Mercer Town Board of Supervisors – July 17th 2008 – Minutes

Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 17th of
July 2008 at 6:30 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Manners, and Opal Roberts. Atty Schellgell was absent.

Motion made by Banaszak, seconded by Sendra, to approve the minutes from the July 3rd 2008 board meeting with the word “approve” removed on page one and on page two under Banaszak’s report the July 11th meeting will be with Senator Jauch. Carried.

Open comment: A resident had a complaint about vehicles for sale being parked in the area between County Road H and Horners Road. Kichak will talk to the county highway commissioner about this. Also, real estate signs on the town road right-of-way. The clerk will check into the sign ordinance concerning this.
Mr & Mrs Colle wanted to know if something could be done to eliminate some of the dust from the ATV trail across the road from their residence near the park. Kichak will check to see if the county can place some millings on this area.

Motion made by Banaszak, seconded by Lambert, to deviate from the posted agenda and move to Old Business (b). Carried.

Old Business: b) Conditional Use permit for 5526N Arrowhead Drive owned by Jeffrey Berg.
Dan Schermetzler, of Best Built Garages, was present to answer questions about the construction of this accessory building. The board informed him that the major concern was that this building not be used for human habitation in the future without obtaining a new residence permit. He assured the board that the building would be used only for storage.
Motion made by Lambert, seconded by Banaszak, to approve the conditional use permit for the construction of a 30x40 accessory building at 5526N Arrowhead Drive owned by Jeffery Berg, with the stipulation that this not be used for human habitation or the conditional use permit will be revoked. Carried.

Motion made by Banaszak, seconded by Lambert, to return to the original agenda order. Carried.

New Business: a) Conditional Use permit for 4546W Camp Nokomis Road owned by Tom Schmitt.
Mr Schmitt was present to answer questions from the board.
Motion made by Lambert, seconded by Stenberg, to approve the conditional use permit for a 30x48 accessory building at 4546W Camp Nokomis Road owned by Tom Schmitt with the stipulation that it not be used for human habitation. Carried.

b) Conditional Use permit for 3599N Popko Circle West owned by Walter Hablewitz.
Mr Hablewitz was present to answer questions from the board.
Motion made by Lambert, seconded by Stenberg, to approve the conditional use permit for a 40x40 accessory building at 3599N Popko Circle West owned by Walter Hablewitz with the stipulation that it not be used for human habitation. Carried.

c) Conditional Use permit for a boathouse at 7051W Lake Six Road owned by Michael Strattis.
All the property surrounding this lake is owned by Michael Strattis.
Motion made by Lambert, seconded by Sendra, to approve the conditional use permit for a 12x18 boathouse at 7051W Lake Six Road owned by Michael Strattis on the condition that it not be used for human habitation. . Carried.

d) Wilson Lake Road – Bill Grant.
Mr Grant, a resident of Wilson Lake Road, asked the board what area of Wilson Lake Road would be completed this year and a possible timeline for work on the remaining sections, which are badly in need of rebuilding. Kichak stated that the section to be completed this year involved the replacement of a culvert the DNR considers a dam and therefore required permits before it could be removed and replaced. The town usually paves about three miles of roads per year but, with the rapidly rising cost of oil and oil products, this may need to be cut back to 2.5 miles or less. The 5-year Road Plan will need to be revised to adjust for this limitation.

e) Commercial building permit for Action Floors.
Carl Anderson, representing Action Floors, was present to explain the proposed use of the building addition. The Planning Commission had studied the Action Floors Design Review application and recommended the board approve this commercial building project.
Motion made by Lambert, seconded by Stenberg, to approve the Commercial building permit for Action Floors for a 27x60 addition to the plant. Carried.

f) Commercial building permit for David McNutt.
Mr NcNutt was present to answer questions from the board. The Planning Commission had reviewed his commercial building application and concluded that, according to the Business Park covenants, this storage building cannot be built before a primary business building is constructed. It was suggested that Mr McNutt change the design and make this building his primary place of business.
Motion made by Lambert, seconded by Banaszak, to deny the Commercial building permit for a 30x60 storage building at 4792N Parkway Drive to David McNutt. Sendra Abstained. Carried.

g) Amend ATV Ordinance to add Scott Road..
Stefan and Marianne Ballek made a request to add Scott Road to the Town of Mercer ATV system.
Motion made by Lambert, seconded by Stenberg, to approve the addition of Scott Road to the Town of Mercer ATV Ordinance with the stipulation that complaints from residents of Scott Road may cause the removal of this road from the ATV route system. Carried.

Old Business: a) Tourist Rooming House permit for Craig Trenkamp.
Mr Trenkamp was present to answer questions from the board. This is a narrow (50’) lot and the concern was about parking. The board also stated that the local agent appointed for this TRH lives 15 miles away. Jim Schmitt, whose residence is two doors away, stated his objection to this application. The board suggested Mr Trenkamp try to resolve the issues with his neighbors and draw up a vehicle parking plan for this lot. The board will then reconsider a re-submission of the Tourist Rooming House application.
Motion made by Sendra, seconded by Banaszak, to deny the Tourist Rooming house application at 6544W Flambeau Dam Road by Craig Trenkamp. Stenberg and Kichak voted nay to this denial. Lambert abstained. Carried.

c) Transfer Sewer/Water in Business Park to Sanitary District.
Motion made by Banaszak, seconded by Stenberg, to postpone this item until Atty Schellgell can be present. Carried.

Business Park report: Dianne Keefe had received a copy of an email from SEH to the EDA inquiring on the progress of the finalization of the grant process. There is a little over $600 left in the Business Park account.

Legal: none.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers, and the budget report.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.

Communications: Huffcutt Concrete will have the planks for the boat landing ready by mid August and will be contacting the office about a delivery date. The total cost for the two 12x8 planks will be $2,073.20.
The WTA Summer Seminar will be in Minocqua on Saturday August 9th. Any board member planning to attend will need to inform the clerk so reservations can be made.

Treasurer’s Report – Manners presented the Treasurer’s Report.
The General Account has a balance of $128,658.45. Total of all funds is $1,213,959.11.
Motion made by Stenberg, seconded by Banaszak, to approve the Treasurer’s report. Carried.

Manners then asked the board if funds from the tax account should be moved to the reserve account at Wells Fargo in order to receive more interest. Lambert said he would talk to Joyce Olson at the bank to see what sort of interest Associated Bank may be able to give us.

Board Reports: Chair/Garage reports: The crew started work on the Wilson Lake Road project. The blasting company will be working on Weber Road tomorrow. The crew will be grading the gravel roads, which are rough due to the rains. More trees had to be removed from the roads due to the storm last Friday. Vacca is still mowing the road sides.


Supervisors: Stenberg – none.

Lambert – Some of the culverts in the Business Park are plugged with gravel and need to be cleaned out. Did Kichak ask for an appraisal on the Malone property? Kichak replied that he had asked Ponik for an appraisal but had received no answer. The county did not receive the grant from Plum Creek this year for the Hiking/Biking trail. There was a problem with the call-out last week for removing the downed trees. Kichak said he will make out a call list and see that the supervisors get a copy. Had Kichak heard anything from the engineering firm about the salt shed site. Kichak said no report had been received as of today. Lambert thinks it would be a good idea to hold off on building the new garage until we have some idea of the direction the economy is taking.

Banaszak – She had received two complaints about the 4th of July parade; the Beaver Lodge float handed out beer to the audience. The Clerk will send a letter to Beaver Lodge informing them that this is illegal. One of the sports cars burned rubber, which is a very dangerous thing to do that close to the crowd. The 4th of July committee will be notified that this should not be allowed at future parades. The meeting with Senator Jauch was held on the 11th. She has received the guidelines for the letters to send downstate supporting the grant for the storm sewer/downtown enhancements project. These need to be out by the end of the month. She received a letter from the state informing her that the WI-DOT is funding the Safe Routes to School Project in the amount of $85,300.

Sendra – She has given the street light list to the clerk. The Library board interviewed several architects on the 14th and the building committee will hold another meeting on the 31st. The building committee plans to obtain as much funding as possible through donations for the expansion project. Deb Hohner has given the library board her resignation affective August 8th. She has taken a job at the school as the History/Social Studies teacher. Woods & Blooms has donated $500 toward the landscaping of the Chamber building. She asked if supervisors were allowed mileage expense for any work they do for the town and was told “yes”. She noticed some Canadian Thistle, which is on the noxious weed list, and was told to report them to the county.

Gene Hickey complimented the town for not allowing cars to be parked on US 51 along the parade route. Lambert complimented the 4th of July Committee for all the activities, especially those at the park and the fireworks display. Dianne Keefe made the comment that the Watercross races turned out to be very interesting.

For Consideration and Approval: a) Liquor/Operators Licenses: Operator Licenses for Patricia Altman, Crystal Baughcum, and Dawn Semenak.
Motion made by Banaszak, seconded by Sendra to approve the Operators Licenses for the above listed applicants. Carried.
Motion made by Lambert, seconded by Stenberg, to approve the Temporary Beer permit for St. Isaac Jogues Church for August 3rd 2008. Carried.
