Mercer Town Board of Supervisors – July 1st 2010 – Minutes

Chairman Kichak called the meeting of the Town of Mercer Board of Supervisors to order Thursday July 1st 2010 at 6:30 pm in the Haines Civic Building (Town Hall).

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Charles Schroepfer, Opal Roberts, and Christan Brandt. Absent: Atty Schellgell.

Motion made by Schroepfer, seconded by Banaszak, to approve the minutes from the June 17th 2010 Town Board meeting. Carried.

Open comment: Dianne Keefe presented the town with a framed photo collage of the Veteran’s Memorial.

New Business: a) Reconsider Five Brothers Conditional Use stipulation.
The board had approved the Conditional Use with the stipulation that enough property for the dwelling and garage be taken out of private forest crop. Dean Sherwinski was present to explain that by doing this he would penalized for taking land out of forest crop before the end of the contract, which only has five years remaining. After considering the cost to supply power to the site and its occasional use, he has decided not to build the dwelling and to ask the county to change the Conditional Use to just the accessory building.
Motion made by Banaszak, seconded by Stenberg, to approve the Conditional Use for a 30x40 accessory building on property in the NE-SW, Sec 31, T42N, R2E owned by Five Brothers LLC, under the condition it not be used for human habitation or commercial use without proper permitting. Carried.

b) Conditional Use permit for a 36x42 building at 2146W Beaver Road owned by James & Kathryn Storck.
Motion made by Schroepfer, seconded by Lambert, to approve the Conditional Use for a 36x42 building at 2146W Beaver Road owned by James & Kathryn Storck, under the condition it not be used for human habitation or commercial use without proper permitting. Carried.

c) Conditional Use permit to operate a Tourist Rooming House at 5094N Musky Point Road owned by Robert & Pamela Ewig.
Banaszak had concerns about whether or not the resident agent would be able to undertake this appointment.
Motion made by Stenberg, seconded by Schroepfer, to approve the Conditional Use for a Tourist Rooming House at 5094N Musky Point Road owned by Robert & Pamela Ewig. Lambert abstained. Carried.

d) Closing of street for 4th of July between Hwy 51 an Around the Corner Pub.
Motion made by Lambert, seconded by Banaszak, to allow the closing of Lakeview Avenue between Highway 51 and Around the Corner Pub on July 4th for a street dance.. Carried.

e) Discuss Comprehensive Plan amendments.
The Planning Commission had met on June 17th to discuss amendments to the Mercer Comprehensive Plan regarding current densities of land use categories. Recommendations were to change “Forest Residential” to “Rural Residential” with density changed from 60,000 sq. ft. (outside shorelands) to 135,000 sq. ft. (approximately 3.1 acres). With public sewer from 40,000 sq. ft. to 67,500 sq. ft. (approximately 1.5 acres). Change “agricultural” dimensions from 2 acres to 35 acres. Change Forestry density from 60,000 sq. ft. to 5 acres. Include the addition of 7 miles of the Northern Highlands Regional Multi-Use Trail System in the Comprehensive Plan as long as it does not interfere with snowmobile or ATV trails.

f) Resolution to conduct Public Hearing to amend Comprehensive Plan.
Motion made by Lambert, seconded by Stenberg, to approve the Resolution to conduct a Public Hearing to amend the Comprehensive Plan. (see attached) Carried.

Old Business: a) Reconsider Conditional Use for a Tourist Rooming House permit for Nancy Jorgensen.
Nancy Jorgensen and her son, Jason, were present to ask the board to reconsider the denial of the conditional use permit. Ron Hjerstadt, an adjacent property owner, was also present. After much discussion the board agreed to approve the conditional use, but if any further official complaints are made to the Sheriff’s department of disruptive behavior by any renters, then this conditional use permit would be invalid. Hjerstadt agreed to this stipulation.
Motion made by Stenberg, seconded by Banaszak, to approve the Conditional Use permit for a Tourist Rooming House for property located at 5018N Little Pike Lake Road owned by Nancy Jorgensen with the above stipulation.. Lambert abstained. Carried.

b) Discuss garage lights
Schroepfer stated that there will be five lights replaced above the work area to begin with to see how much of an improvement this makes. The remainder of the 19 lights will be replaced gradually. Costs for the new fixtures will range from about $52 to $66 each according to the three quotes he received.

Legal: none.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, and vouchers. The Fire Dues check was received in the amount of $8,812.92.
Motion made by Lambert, seconded by Stenberg, to approve the vouchers and issue the checks. Carried.

Email from Heidi Baar suggesting more trees be planted in Carow Park between the buildings and the lake. The Public Information meeting for the Highway 51 project will be held Tuesday, July 6th from 4:30 to 7:00 pm at the Community Center. A request from a property owner for an exception to the dwelling size minimum of 22’x22’ to accommodate his conversion of an accessory building to a dwelling. This will be placed on the next regular meeting agenda.

Treasurer’s Report – Brandt presented the Treasurer’s report. The General Account has a balance of $66,667.50. Total of all funds is $1,460,313.35.
Motion made by Lambert, seconded by Banaszak, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: Patching of the downtown area was completed in preparation for the 4th. He will have the crew place topsoil along the new paved path at the park. The crew is still working on Murrays Landing Road. There were a number of wash out repairs due to the rains. The county has agreed to move the Welcome to Mercer sign to its new location near the county line on FF. Central WI Body & Hoist sent a quote for all the equipment for the new chassis for $52,954. The garage will do the lettering and decals on the truck doors.

Supervisors: Schroepfer – the new concrete sidewalk has been poured at the library. They will come back and give it a seal coat within the month. Heather Palmquist said the Land Conservation department will give the town $100 towards the cost of herbicides. The poison ivy along County J is thick in some areas. He asked about the status of Northern Trails Drive off of County H. The crew has a problem with turning around there. Has the town taken this over? Kichak replied that the town had agreed to rebuild and pave it at the property owner’s expense but nothing has been done to date. A stop sign needs to be placed at the intersection of Turtle Rapids Lane and US 51. The Garden Club would like to place a waste container at the pocket park like the one at the Mercer Lake boat landing. The board had been given the road survey results prepared by the road crew for their various routes. The board should consider this report when making the Road Plan.

Banaszak – the Guy White subdivision needs to be rezoned from F-1 to R-2. Apparently the plat was never approved by the county. There is a question on whether or not the plat was legally recorded. There will be a meeting at 8:00 am tomorrow morning at the town hall to discuss with the town engineer and Schellgell to discuss the estimated costs presented by DOT for the Highway 51 project. There will be a meeting in Rhinelander on the 27th and the town needs to have all the information in to the DOT engineers by the 21st. She will be meeting with Carolee Russell (WISCAP) tomorrow morning at 10:00 am. They need 70 additional people to respond to the survey so they will be going door to door. She attended the Hike/Bike grant training session in LaCrosse last week and it was a very, very good meeting. Most of the attendees were applying for Safe Routes money and not the Bike path projects so it looks very good for anyone applying for those. Where are we with the Malone blight problem? Kichak said he will contact him tonight and explain that he will be receiving an official letter from the town. Lambert said blight letters need to also be sent to the owners of the old toothpick factory on FF, the old Gerlach property on Old 51, and to Larry Kessenich for the property across from the Post Office.

Lambert – A mile of seal coating is planned for Murrays Landing Road. There is a .4 section left that will be gravel between two paved sections. The board agreed that this section should be included in the seal coating project. A group of people would like to adopt County Road FF for litter clean up. The county will pay for the signs. What about putting Mercer’s loon logo on the signs? The board agreed if the county can do this. The DNR plans to buy a lot of land around Moose Creek.

Stenberg – We may be in the early stages of getting a private investment fund set up for the Business Park so that interested buyers have another option other than going to the banks for a loan.

Public Comment: Kathy Tutt said the customer appreciation day has been changed from the 13th to the 14th of August. Vic Ouimette reported on the two problem spots on Catherine Lake Road that need to be resolved where water runoff is a problem. There areas may need culverts. Gene Hickey suggested that everyone who obtains a Tourist Rooming House permit be given the Accommodations Tax information.

The next regular meeting of the Mercer Town Board of Supervisors will be held on Thursday the 15th of July 2010 at 6:30 pm in the Haines Civic Building.

Motion made by Stenberg, seconded by Lambert, to go into Closed Session at 8:02 pm per WI Stats. 19.85 (1)(c) to discuss employee health insurance and hiring of a part time summer employee. All yes.

Motion made by Lambert, seconded by Banaszak, to return to Open Session at 8:11 pm. All yes.

Action on Closed Session: Supplemental insurance for clerk will be placed on next regular meeting agenda. An employee asked for insurance for a dependent child over the age of 18 under “single coverage” employee. Employee would pay the extra premium. The town carries a $2,000 deductible for single coverage employees and private insurance could probably be obtained at a lower cost than our group insurance.
Motion made by Schroepfer, seconded by Lambert, not to allow insurance for a dependent child under “single coverage” employee. Carried.
Motion made by Lambert, seconded by Schroepfer, to hire Mark Dierbeck as part time summer help. Carried.

Motion made by Lambert, seconded by Stenberg, to adjourn the meeting at 8:13 pm. Carried.
