marge Pemble, representing the Veterans Memorial Park Association, extended invitations to the board for the dedication of the Veterans Memorial to be held May 16th at 1:45 pm. She asked if the town would barricade the section of Veterans Memorial Parkway from the Ranallo residence to the O’Neil residence. Kichak said he will have the crew deliver the barricades the day before the event.
Vic Ouimette asked when the board plans to address the Room Tax issue. The board will publish a Public Hearing notice for a meeting to be held on Tuesday, June 2 at 6:30 pm in the Mercer Community Center.
Larry Wollner, a seasonal resident at 6300 Omearas Road, presented a letter of complaint about the smoke from a wood burning furnace at the Kennedy residence. These dwellings are in a natural bowl-like setting and the smoke does not diffuse upward. He would agree to a May to October ban on the use of the outdoor furnace. Lambert will take his letter and accompanying photos to the next Health Department meeting to ask them what can be done to address this issue.

New Business: a) Conditional Use permit for a 40x80 building at 3830N Wilson Lake Road owned by Daniel Waters.
Mrs Waters was present to answer questions from the board. She and her husband plan to retire and live at this residence full time within the next several years. They will be storing their pontoon boat, truck w/plow and other items in this accessory building.
Motion made by Lambert, seconded by Stenberg, to approve the Conditional Use permit for a 40’x80’ accessory building at 3830N Wilson Lake Road owned by Daniel Waters, on the condition this building not be used for commercial purposes or for human habitation. Carried.

b) Tourist Rooming House at 4150N Pine Road owned by Charles Zradicka.
Motion made by Banaszak, seconded by Sendra, to approve the Tourist Rooming House permit for 4150N Pine Road owned by Charles Zradicka. Carried.

c) Discuss/Approve 5-year Road Plan.
There were several questions from the audience about whether or not their roads were on the plan. Kichak answered the various questions.
Motion made by Lambert, seconded by Banaszak, to approve the 5-year Road Plan subject to changes due to cost fluctuations. Carried.

d) Open/Award Cemetery Grounds Keeping Bids.
Eight bids were received: Frank’s Up North Handyman Services $5850, Harma’s Lawn & Property Service $6700, Mike Lambert $6699, M.A.C. & Laura Inc $6995, Northwoods Lawn & Home $6000, Pfeiffer’s Lawn Care Service $6495, Keith Wesolowski $5850 and Richard Wilson $6400. It was decided that the $150 difference between the lowest bids and the bid of Northwoods Lawn & Home was made up for in the experience Northwoods has since they maintained the cemetery for the 2008 season.
Motion made by Banaszak, seconded by Sendra, to award the Cemetery Grounds Keeping bid to Northwoods Lawn & Home for $6,000. Lambert abstained. Carried.

e) Discuss DOT comments on improvements adjacent to US 51.
Stephanie Christensen of EMCS had sent a letter asking for a response letter to indicate any significant effects on the Mercer Veterans Memorial and the Loon & Chamber area of the Highway 51 project. There was a question about how this plan will affect the Sanitary District lines in that area. Kichak will contact Ms Christensen about this concern.

f) Open/Award Town Buildings mowing bids.
Three bids were received: Harma’s Lawn & Property Service $3500, Mike Lambert $5999, and Northwoods Lawn & Home $4200. After discussion as to the bids and the previous costs of the mowing to the town using a part-time employee, the decision was not to go with a mowing contract for the 2009 season.
Motion made by Sendra, seconded by Banaszak, to reject all bids for the Town Buildings mowing contract and to use a part-time employee for this work. Lambert Abstained. Carried.

g) Discuss/Approve Ayres bills.
With the current bill, Ayres has now reached the limit for charges to the town for the Slamm modeling. Less than $2000 remains of the $30,000 limit for the Storm Sewer project.
Motion made by Banaszak, seconded by Sendra, to approve the payment of the current Ayres bills of $5,972.39 for the Storm Sewer project and $5,585.00 for Stormwater modeling and Assessment. Carried.

Old Business: a) Discuss/Approve amendment to Sign Ordinance.
Atty Schellgell stated he was waiting for the board to determine the wording on the paragraph to be added to the ordinance. This item will be put on hold until the board drafts the wording for this paragraph. No action taken on this item.

b) Appoint Hadley Brush Pit attendant.
Two job applications had been received. These were reviewed by the board.
Motion made by Lambert, seconded by Stenberg, to hire Victor Minisan as the Hadley Brush Pit attendant. Carried.

c) Discuss Salt Shed location and construction.
Atty Schellgell informed the board the town is locked into the original contract with Angelo Lupino. The board will talk with Lupino about supplying pre-cast concrete instead of poured. Discussion was held about whether to place the shed at the garage site or near the gravel pit on Fierick Road. No decision was made.

Legal: none.

Officer Reports: Clerk’s Report - Roberts presented the receipts list and vouchers. The check to Pierce Manufacturing for $234,850 for the new fire truck is included in the bills.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.

Communications: There is a question about the inclusion of the shoulder of County Road FF from Flambeau Dam Road to Swamp Creek Road as an ATV route. It is listed in the ATV Ordinance but ATV signs are not posted. Kichak and Lambert said the County Highway Department has questions from other townships about the use of county roads as ATV routes and the safety factors in allowing this practice. They will discuss this again at the next County Highway meeting.
The Board of Review meeting will be held just before the Town Board meeting on May 21st but adjourned to a later date due to the assessment roll not being completed.
The Spider Lake Association received approval from the DNR for the placement of Hazard Warning Markers in Spider Lake.
Notice of altered policy terms from the Local Government Property Insurance Fund about the deductible amount.
Copy of report the Sanitary District would like the Fire Department to fill out to report water and hydrant usage. Also, letter stating the Hydrant Tap fees will be reduced from $40 to $25. Even with the sale of a portion of Outlot 3 to Gene Taylor, the town will still be paying the Fire Protection assessment for that lot.

Treasurer’s Report – Manners/Brandt presented the Treasurer’s report. The General Account has a balance of $363,074.57. Total of all funds is $1,499,915.60.
Motion made by Sendra, seconded by Banaszak, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: Town roads are being patched. Kichak had talked to the DOT about the bidding for the storm sewer project and was told the DOT will handle the bid process. The crew graded all the roads that are dry. Meverden will begin crushing gravel soon. May need to hire Kohegyi to push back the debris at the gravel pit before Meverden starts. The crew is working on the Shay Dam repairs as required by the DNR. The truck has been repaired and is back in service. Weight limits are being lifted Monday. He has attended the Board of Review training. He talked with Niemi about the leasing of a truck, if needed, for the heavier work this summer. The first road work will be on Beaver Lodge Circle. Road patrol will be scheduled sometime soon.

Supervisors: Stenberg – none.

Lambert – none.

Banaszak – request for “Hidden Driveway” sign for the Ohlinger driveway on Great Northern Trails. The project to move the post office is not going anywhere. The US Post Office may be bankrupt by the end of the year. The grant requests for the Bike/Hike paths will be due in 2011. Zion Lutheran Church asked for a letter of support from the town for the day care to be offered at the church.

Sendra - Lucien Perron was re-elected to the Sanitary Board. Tom Thompson was elected president and Mike Vecchione vice president. The Sanitary District has signed off on the bill of sale for the sewer and water system in the Business Park. Beginning on June 11th at 6:00 pm the Sanitary District will be holding their meetings in the evening. The Falkowski’s requested the town not plow snow onto Echo Lake during the winter. Kichak explained that the town cannot plow snow out onto the ice because the equipment would not be covered by our insurance in that event.
