Mercer Town Board of Supervisors – May 21st 2009 – Minutes
BOARD OF REVIEW
Chairman Jim Kichak called the Board of Review to order at 6:30 pm Thursday the 21st of May 2009 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Opal Roberts, and Atty Schellgell.
Absent: Christan Manners/Brandt.
REGULAR TOWN BOARD MEETING
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 21st of May 2009 at 6:32 pm in the Haines Civic Building.
Motion made by Sendra, seconded by Banaszak, to approve the minutes from the May 7th board meeting. Carried.
Open comment: Angelo Luppino was present to answer questions from the board about the substitution of pre-cast concrete walls for the salt shed. He stated that the price would be the same as poured concrete as quoted in the bid last year. After discussion by the board it was decided the salt shed will be constructed at the garage site on Highway 51 with pre-cast concrete walls. The cover is in Abbotsford and ready for delivery. Coverall is asking for $18,800 as a prepayment. The town had already paid $22,510 in October. Lambert asked about the portability of the shed once it is constructed.
Bill Brundage, a resident at 5460N Lakeshore Drive, presented photos and informed the board about the problem of water on the road at the junction of Lakeshore Drive and County Road J. He stated that in the winter this becomes a sheet of ice and a safety hazard. The board will look at the site and see what can be done to get the water off the road.
New Business: a) Discuss/Approve 1.9 miles of Fisher Lake Road East from Fisher Lake Rd to Lori Ann Ln as ATV route.
John Elzer, a resident at 0751W Lori Ann Lane, had made this request. He answered several questions from the board. There are about three residences along this section of the road. One house is located rather far from the road. It was suggested by the board that Mr Elzer contact the Bingham family and obtain a signed document that they would not object to this section of Fisher Lake Road East being designated an ATV route.
Motion made by Banaszak, seconded by Sendra, to postpone this item until the next regular board meeting. Carried.
b) Conditional Use permit for a 40’x30’ Accessory Building at 2941W Mercer Lake Circle N owned by Joann Huff.
Motion made by Lambert, seconded by Stenberg, to approve the Conditional Use for a 40’x30’ Accessory Building at 2941W Mercer Lake Circle N owned by Joann Huff on the condition it not be used for human habitation or for a commercial business. Carried.
c) Discuss Land Condominiums.
Banaszak said this was discussed at the Town Officials seminar and was being used as a way to get around the construction of roads in a land division. Atty Schellgell explained the different types of property divisions for condominiums. He stated the construction of roads under a land condominium could be a problem eventually for the town. He will research the question and bring the results to the next regular board meeting.
Motion made by Lambert, seconded by Banaszak, to postpone this matter until the next regular board meeting.
d) Discuss benches for the cemetery.
Banaszak said this matter had been resolved so no action was needed.
e) Discuss crosswalks.
Now that the DOT has absorbed the infrastructure money for the Safe Routes to School, can the crossings on Highway 51 be painted by the town this summer? Kichak will call the DOT about permission to paint the crossings and this will be placed on the next agenda.
Old Business: none.
Legal: There had been a question of how the laterals were constructed for the Malone property without a change order by the Town. Atty Schellgell explained the construction company had asked for permission from Malone to place their equipment and to use some of the materials on his property. Instead of Malone charging them a fee he asked the construction company to place three laterals to his property. Apparently the company agreed. There has been no charge to the town for these laterals.
Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and Budget Report. She explained that several of the amounts were incorrect due to the accounting program. The Building Repairs and Maintenance account is almost depleted due to the recent expenses for the rescue barn, fire department and library.
Motion made by Lambert, seconded by Stenberg, to approve the vouchers and issue the checks. Carried.
Communications: An interested party had asked if the Fire Department would be selling the trailer they no longer need. Kichak said it will not be sold because the town has other uses for the trailer. A complaint about a camper in the alley by Hometown Village had been called into the Clerk’s office. Kichak said he will check on this matter. A copy of a letter from the Mercer Chamber of Commerce addressed to Lambert with a complaint about a conversation between Lambert and an employee of the Chamber, Tina Brunell. An invitation had been received for the dedication of the new Town of Sherman town hall and fire station to be held on Wednesday June 10th 2009 at 2:00 pm. A reply from the Local Government Property Insurance Fund stated that the increase in premiums will not affect the policies with deductions over $500. An email was received from the WI Towns Association legal department stating the town cannot change the residency requirement for the Sanitary District.
Treasurer’s Report – In the absence of Manners/Brandt, the Clerk presented the Treasurer’s report. The General Account has a balance of $94,395.20. Total of all funds is $1,231,779.64.
Motion made by Banaszak, seconded by Sendra, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: The crew has been removing trees from the roadways due to the high winds we had yesterday. The work on Beaver Lodge Road is behind schedule because the crew has been busy clearing the roads. The street sweeper will be run early tomorrow morning to clean the streets for the holiday weekend. All the new flags were installed. The road tour will be set up for sometime in early June. He recommended the town sell the two lawn mowers not being used at present. The Hadley Brush Pit was open this week for yard clean-up and the attendant has been doing a good job. The new fire truck was delivered yesterday but the department hadn’t had time to equip it due to being called out most of the day for help with wildfires in Oma. Sendra asked about the extra paving on the sharp curve on Arrowhead Drive. Kichak said he will see about adding more paving on this curve to increase the width on the road. Lambert said he will have the crew logging his property remove the trees along the road on Arrowhead Dr. Kichak said the crew will remove the stumps when they have time.
Supervisors: Stenberg – Thank You signs are ready to be placed at the park. The power poles by the walking path along County Road J need to have reflective markers. They are difficult to see at night. He had received a complaint about a property with old refrigerators by a dwelling with the doors still attached. There are children living in the area. Lambert said he will contact the Health Department about this.
Lambert – The Fire Department is planning to start a Junior Firefighters program and the Clerk researched the effect this might have on the town’s liability insurance. If the Fire Department has a program set up with procedures and policies it will not increase the premium on the liability insurance. The Park project needs to have the lights installed and the path paved to be complete the project. About the letter he had received from the Mercer Chamber: he had been a member of the Chamber for 30 years before leaving it and, since being a board member, has always supported the Chamber 100%. They should have had the courtesy to discuss this with him first.
Banaszak – Stephanie Christensen, project manager for EMCS/DOT, had replied to Banaszak’s enquiry about the Highway 51 project progress. It has been determined that there will be no adverse effect on the two historical buildings in the downtown area. Christensen also gave her an update on the various components of the project. The contract with the town may be ready by mid-June. The next Public Hearing will be scheduled in August or September. Kichak had talked to Christensen shortly after the last board meeting about the location of the Sanitary District lines over the culvert by the Loon.
Margie Ervin has requested the board’s approval for the erection of a tent on the parking lot of the Community Center again this year. The board agreed to this.
Sendra - both lights in the park belong to the park. There may be a switch to turn the lights on inside one of the buildings. These lights should probably be left on for the summer for people who use the walking path around the park. A competitor to Action Floors got the contract to install the basketball court floor at Camp David for the President. She had delivered, or mailed, a brochure about the Façade Loan Program to the businesses in town and several are interested.

b) Cemetery Deeds - Purchase of site by Arjay F Vaughn.
Motion made by Sendra, seconded by Lambert, to approve the sale of a cemetery site to Arjay F and Geraldine Vaughn for a site in Section 4, Block 24, Plot 4, Site 6. Carried.

Motion made by Banaszak, seconded by Sendra, to adjourn the board meeting at 7:38 pm. Carried.

Due to the Assessment Roll not being completed at this time, the Board of Review is adjourned to August 17th 2009 at 9:00 am in the Town Hall (Haines Building).
Motion made by Lambert, seconded by Stenberg, to adjourn the Board of Review meeting at 7:41 pm. Carried.
