Mercer Town Board of Supervisors – May 17th 2012 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 17th of May 2012, at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Charles Schroepfer, Christan Brandt, and Opal Roberts. Absent: Atty Schellgell.
Motion made by Banaszak, seconded by Stenberg, to approve the minutes from the May 3rd 2012 board meeting, the May 11th 2012 board meeting, and the May 15th 2012 Board Meeting/Public Hearing. Carried.
Open comment: Ed Alvey Sr had a complaint about the town board approving a conditional use for Michael McConville to build a pole building on property located at 5741N County Road H. This is adjacent to Alvey’s property and, in his opinion it is too close to the property line and will be a bright red color. Lambert suggested the board ask Atty Schellgell to send a letter to the owner informing him of the need to talk to his neighbors about the building and to change the color, if possible, to a neutral earth tone.
New Business: a) Discuss/Approve Sno-Goers loan.
Darryl Fohr was present to represent the Snowmobile Club. The balloon payment on their loan is due June 18th in the amount of $46,916.60 and they are asking the board’s approval to re-apply for the loan.
Motion made by Lambert, seconded by Stenberg, to approve the loan renewal for the Snowmobile Club. Carried.
b) Discuss/Approve Conditional Use for a 32’x40’ Accessory Building at 1481W Margaret Lake Road owned by William Bohm.
The board needs more information on the construction of the proposed building.
Motion made by Schroepfer, seconded by Banaszak, to postpone this item until the owner provides more information on the building plan. Carried.
c) Discuss/Approve Grand Portage Condo plat amendment.
The Planning Commission has reviewed the proposed plat and recommended the town board approve the plat amendment. The number of lots had been reduced from nine to six. Schroepfer had a question on the future location of a septic system for Lot #5. Todd Maki, of Coleman Engineering, explained that common areas have been set aside for future septic system replacements.
Motion made by Stenberg, seconded by Lambert, to approve Grand Portage plat amendment. Carried.
d) Discuss/Approve letter of support for Mercer ATV Club.
Tina Brunell represented the ATV Club (Mercer Dusty Loons). They are asking for a letter of support for the efforts of the local ATV club. This organization was established a year ago and has 73 members at this time. Iron County Forestry has recognized them as an ATV club and they will be requesting funding from Iron County for the seven miles of ATV trails in Mercer Township.
Motion made by Stenberg, seconded by Banaszak, to approve the letter of support for the Mercer ATV Club. Carried.
e) Discuss/Appoint Library Board member.
Due to the resignation of Gary Bogenschneider a new library trustee needs to be appointed. Chairman Kichak appointed Wendy Thiede to fill the unexpired term on the library board.
f) Discuss/Appoint Park Board members.
Six letters of interest were received for the park board positions.
Motion made by Lambert, seconded by Schroepfer, to appoint Tom Thompson Jr to a 3-year term, Adam Kussard to a 3-year term, Tom Thompson to a 2-year term, Todd Engler to a 2-year term, and Dave Gentile to a 1-year term. William Brundage is to be an alternate to fill any future unexpired terms. Dave Gentile to be president of the Park Board. Carried.
g) Discuss/Approve purchase of mini-excavator.
Kichak had talked to the owner of the mini-excavator who would like to hold off in the sale of this machine. He will rent it to the town for $400 per week.
Highway Project Report:
There were quite a few people at the construction meeting and several issues were addressed. One of the questions at the construction meeting was how the town plans to clear snow from the new sidewalks. It would not be feasible to use heavy machinery as in the past. The TRIP-D grant was denied for Mercer.
Dianne Keefe has two smaller bills to pay to SAA and CWE next week. She completed the required CDBG report.

Legal: Schroepfer asked if Atty Schellgell has been made aware of the Klick Road issue. Kichak said he will talk to Schellgell tomorrow.
Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers, and budget report.
Motion made by Lambert, seconded by Schroepfer, to approve the vouchers and issue the checks. Carried.
Communications: none.
Treasurer’s Report – Brandt presented the Treasurer’s report. Balance forward was $231,498.02. Receipts were $8,833.51, disbursements were $42,592.01, with an ending General Fund balance of $197,739.52. Total of all funds is $1,441,481.10.
Motion made by Banaszak, seconded by Stenberg, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports – Hadley Road has been repaired. Crew is still working on Cramer Lake Road. Gravel has been hauled to Joe’s Shack Road. Most of patching is complete. A discussion on problems at the use of Hadley Brush Pit ensued. Out of area users and the amount of brush piling up is an issue. Kichak obtained some new patching material for the garage roof and in the areas where it was applied it has worked. There is a person interested in purchasing a small strip of town land between the Sanitary District and Kichak’s property. Schroepfer asked if there would be any cost to the town to do this. Discussion of this will be placed on the next agenda. Kichak had looked at Range Road to determine what would be an expensive yet durable paving material for this length of road. Kichak told the Sanitary District that the town will pave the section of road in the Business Park that was removed during the water line repair. He has talked with Marge Pemble about the work to be done at the Veteran’s Memorial.
Supervisors: Stenberg – the Fire Department should call the Sanitary District when there is a possibility of using a large amount of water. The department needs a larger water valve inside the fire station. Stenberg has listed some of the Business Park lots with the Commerce website. He stated that any and all issues with the sewer/road project should be addressed during the construction because we won’t be doing this again.
Lambert – he asked that the grass by the Ambulance Barn and Fire station be cut as part of the town mowing contract. The 12 year old ambulance needs to be replaced and should be considered during the budget sessions this fall.
Banaszak – the Library and the Library/Building Committees will be meeting weekly for a time. Sandy Herfel of WEDC said they are redoing the CDBG contracts so our agreement may not be here as soon as expected.

The next regular meeting of the Mercer Town Board of Supervisors will be held on Thursday, the 7th of June 2012 at 6:30 pm in the Haines Civic Building.
Motion made by Lambert, seconded by Stenberg, to go into Closed Session at 7:30 pm per WI Stats. 19.85 (1)(c) to discuss personnel and Stats. 19.85 (1)(e) to discuss financial issues. All yes.
Motion made by Schroepfer, seconded by Lambert, to return to Open Session at 7:55 pm. All yes.
Chairman Kichal will discuss the various issues brought up in Closed Session with Atty Schellgell. If needed, another Closed Session will be scheduled.
Motion made by Lambert, seconded by Stenberg, to adjourn the meeting at 8:02 pm. Carried.
