Mercer Town Board of Supervisors – June 17th 2010 – Minutes

Chairman Kichak called the meeting of the Town of Mercer Board of Supervisors to order Thursday June 17th 2010 at 6:30 pm in the Haines Civic Building (Town Hall).

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Charles Schroepfer, Opal Roberts, Christan Brandt, and Atty Schellgell.

Motion made by Banaszak, seconded by Stenberg, to approve the minutes from the June 3rd 2010 Town Board meeting. Carried.

Open comment: Wayne Riebe reported that he and Bob Weinkauf are trying to work with the Iron County Forestry department for an ATV trail to Popko Circle. Still running into obstacles with state land.
Diane O’Krongly asked if there would be a public hearing for establishing this ATV trail. She was told it would definitely be an agenda item and, if necessary, a Public Hearing would be held.
Jennifer Geisler, of Heart of the North Bar, asked if the section of Lakeview Avenue between US Highway 51 and Around the Corner Pub could be barricaded off. This will be placed on the next agenda.
Bill Brundage reported that the culvert placed on Lakeshore Drive has developed an erosion problem. Kichak will have the crew work on the repair.

New Business: a) Conditional Use permit to construct a seasonal residence and storage garage on property located within an F-1 district on property in the NE-SW, Sec 31, T42N, R2E owned by Five Brothers LLC.
Discussion was held about the board not being in favor of the DNR allowing buildings on private forest crop land.
Motion made by Schroepfer, seconded by Stenberg, to approve the Conditional Use for Five Brothers with the stipulation that the property the house and garage would occupy be removed from private forest crop land. Carried.

b) Conditional Use permit to operate a Tourist Rooming House at 5018N Little Pike Lake Road owned by Nancy Jorgensen.
Lambert stated he had informed the owner of the property in question that he should cease rentals until he had obtained the town Tourist Rooming House permit. In a printed statement from Ron Hjerstedt, who lives at 5075N Popko Circle East, he strongly objected to a TRH permit being granted this residence.
Motion made by Schroepfer, seconded by Banaszak, to approve the Conditional Use for a Tourist Rooming House at 5018N Little Pike Lake Road owned by Nancy Jorgensen. Stenberg voted “no”; Kichak voted “no”; Lambert abstained. Motion not carried.

c) Open/Award Seal Coating bids.
Three bids were received:
Scott Construction 1.4 miles $41,701.14 1 mile $32,957.99 = $74,659.13
Fahner Asphalt 1.4 miles $40,245.33 1 mile $38,590.19 = $78,835.52
Pitlik & Wick 1.4 miles $39,937.00 1 mile $29,450.00 = $69,387.00
There was discussion about the equipment of the companies providing the bids. The board thought it best if the seal coating was done using equipment that could lay the coating in one pass. Both Scott Construction and Fahrner have such equipment. Pitlik & Wick would need to make two passes for the width of the road.
Motion made by Stenberg, seconded by Lambert, to award the Seal Coating bid to Scott Construction. Carried.

d) Discuss/approve garage lighting quote.
Schroepfer had received three quotes so far and still waiting for another one that might come in. The quotes were for conversion kits and with the cost of each kit it might be advisable for the town to replace the lights instead. He will check into this possibility.
Motion made by Schroepfer, seconded by Stenberg, to postpone this item until the next regular meeting. Carried.

e) Discuss/Approve appraiser for Malone property adjacent to Business Park
This would be for an appraisal only. It is not feasible for the town board to think about the purchase of any property at this time. Stenberg reported that banks will not make loans to interested buyer of lots in the Business Park until the area is cleaned up. A letter will be sent to John Malone.
Motion made by Banaszak, seconded by Stenberg, that no appraisal be done on the Malone property. Carried.

f) Amend ATV ordinance to include Circle Lily Road.
There was no objection from anyone about this question.
Motion made by Lambert, seconded by Schroepfer, to amend the ATV ordinance to add Circle Lily Road to the ATV routes. Carried.

g) Discuss/Approve Landscaping match monies.
The landscaping plan of the walk/bike path submitted to the DOT was reviewed. There would be a $30,000 match required from the town for the project. Margaret Pemble was present and presented a landscape and path plan for the Veteran’s Memorial area. The short cross road needs to be re-sloped to permit handicap access. Kichak stated that the road work can be done by the town.
Motion made by Schroepfer, seconded by Stenberg, to approve the $30,000 match monies for the project. Carried.

h) Approve sale of brush rake.
Kichak said Trolla may be able to sell the brush rake for $2,300 to $2,500.
Motion made by Lambert, seconded by Stenberg, to approve the sale of the brush rake. Carried.

i) Discuss/approve paving at Carow Park.
Two quotes from Pitlik & Wick for a total of $5,585 were received for the paving of the path and the bumpouts for the park benches.
Motion made by Banaszak, seconded by Stenberg, to approve the paving quotes from Pitlik & Wick in the amount of $5,585 for Carow Park. Carried.

j) Discuss/Approve street dance in alley behind Around the Corner Pub on August 13th 2010 in appreciation of all residents of Mercer, sponsored by members of Downtown Development.
Motion made by Lambert, seconded by Schroepfer, to approve the closing of the alley behind Round the Corner Pub for a street dance on August 13th. Carried.

k) Discuss/Approve Around the Corner Pub 10th Year Anniversary dance in alley behind Pub on September 11th 2010.
Motion made by Banaszak, seconded by Stenberg, to approve the closing of the alley behind Round the Corner Pub for a street dance on September 11th. Carried.

l) Discuss/Approve dumpster contract with Veolia.
Motion made by Stenberg, seconded by Lambert, to approve a one year contract with Veolia for a two yard dumpster at the Fire Station. Carried.

Old Business: a) Amend ATV route ordinance to include Wilson Lake Road
Motion made by Lambert, seconded by Schroepfer, to approve the addition of Wilson Lake Road to the ATV route system with a 25 mile per hour speed limit with a three month probationary period. Carried.

Legal: Schellgell explained that if a Tourist Rooming House required a Conditional Use permit then the county would have to enforce the TRH. Otherwise the town chairman would need to issue the citation and then send it up to the county court.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and budget report.
Motion made by Lambert, seconded by Banaszak, to approve the vouchers and issue the checks. Carried.

Treasurer’s Report – Roberts presented the Treasurer’s report. The General Account has a balance of $86,949.02. Total of all funds is $1,480,594.87.
Motion made by Stenberg, seconded by Schroepfer, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: He had a call from EMCS telling him it would cost $80,000 to widen Railroad Street. He thought this estimate was too high. The crew is still working on Murrays Landing Road. Rain is slowing the work. He checked on the problem reported by a property owner on Fisher Lake Road and told them they would need to put a culvert under their driveway. Mowing of road sides will have to start soon since the grass is so tall from all this rain. He will be seeking crack sealing quotes in July.

Supervisors: Stenberg – none.

Lambert – none.

Banaszak – there will be a public information meeting on the DOT project on July 6th at 4:30 pm. The surveys for the residents in the Sanitary District have been mailed. WISCAP will be asking for $70.00 to cover the cost of the mailing. The Hike/Bike path application deadline has been moved up to August. She will be attending a workshop in La Crosse on grant writing for this project and the board granted mileage for attending this meeting.

Schroepfer – the Fire Department will be installing the two dry hydrants. One on Swamp Creek and one by Lake of the Falls campgrounds. The DOT may request that the Sanitary District move some of their water/sewer lines for the Hwy 51 project. He wanted to thank the organizers of the Lupine Junefest. It went well in spite of the gloomy weather. He talked to Kai Kempen and was told the rain had them behind in their work but that they hoped to get to the library sidewalk sometime next week. The Meat Raffle held by the Library Fundraising Committee at Around the Corner Pub was very successful. Snow’s Market donated all the meat. He and Heather Palmquist did a survey of the poison ivy areas. It would be expensive for the town to purchase our own herbicides so he asked if the county could be talked into selling us what we need.

Public Comment: Kathie Tutt asked when Weber Road would be chip sealed. Kichak said this fall.
O’Krongly again stated her opposition to ATV trails any where near Popko Circle. She said our area is different from the northern part of the county and we do not need what they have. Lambert said the board did not open Popko Circle and therefore would not open all sections of County FF.
There was discussion about the decision of the School Administrator to not allow students in Sherman Township to transfer to the Mercer School without this question being discussed at a regular school board meeting where the public could state their opinions. The next school board meeting is on June 28th and the town board should attend to ask how and why this decision was made.

For Consideration and Approval: Temporary Beer permits for: Lions Spaghetti Fest to be held June 26th 2010 at the Mercer Senior Center; and for the Mercer 4th of July Committee to be held July 4th 2010 at Carow Park.
Motion made by Lambert, seconded by Stenberg, to approve the above named Temporary Beer permits. Carried.

Liquor License applications: Anchor Inn, Antler’s Pub, Around the Corner Pub, Arrowhead Resort, Beaver Lodge, Dawn’s Beaver Resort, Camp One, Chatterbox Eatery & Pub, Donners Bay Resort, E & L Café, Citgo Qui Food Mart, Dear Lodge, Fisher Lake Inn & Resort, Gateway Lodge, Heart of the North Bar, Moe Miller’s Cottages, Johnny’s Bar & Grill, Lazy Ace Saloon, The Hideaway, Pine Forest Lodge, The Pines Miniature Golf and Arcade, Porky’s, Rugger’s Landing, Tahoe Lynx, Tip Top Resort, Ulman’s Ding-A-Ling Supper Club, The Wolf’s Den, Snow’s Family Market, and Mercer BP Amoco.
Motion made by Banaszak, seconded by Stenberg, to approve the above listed Liquor Licenses contingent on payment of all outstanding taxes, liquor bills and forms required by the state. Lambert abstained. Carried.

Motion made by Schroepfer, seconded by Banaszak, to approve Operator’s Licenses for the above listed. Carried.

Cemetery Deeds: Transfer from Jean Sislo to Denese Oderman sites in Section 3, Block 13, Plot 1, Sites 1 & 4.
Motion made by Banaszak, seconded by Stenberg, to approve the transfer of the cemetery sites from Jean Sislo to her daughter, Denese Oderman , the sites in Section 3, Block 13, Plot 1, Sites 1 & 4. Carried.
