Mercer Town Board of Supervisors – July 2nd 2009 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 2nd of July 2009 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Manners/Brandt and Opal Roberts. Absent: Atty Schellgell.
Motion made by Sendra, seconded by Banaszak, to approve the minutes from the June 18th 2009 town board meeting. Carried.
Open comment: Matt Schmidt informed the chairman that the Regional Trail Committee has not been established and the appointment of Banaszak and Sendra was to a non-existent committee.
New Business: a) Conditional Use permit for 15x24 addition to an existing garage to use as a temporary dwelling at 5765N Payment Lake Road owned by Troy & Cynthia Frank.
Banaszak had a question as to what the structure will be used for after the home is built. Stenberg asked about the timetable for building the home. The clerk will contact Mr & Mrs Frank about these questions.
Motion made Lambert, seconded by Stenberg, to postpone this matter until the next regular meeting. Carried.
b) Conditional Use permit for 28x40 building at 3500W Turtle Rapids Lane owned by Richard Petz.
Bonnie asked if the accessory building was too close to the well. The Zoning Administrator has looked at the site.
Motion made by Stenberg, seconded by Sendra, to approve the Conditional Use permit for 28x40 building at 3500W Turtle Rapids Lane owned by Richard Petz on the condition it not be used for human habitation or commercial purposes. Carried.
c) Conditional Use permit to place a fifth wheel mobile home on property at 4616N Little Pike Lake Road owned by Jeremy Coates.
The adjoining property owners, Jay & Joyce Leder and Kay Zerndt expressed no objections to allowing a fifth wheel recreation vehicle to be placed on this property. Kay Zerndt asked if this property couldn’t be grandfathered in since Coates is one of the original property owners and there was, at one time, a mobile home there. Andy Fowler and Tom Teague argued against this. Fowler said there are already five trailers on the lake and Teague stated there is a reason we have an ordinance prohibiting this. Atty Schellgell wasn’t able to be present and had requested this matter be postponed until the July 16th meeting.
Motion made by Banaszak, seconded by Sendra, to postpone this matter until the next regular board meeting. Carried.
d) Discuss/Approve change of health insurance agent.
The Town had appointed WI Benefits as our insurance agent, not a specific person. Rick Zenisek had been handling our account but was no longer employed by the company. He had asked the board to approve a change of agent so he could continue to represent the town.
Motion made by Lambert, seconded by Banaszak, to keep WI Benefits as our health insurance agent. Carried.
e) Discuss/approve change of garage uniform provider.
The Clerk has been comparing costs but has questions for Aramark.
Motion made by Stenberg, seconded by Sendra, to postpone this matter until the next board meeting. Carried.
f) Set date for Supervisor Rood Patrol.
The Board set Thursday July 9th beginning at 8:00 am for the supervisors to do the road patrol.
g) Budget Amendment.
Motion made by Banaszak, seconded by Sendra, to amend the budget by increasing the revenue item County Timber by $15,000 (to $30,000) and increase the expense item Road Gravel by $15,000 (to $65,000). Carried.
Old Business: a) Discuss/Approve ATV route on Fisher Lake Road East from Lori Ann Lane to Fisher Lake Road.
Doug Calendine expressed his objections to the noise, destruction and unsafe operation of the ATVs. John Elzer, who requested the route be approved, gave his reasons for wanting this as an ATV route. Adam Kussard asked how many problems were reported from the use of Fisher Lake Road by ATVs. The answer was none.
Motion made by Stenberg, seconded by Banaszak, to approve the use of Fisher Lake Road East from Lori Ann Lane to Fisher Lake Road as an ATV route with the stipulation that if this causes unsafe problems in the future, it will be closed. Carried.
Legal: none
Officer Reports: Clerk’s Report - Roberts presented the receipts list and vouchers. The Clerk reported that the water fountain in the library could have been replaced with a new one for the cost of having the old one repaired.
Motion made by Lambert, seconded by Stenberg, to approve the vouchers and issue the checks. Carried.
Communications: The Board of Commissioners of Public Lands has purchased a 3002.22 acre parcel from Potlatch Forest Holdings. They will be making a PILT payment to the town for $1,267.45.
From the DNR a copy of the Appraisal Transmittal for the 40 acre parcel on Maple Ridge Road. If this is accepted by the Board of Commissioners of Public Lands then the DNR will own this property and will consider trading this parcel for a parcel on Popko Circle West owned by the town.
A copy of the letter from the Health Department sent to the owner of the outdoor wood burning unit causing smoke problems to nearby properties.
A letter from Jack English stating his views on the legal opinion given by Atty Schellgell at the last board meeting regarding the road to the English cabin.
Letter from Maryann Brown expressing her concerns about the Room Tax Ordinance meeting held on June 24th.
Letter from Cary & Molly Chablowski, who own property at 5061N Beachway Drive, asking that the town and the WI-DOT address the run-off problems the property owners have who live on the lake side of this road.
An email from the DNR about the 2009 gypsy moth aerial spraying program.
Treasurer’s Report – Manners/Brandt presented the Treasurer’s report. The General Account has a balance of $67,852.92. Total of all funds is $1,205,750.97.
Motion made by Lambert, seconded by Banaszak, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: The road bed work is done on Beaver Lodge Circle and the crew has moved out to Fisher Lake Road East. A “wobble-wheel” was used to pack down the road bed on Beaver Lodge Circle and it does a great job of packing but it broke down. Meverden did a good job of crushing the gravel for the road projects. He talked to the county Forestry department and the company cutting timber off of Fisher Lake Road will cut the trees on the town road right-of-way for us. Carl Hertel is mowing the road sides. The crew is doing more patching and some of the curbs in town need repair again. Pitlik & Wick will give the town a bid on the path in the park down to the gazebo. The lights are installed in the Park. The walls are up for the salt shed. The week long clean-up is going well.
Supervisors: Stenberg – the air conditioning at the Community Center is not working and he will have Thompson’s Heating look at it tomorrow. The alarm problem at the library is still not resolved.

Banaszak – she is working with the Fire Chief on a FEMA grant for new doors at the Fire Station #2 on County FF and an exhaust system..
Sendra – while she was checking out the Coates property on Little Pike Lake Road she noticed building construction that seems to have been going on for a while. How long are people allowed for the completion of their buildings?
For Consideration and Approval: a) Liquor Licenses/Beer Permits. – none
Operator’s Licenses to approve: Lynn Langhoff, James Langhoff, Charles Zradicka, Candice McCampbell, Mary Emerson, Thomas Olson and Debra Savage.
Motion made by Stenberg, seconded by Sendra, to approve the Operator’s Licenses for the applicants listed above. Carried.
