Mercer Town Board of Supervisors – May 15th 2008 – Minutes

Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 15th of
May 2008 at 6:30 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Manners, Opal Roberts and Atty Schellgell.

Motion made by Banaszak, seconded by Sendra, to approve the minutes from the May 1st 2008 board meeting. Carried.

Open comment: Marge Pemble gave an update on the Veteran’s Memorial. Sod will be removed in the next couple weeks to prepare for the laying of the memorial bricks. For the 4th of July they will be placing ribbons from the Memorial to the park and asked if the town crew would be available to help with this project. Kichak said yes.
Kelly Kohegyi stated that there will be a school referendum meeting at the school on May 20th at 6:30 pm and invited everyone to attend.

Motion made by Stenberg, seconded by Banaszak, to deviate from the agenda. Carried.

Old Business: a) Discuss Forest Road.
Atty Schellgell had contacted the state plumbing inspector about the 5’ setback for septic systems and was told the town has the ability to waive that provision. Banaszak and Sendra had looked at the road right-of-way and septic location. Banaszak asked if something couldn’t be done about the problem that will be acceptable to all parties involved. There was discussion about the placement of the entry onto Forest Road from County FF. Lambert asked Mr Roberts what he wanted done about this problem. Linda Hamrick stated that Mr Roberts had refused to sell part of the property adjoining Forest Road to them. Kichak suggested that Mr Roberts and the Hamricks discuss the sale of a portion of the property north of Forest Road. The Hamricks can then grant the town the needed land to move the road north to make the septic system legal and to improve the location of the intersection of Forest Road and County FF. Mr Roberts and Linda Hamrick agreed to do this.

Motion made by Lambert, seconded by Stenberg, to move to item 7b. Carried.

New Business: b) Discuss roads in Moose Creek Acres subdivision.
Lambert said that the residents on Musky Point Road had received a letter from the DNR regarding a public hearing to be held about the bridge on one of the roads in the subdivision.
Motion made by Lambert, seconded by Sendra, to table this matter until the next meeting. Carried.

Motion made by Lambert, seconded by Stenberg, to return to the original agenda. Carried.

Old Business: a) Discuss security system for library.
A representative of ADT Systems was present to explain the components of the proposed system to the board. It was decided to have motion detectors with a silent alarm. In the event of an intrusion the Sheriff’s department and the board member in charge of the Community Center/Library building will be notified immediately. The representative gave the costs for the purchase, or lease, of the equipment. After discussion it was decided to lease the system.
Motion made by Lambert, seconded by Stenberg, to lease an ADT security system for the library and Community Center. Carried.

c) Award plow truck bids.
Motion made by Stenberg, seconded by Banaszak, to table this until the next meeting. Carried.

New Business: a) Discuss Fireworks Ordinance.
Atty Schellgell had left the meeting earlier so it was suggested this be tabled.
Motion made by Lambert, seconded by Sendra to table this item until the next meeting. Carried.

c) Sign permit for Great Lakes Carpentry.
This will have to go before the Planning Committee before the board can vote on this permit.
Motion made by Banaszak, seconded by Sendra, to table this until the next board meeting. Carried.

d) Consider donation to Junefest for Porta-Potty rental.
Sherri Younger explained that the event needed three units. Two other organizations have donated money for this purpose and she asked if the town would be willing to donate the monies for the third.
Motion made by Stenberg, seconded by Lambert, to donate the funds needed to the Junefest committee. Banaszak and Sendra are members of the Junfest Committee so they abstained. Carried.

Business Park report/approval of bills. Dianne Keefe presented the bill for her wages as the Financial Officer for the Business Park in the amount of $153.57. The lift station was discussed. Kichak and Stenberg will attend the next Sanitary District meeting. The audit of the Business Park EDA grant will be conducted on the 22nd.
Motion made by Stenberg, seconded by Banaszak, to approve the payment of $153.57 for wages. Carried.

Legal: none.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and the budget report.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.

Communications: Ron Winquist of the Marathon (ICO) station asked if he could apply for a license to sell packaged beer and wine even though he is just across the street from a church. The Clerk will contact the State Alcohol division to see if this limitation applies to a Class “A” license.
In the last Municipality magazine several bills affecting municipalities were passed. Act 33 allows municipalities to authorize the use of Neighborhood Electric Vehicles on specified roads within the municipality. These NEVs will need to be licensed by the state. Act 72 allows a municipality to publish summaries of a new ordinance instead of the entire ordinance.
A premium estimate letter from the Local Government Property Insurance Fund for $5,822.
A seasonal resident on Garnet Street complained that the snow plow had broken off his mailbox post this winter. Kichak said he will take a look at the damage.
An invitation from the school to attend a “Thank You” to the volunteers and students at the Paws Shop, which has won the National Civic Star Award. This will be held on June 2nd at 2:00 pm at the school gym.

Treasurer’s Report – Manners presented the Treasurer’s Report.
The General Account has a balance of $150,808.94. Total of all funds is $1,282,946.21.
Motion made by Lambert, seconded by Banaszak, to approve the Treasurer’s report. Carried.

Board Reports: Chair Report – none.

Garage Report: Wayne Nasi Construction had conducted an on-site inspection of the garage building on April 28th. On May 1st the Clerk’s office received his report listing four areas of concern with the building. The building is approximately 38 years old and would need to be brought up to the new energy and snow load codes. If the town decides to renovate the building instead of building new, we would still be left with a 38-year-old structure. Kichak asked Coleman Engineering for a quote to do the subsurface exploration for the proposed garage building site. They gave a quote of $4200 for five borings. Kichak will contact other firms for boring quotes as he thinks this is rather high. There were letters from residents petitioning for work to be done on Clear Lake and Murray Landing Roads. A letter from Mr & Mrs DeCherrie asking what the town plans to do with Moricoli Road. A letter from Vic Ouimette thanking the town for agreeing to chip seal Catherine Lake Road in 2009.
Kichak suggested the town contribute $500 for ATV signs. There is a person who volunteered to install the signs. The board agreed to contribute $500 for the ATV signs and to charge this to the Road Sign expense account.
The crew is cutting trees on Weber Road. One of the crew is out due to his wife’s illness, so this is slowing work down. The edging of the walking path around the ballpark is being completed. Vacca has been cleaning up and mowing the lawn areas of the Town Hall, Chamber and Vets Memorial. The crew cleaned up the winter debris from the cemetery.
Letters will be sent to several property owners about the unsightly junk on their properties. If not cleaned up within a certain time limit, the matter will be turned over to the county under the Nuisance Ordinance.

Supervisors: Lambert – no.

Stenberg – Gary Jordans complained about not having a Green Meadows sign out on US Highway 51. Green Meadows does not go out to 51. It is an extension of Maple Ridge Road.
Real estate signs are being placed on the road right-of-ways and are a hindrance to the road crews. It was agreed that the crew will remove the signs and take them up to the garage for pick up by the owners of the signs.
The hole caused by the sewer line problem on County J needs to be patched. Kichak will contact the county about this.

Banaszak – Nicolet College is holding a listening session about how they can better serve our township on the 19th at the Community Center.
Jeff Nehring will see that several benches are placed in the cemetery.
She has been in touch with Sen. Jauch’s office about the enhancement grant. His office is trying to do as much as they can in support of this grant. Rep. Sherman’s office said they were in support of the grant, also.

Sendra – The inventory of the street lights is 66% complete. She attended the library building committee meeting on the 19th and possible options of expansion using the present library were discussed.
