Mercer Town Board of Supervisors – June 18th 2009 – Minutes


Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 18th of June 2009 at 6:30 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Opal Roberts, and Atty Schellgell. Absent: Jim Lambert and Christan Manners/Brandt

Motion made by Banaszak, seconded by Sendra, to approve the minutes from the June 2nd 2009 Public Hearing and the June 4th 2009 regular town board meeting. Carried.

Open comment: George Melewski informed the board that the newer section on Fisher Lake Road East is in need of crack sealing. Kichak said that will be done this year if there is enough money in the budget, if not, this will be placed in next year’s budget.
Doug Calendine wanted to make a comment on the proposed ATV route on Fisher Lake Road East. This is not on the agenda because Mr Elzer requested it be placed on the agenda for July 2nd. Mr Calendine will be unable to attend that meeting but will send a letter to the clerk stating his opinion on the proposed ATV route. Mr & Mrs Calendine complimented the town on the road work at the Fisher Lake boat landing.

New Business: a) Discuss/Approve the County Tourist Rooming House permit for 1983W Roamer Road owned by R Rosa/G Wirtanen/K Markwardt.
This was formerly a resort. There was no objection to the licensing of this dwelling as a Tourist Rooming House.
Motion made by Banaszak, seconded by Sendra, to approve the County Tourist Rooming House permit for 1983W Roamer Road owned by Robert Rosa, George Wirtanen and Kellie Markwardt. Carried.

b) Discuss/Approve ATV Route on County Road J from 1599W County Road J to Beaver Lodge Circle.
Kichak stated that the County Highway Committee had discussed this at the last meeting. This section along County J is fairly level and straight so would not be considered a safety hazard.
Motion made by Stenberg, seconded by Banaszak, to approve the use of the section of County Road J from 1599W County Road J to Beaver Lodge Circle as an ATV route. Carried.

c) Open/Award propane bids.
There were three bids: Hilgy’s L P Gas at $1.29 per gallon; Midland Services at $1.37 per gallon; Ritchie Lakeland Oil Company at $1.098 per gallon.
Motion made by Banaszak, seconded by Stenberg, to award the propane contract to Ritchie Lakeland Oil Company at $1.098 per gallon for the 2009-2010 heating season to run from August 1 2009 to May 31 2010. Carried.

d) Discuss/Approve Iron County Recycling Agreement.
The Mercer recycling employees are working 13 hours per week and the agreement states they are allowed a maximum of 10 hours per week.
Motion made by Banaszak, seconded by Sendra, to approve the Addendum to the Iron County/Municipality Recycling Cooperative Agreement with the correction “for a maximum of 13 hours per week”. Carried.

e) Discuss/approve Forest Fire Protection grant application.
This is a grant application for personal fire fighting equipment and the construction of dry hydrants. The amount requested is $12,327. This is a 50-50 match so the town will need to budget $6,163.50 for our share of the grant.
Motion made by Stenberg, seconded by Banaszak, to approve Resolution 2009.04 to apply for a Forest Fire Protection Grant. Carried.

Chief Altman informed the board that the Sanitary District is considering capping the fire hydrant by the Fire Station. Stenberg asked why the Sanitary District, with what they charge for Fire Protection and water rates, would think about shutting off a hydrant by the fire station. Kichak asked Sendra to inform the Sanitary Board that the town does not look favorably on this proposed hydrant shut off.

f) Appoint Regional Trail Committee members for Mercer.
Chairman Kichak appointed Bonnie Banaszak and Toni Sendra to the Regional Trial Committee to represent the Town of Mercer.

Old Business: a) Discuss/approve Eich Subdivision Agreement.
Atty Schellgell stated that the agreement he had drafted needed some changes since Mr Eich removed the cul-de-sac from the survey map. He will make the required changes to the agreement. No action was needed by the board.

Legal: Atty Schellgell had researched old files for 1993 and found several documents dated in October relating to the request by John Pierpont to abandon the section of Pierpont Drive from the east subdivision line to the newly constructed road now named Lake Tahoe Drive. The map, presented at that time, shows the abandoned portion was to go up to the new road. This would include the short section of road on the Jack English property. The Clerk will send copies of these documents to Mr English, Martha Pierpont and John Pierpont Jr.
The possibility of a subdivision with platted roads, but not accessed by a public road, being developed is a concern. If the developer constructed the roads in the subdivision to town specifications, then the town would have to accept them. Even if the developer had an easement to this subdivision, there is no requirement that the easement be built to road specifications and could pose a serious problem to the town. One way of preventing this would be to have the county amend their ordinance to allow the town the option of whether or not to accept the roads in a platted CSM.
The state ethics board has not answered his query about board members and the room tax ordinance vote.
Jeremy Coates has applied to the County for a Conditional Use permit to place a fifth wheel mobile home on his property on Little Pike Lake Road. This would require an annual vehicle permit from the county and approval by the Mercer Board of Supervisors. This will be on the next meeting agenda.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and budget report.
Motion made by Stenberg, seconded by Sendra, to approve the vouchers and issue the checks. Carried.

Communications: Cover-All sent the contract for the front corners of the salt shed. The price is $1,214.00.
The Clerk has a new computer because the old computer developed a hard drive problem. Professional Computers will deduct $100 from the bill for the new computer as a trade-in.
Letter from the Turtle Flambeau Flowage Association naming the two members selected to be on the Room Tax Committee. Also a letter asking if the ATV route signs could be installed on County FF. Kichak said Kessenich will get the signs up Monday.
Rich Zenisek, who handles the town’s health insurance account with Wisconsin Benefits, is no longer in their employ. He would like the town to make a “change of agent” from Wisconsin Benefits to him. This will be placed on the next agenda.
Sanitary District letter from their lawyer stating the residency requirement for voting for a SD Commissioner. We already knew that! The question was if this requirement could be changed to include the owners of businesses in the district but who live out of the SD.
Aramark gave the town a quote for the uniform service presently provided by AmeriPride. The savings would only amount to about $10.00 per month. The Board will consider this at the next meeting.
Appraisal report from the DNR for the property in Section 10, T43N, R2E for the Moose Lake State Natural Area. The DNR also sent a notice for a meeting to be held in Park Falls on Friday June 16th at 3:00 pm to discuss the proposed Preferred Alternative and Options management course for the Flambeau River State Forest.
Mr Ouimette had asked about way-finding signs at road intersections. The state has requirements for these way-faring signs and a copy will be given to him.

Treasurer’s Report – In the absence of Manners/Brandt, Roberts presented the Treasurer’s report. The General Account has a balance of $117,718.30. Total of all funds is $1,255,616.35.
Motion made by Banaszak, seconded by Sendra, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: The boat landing on Fisher Lake has been repaired. The town will need to hire a contractor to paint the crosswalks on Highway 51 due to the liability requirements. Gravel crushing is complete. Work is started on Fisher Lake Road East. Almost done with Beaver Lodge Circle road bed preparation. Sometime next week he will lease the trucks to get the gravel hauled to the site. He will see that the ATV signs are put up on County FF early next week. The crew had graded Swamp Creek and Moose Lake Roads so the date can be set for the road patrol.

Supervisors: Lambert – (absent)

Stenberg - The Evergreen Energy prototype plant is now in operation and if everything goes as planned they will be building the main plant next year. It will take about five more weeks to get all the oxygen out of the system. Karen Graf, from Senator Feingold’s office, was there last week and was impressed with the operation. There is a company from Australia interested in the prototype structure when the main plant is in operation.

Banaszak – none.

Sendra – Murray from Xcel Energy would like a copy of her list of Mercer street lights to compare with theirs and update their inventory. The Sanitary District would like to know when the next meeting with the DOT is planned. Banaszak said sometime in August. Bill Brundage had asked her what the town had decided to do about the problem with standing water near the junction of Lakeshore Drive and County J. Kichak said this area will need to be ditched to get the water off the pavement when it rains or from melting snow.

For Consideration and Approval: a) Temporary Beer Permit. – for the Mercer Education Foundation at the Community Center for June 17 2009; for the Mercer Lioness Sock Hop at the Community Center on July 3 2009; for the Greater 4th of July Committee at Carow Park on July 4th 2009.
Motion made by Sendra, seconded by Banaszak, to approve the Temporary Beer permits for the organizations listed above. Carried.

Motion made by Banaszak, seconded by Sendra, to approve the liquor licenses for the above listed businesses contingent upon payment of all outstanding personal property taxes, liquor bills, and any State of Wisconsin restrictions. Carried.

Motion made by Sendra, seconded by Stenberg, to approve the Operator’s Licenses for the applicants listed above. Carried.

Cemetery: for Jesse Kochajkiewicz for a site in Section 4, Block 21, Plot 4, Site 1; for Harriet Wacura for a site in Section 4, Block 21, Plot 1, Site 6.
Motion made by Banaszak, seconded by Sendra, to approve the sale of the above mentioned cemetery sites. Carried.
