Mercer Town Board of Supervisors – June 5th 2008 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 5th of
June 2008 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Manners, and Opal Roberts and Atty Schellgell.
Motion made by Banaszak, seconded by Sendra, to approve the minutes from the May 15th 2008 board meeting. Carried.
Open comment: Neil Hamrick explained that he and Mr Roberts had reached a tentative agreement about Forest Road. The present junction of Forest Road and County Road FF is not safe. He proposed placing the junction further up the hill to give a clearer view of traffic on County FF. There was a discussion of the abandonment of that end of Forest Road.
Sue Heil spoke for five Moose Creek Acres property owners who feel that their property value may not be as much as the purchase price the roads are not complete. This will be discussed under Old Business.
New Business: a) Discuss Snowmobile Watercross on Grand Portage Lake.
Mike O’Brien, representing the Snowmobile Club, stated that as part of the Centennial Celebration on July 4th the Sno-Goers were allotted the 2:30 pm to 3:30 pm time slot. This Watercross race would be in line with the club’s function. Warden Stu Pfieffer said the DNR had no problem with the proposed race. The club needs permission from the town to use the boat landing. The race area will be marked with buoys. Schellgell asked about the club’s liability insurance and asked that the town be listed as a loss payee. The club will contact property owners around the lake to inform them of this activity for that hour.
Motion made by Banaszak, seconded by Sendra, to approve the use of the boat landing for this event. Carried.
b) Camper permit for Lot 33 Dodd Subdivision for Curt & Sue Faga.
This is for a four month permit to park their camper on their property for the summer.
Motion made by Stenberg, seconded by Banaszak, to approve a four month camping permit for Curt & Sue Faga for Lot 33 of the Dodd Subdivision. Carried.
c) Change the name of a section of Plunket Road.
The Northwoods Wildlife and Wetlands Club had sent a letter asking if the town would consider changing the name of the section of Plunkett Road that lies north of US 51 to Range Road. The shooting range has the only fire number on that road. The change of name would provide a better visual recognition to users of the range, especially those from out of the area.
Motion made by Lambert, seconded by Stenberg, to approve changing the section of Plunkett that lies north of US Highway 51 to Range Road. Carried.
d) Amend M-O-U between the Town of Mercer and the Mercer Lake Association.
Doug Childey has asked if he can contact the town’s attorney to refine some of the statements in the M-O-U previously approved by the town but not signed by the Lake Association. This permission was given. No other action needed to be taken.
Business Park report/approval of bills. Dianne Keefe presented bills in the amount of $4,159.25 to pay the auditors and the final bill from SEH. Kichak and Stenberg had attended the last Sanitary District meeting. The town agreed to pay for half the bill for the hourly wage of the Sanitary District employees during the filming of the pipe lines last year.
Motion made by Banaszak, seconded by Lambert, to approve payment of $4,159.25 for two bills. Carried.
Old Business: a) Sign permit for Great Lakes Carpentry.
This had been given to the Planning Commission for review and Stenberg stated it had been approved by them.
Motion made by Stenberg, seconded by Lambert, to approve the sign permit for Great Lakes Carpentry. Carried.
b) Discuss Fireworks Ordinance.
After much discussion about the proposed ordinance the clerk had drawn up from various samples on the internet of ordinances used by other towns, the board decided to strike out most of the restrictions and go with a short ordinance limiting the days and times fireworks displays would be permitted.
Motion made by Lambert, seconded by Stenberg, to remove paragraphs b and c of section one and a, b, c, d, e, g, and h of section two, and to include the Tuesday night before Loon Day and the evening of Loon Day in the times permitted paragraph. Addition of a penalty paragraph stating a fine of $50.00 for the first offence and $250.00 for the second offence. Carried.
c) Re-application of Conditional Use for Boathouse by Jim Trotnow.
Mr Trotnow was not present to restate his application.
Motion made by Stenberg, seconded by Lambert, to re-deny the application. Carried.
d) Discuss the paving of roads in Moose Creek Subdivision.
Kichak reported that the subdivision developer, Richard Mazol, has asked for paving bids from Pitlik & Wick. Discussion was held about what roadwork has been completed so far, and there were questions about several other provisions in the subdivision plat. When Pitlik & Wick are in the process of reviewing the road work to be done, Kichak and Atty Schellgell will meet with them to discuss what needs to be done before the town will accept the roads in that subdivision.
e) Award Plow Truck bid.
After reviewing the specifications and bid prices again, Kichak suggested the board accept the bid from Mid-State International Truck over the higher bid by Peterbilt of Wausau.
Motion made by Banaszak, seconded by Sendra to award the bid to Mid-State International Truck for $68,925 for a plow truck. Carried.
Legal: none.
Officer Reports: Clerk’s Report - Roberts presented the receipts list and the vouchers.
Motion made by Lambert, seconded by Stenberg, to approve the vouchers and issue the checks. Carried.
Communications: The Sanitary District submitted a petition to remove the Bouska property from the district.
Tom Bescha donated sound equipment with a value of $850 to the Community Center.
Copy of a letter from State Senator Bob Jauch to Secretary of the DOT about the inequalities of most of the money distributed for transportation grants going to the southern half the state.
Letters from US Senator Feingold and Governor Doyle expressing their regrets for not being able to attend our centennial celebration.
A note from the Sanitary District about not charging the town for the water service in the cemetery.
A “Thank You” from the DNR for the snow plowing of Sportsmans Landing.
The Clerk received a quote for a new copier. It was suggested that EOJohnson and Tri-State Business be contacted for quotes, also.
Treasurer’s Report – Manners presented the Treasurer’s Report.
The General Account has a balance of $110,269.93. Total of all funds is $1,242,437.20.
Motion made by Lambert, seconded by Banaszak, to approve the Treasurer’s report. Carried.
Board Reports: Chair Report – none.
Garage Report: the crew has been working on the manhole in the alley behind Tom’s Cafe. One of the problems with the pipe was created when the utility company cut the storm sewer drain while burying a line.
Swamp Creek and Moose Creek Roads are being worked on. All the trees are cut on Weber Road. There are several rock shelves that will need to be blasted. The permit for the culvert on Wilson Lake Road came in this week. The paving bids will be opened at the next meeting for the road projects. The work for the park project will be started soon. The yard clean-up week went well. He contacted John Malone and told him he needs to clean up his mess or it will be turned over to the county. The town may be interested in purchasing the trailer park property from Mr Malone to add to the Business Park and it was suggested an appraisal be obtained. Northern Environmental submitted a quote of $3,900 for the soil borings for the salt shed location. This is $300 less than the Colman Engineering quote. Trail signs needed for the ATV routes will cost approximately $3,000. The board agreed to take this amount from the Contingency fund. A budget amendment will be on the next meeting agenda.
Kichak did not sign the final subdivision plat sent down from Colman Engineering because the stipulation of the public access area not being recorded as walk-in only. There was also one lot listed as an “exception” that was not listed that way on the final plat presented to the town board.
Supervisors: Lambert – there is gravel on the town roads in the areas where the ATVs cross the roads that needs to be removed by the road crew.
Stenberg – The Planning Commission adopted a resolution recommending an amendment to the Mercer Comprehensive Plan. This will be an agenda item for the next meeting. Has Kichak asked the County about paving the hole on county J? The lift station in the Business Park is up and running. There is a leak in one of the elbows but A-1 will have to repair that. The Security System is installed at the library. He was asked if the town would allow Mr Bouska to start his septic and water before being removed from the Sanitary District. Schellgell said he would not advise this. Mr Johnson has been informed of the approximate cost of paving the roads in the cemetery.
Banaszak – Representative Sherman will be present at the dedication of the Pocket Park at 1:30 pm on June 28th. Could the town purchase three benches for the cemetery? It was suggested the town have the shop class build the benches next fall. She attended the listening session Nicolet College held at the community center. Is the trip to look at the salt sheds other towns have built still planned?
Sendra – none.
For Consideration and Approval: a) Liquor/Operators Licenses: Temporary Beer Permit for the American Legion.
Motion made by Banaszak, seconded by Sendra to approve the Temporary Beer permit for the American Legion on August 2nd at the Community Center. Carried.
