Mercer Town Board of Supervisors – July 16th 2009 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 16th of July 2009 at 6:00 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Bonnie Banaszak, Toni Sendra, and Opal Roberts. Jeff Stenberg arrived at 6:03 pm. Also present were Library Trustee President, Marge Pemble, Secretary Valarie Anderson, Trustee Gary Bogenschneider and Library Director Teresa Schmidt.
Meeting between the Mercer Town Board and the Mercer Public Library Trustees
The Mercer Public Library Board of Trustees presented the library’s goals and expansion plan to the town board. The library trustees stated the benefits of the Mercer library to the community, including the economic benefits. The library needs more space for holding classes, meetings, activities & alternatives for children & young adults, and collection development due to the continued growth of the library use and activities. Bogenschneider said that a quality library in the community is a draw for businesses and the employees who work for them. It is difficult to put a dollar amount on the value of a good library. Discussion was held about the timeline for the project and approximate costs. The Trustees are estimating a cost of between $450,000 and $500,000 and a construction start within 3 to 5 years, depending on the fund raised at that time.
The meeting was adjourned at 6:20 pm.
Regular Town Board meeting
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 16th of July 2009 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Manners/Brandt, Opal Roberts and Atty Schellgell.
Motion made by Banaszak, seconded by Sendra, to approve the minutes from the July 2nd 2009 town board meeting. Carried.
Open comment: Dianne Keefe expressed her excitement at the painting of the crosswalks on Highway 51.
New Business: a) Discuss/approve action on meter/back flow preventer on fire hydrant at Fire Hall.
Tom Thompson, Sanitary District Commissioner, was present to explain to the board the need for the back flow preventer. He stated that the Sanitary District will install the meter. The back flow preventer will cost the town $550.82. There will be no charges to the Fire Department for future hydrant taps. The water used for fire practices will not be charged to the town but the SD needs to know how much is used for each practice.
Motion made Lambert, seconded by Sendra, to purchase the back flow preventer for the Fire Hall. Carried.
b) Open/Award bids for the 2009 paving project.
Two bids were submitted:
Angelo Lupino - $225,000.00 Pitlik & Wick - $141,723.50
Motion made by Lambert, seconded by Banaszak, to award the 2009 paving project bid to Pitlik & Wick for $141,723.50. Carried.
Old Business: a) Conditional Use permit for 15x24 addition to an existing garage to use as a temporary dwelling at 5765N Payment Lake Road owned by Troy & Cynthia Frank.
Troy Frank was present to answer questions from the board. There was a concern about when he plans to build the residence and what the addition to the garage will be used for after the house is built. Mr Frank stated he has no plans to use the addition as a Tourist Rooming house.
Motion made by Lambert, seconded by Stenberg, to approve the Conditional Use permit for the 15 x 24 addition to the existing garage to use as a temporary dwelling at 5765N Payment Lake Road owned by Troy and Cynthia Frank. Carried.
b) Conditional Use permit to place a fifth wheel mobile home on property at 4616N Little Pike Lake Road owned by Jeremy Coates.
Mr Coates was present to explain why he needed this fifth wheel mobile home as a residence. He will be moving to Mercer from Ft Atkinson. He has applied to the bank for a loan to start building a house. There was a lengthy discussion among the board members and comments were allowed by Kichak from concerned members of the audience. Various sections of the Dwelling Ordinance were cited and analyzed. The board members agreed that this was a very tough decision.
Motion made by Lambert, seconded by Stenberg, to deny the placement of a fifth wheel mobile home on property at 4616N Little Pike Lake Road owned by Jeremy Coates due to Mr Coates not being sure he could afford to have a home built before the 24 month camper permit period would expire. Carried.
c) Discuss/approve change of garage uniforms provider.
After comparing price lists for Aramark and the current provider, AmeriPride, it was determined that the town may be able to save several hundred dollars a year by changing to Aramark.
Motion made by Lambert, seconded by Banaszak, to change to Aramark as the supplier of garage uniforms. Carried.
Legal: Schellgell has reviewed the Room Tax Ordinance which has been drafted and adopted by the Room Tax Committee. He found nothing to change in the document. The Room Tax Ordinance will be placed on the agenda for the August 20th board meeting.
Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and budget report.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.
Communications: Tom Bergman, Iron County Zoning Administrator, asked the board if they could use the sentence “on condition that the structure not be used for human habitation or for a commercial business without proper permitting and inspections” when placing a condition on a Conditional Use permit for an accessory building. The board agreed to do this.
Does a mobile sign need a sign permit? The answer is “yes”.
Farhner had sent a quote for the painting of the crosswalks.
A letter to Kichak about the condition of the Repair Shop property. Lambert said the board will not take action on an unsigned letter. There is a complaint form available for serious complaints.
The problem with the air conditioning unit at the Community Center was caused by the “economy motor”. This devise uses outside air for cooling when the inside temperature reaches a certain degree. This is simply an energy saving feature and the unit will work alright without it. At almost $1,000 for a new unit and installation it would not be cost effective to replace it.
Letter from a Moose Creek Acres resident about the paving of the roads in that subdivision. In September of 2008 the developer was told he needed to have the roads paved in 2009. The clerk will send a letter to the Doud’s explaining that the roads are the responsibility of the developer. Atty Schellgell will send a letter to the developer.
Letter from Scott Reinhard, president of the Turtle Flambeau Flowage Assoc., about several proposals for the Room Tax Ordinance.
Tom Teague wanted to inform the board that, even though he and several other residents on Little Pike Lake were opposed to the parking of the fifth wheel on Mr Coates property, they understood his need for a residence here. They will work with him to contact various agencies and will do what they can to help him build a home. The board was very pleased with this information and thanked Mr Teague.
Treasurer’s Report – Manners/Brandt presented the Treasurer’s report. The General Account has a balance of $70,663.07. Total of all funds is $1,209,037.24.
Motion made by Stenberg, seconded by Banaszak, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: The trees are almost all cut on Fisher Lake Road East. The crew will be pulling stumps there next week. The ATV signs for that road will not be installed since they would have to be taken down for the road work. Kichak found a wobble wheel packer for $3,500. We were charged $573.77 by Iron County for the rental of a wobble wheel packer for 9 hours on Beaver Lodge Circle. This equipment would pay for itself at that rate. After the work is completed on Fisher Lake Road East, the crew will move to Catherine Lake Road. Due to scheduling conflicts the road patrol had to be cancelled so a new date for that will need to be set.
Supervisors: Sendra – the Sanitary District is trying to work with the town to iron out some of the problems that have arisen about hydrants and fees. Good to see both entities working together.
Banaszak- the Fire Construction grant was applied for but Banaszak was told that the items listed for repairs and improvements to the Fire Hall were considered low priority. She wanted to thank the clerk and her husband for working at the cemetery to set some of the metal stakes for marking the cemetery blocks and plots. She asked about the letter that was to be sent to A-1 about the extra laterals in the business park and was told by Kichak that he still wanted to hold off on that.
Lambert – he had received several complaints about Murray Landing Road and had gone out to look at the problems. This road only has a couple of full time residents but is used by a number of vehicles to get to Grant Lake in Sherman Township. If it is chip sealed, could the road plan be changed to include this road in 2010? Kichak agreed that this could probably be done.
Stenberg – he wanted to commend Jerry Huffmaster for all the work he had done to help get the air conditioning in the community center working and working with ADT on the Security system in the library. He saved the town money by doing as much of the work as possible before calling in the contractors.
For Consideration and Approval: a) Liquor Licenses/Beer Permits. – Temporary Beer permits for: St Isaac Church Polka Mass and Polish Dinner to be held on August 2nd 2009 at the church; Mercer Lions Loon Day concession to be held on August 5th 2009 at the Pocket Park; and Mercer Lions BBQ to be held August 15th at Carow Park.
Motion made by Banaszak, seconded by Lambert, to approve the Temporary Beer permits for the above listed events. Carried.
Operator’s Licenses to approve: Keith Wesolowski, Patricia Perna and Jamie Johnston.
Motion made by Sendra, seconded by Lambert, to approve the Operator’s Licenses for the applicants listed above. Carried.

Motion made by Stenberg, seconded by Banaszak, to approve the transfer of cemetery deeds as listed above. Carried.
