Mercer Town Board of Supervisors – January 7th 2010 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 7th of January 2010 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Brandt and Opal Roberts. Absent: Atty Schellgell.
Motion made by Sendra, seconded by Banaszak, to approve the minutes from the December 17th 2009 town board meeting with the sentence “A Public information meeting for the NHRATP will be held January 13th at 6:30 pm at the town hall.” added under Supervisor Sendra’s report. Carried.
Open comment: Jim Schmitt, of 6536W Flambeau Dam Road, made a statement about the grooming of the shoulder and ditch line of Flambeau Dam Road. He would like to see this practice discontinued since it creates a false impression as to the width of the road. The road is designated as a snowmobile route and the shoulders do not need to be groomed.
New Business: a) Discussion of Town Storm Sewer Project – Jay Knoke, CWE.
Jay Knoke of CWE Engineering, discussed the US Highway 51 Project funding. At present the town will need to provide $482,323 for the project. He outlined potential sources for additional funding such as another TRM grant for $150,000, an Environmental Infrastructure Assistance (Sec 154) grant, a Rural Utilities Services grant, and a Community Development Block Grant. Knoke also explained that the approximately $27,00 figure the DOT came up with for the widening of 51 was incorrect and the amount will be about $6,000 above that estimate the town will have to provide.
Carolee Russell, of WI Community Action Program Association (WISCAP), offered to help the town seek additional grants for water and waste water issues. This assistance is provided at no cost to the town and is made possible by funding received from the Environmental Protection Agency or the USDA-RD. Chairman Kichak signed the Technical Assistance Service Plan for the Storm Sewer Upgrade Project presented by Russell.
Stenberg asked about the plan to route the storm water to the area behind the Chamber building. Knoke said the DOT has basically agreed to do this but no cost figures have been submitted to date. The town will need to hire someone to do the inspection of the local streets portion of the project. He will include these costs in the application for the grants.
b) Discuss/Adopt amendment to Sign Ordinance.
The amendment is to Section 9 of the Sign Ordinance #1999-2.
Title to be changed from Permits and Fees to Application and Review Process.
9.1 All new or replacement resident business signs greater than 12 square feet shall require a Sign Permit.
9.2 All non-resident business signs shall require a Sign Permit.
9.3 Design review approval is required prior to the issuance of a Sign Permit.
9.4 Applicant may obtain a copy of the Sign Permit Application form the Town Clerk. Applicant submits a completed application of the required information to the Clerk, who will forward the document to the Secretary of the Plan Commission.
9.5 Within a maximum of 30 days from the time the application is received, a duly posted meeting of the Mercer Plan Commission shall be arranged to review documents for the preliminary approval, and a recommendation will be forwarded to the Mercer Town Board. Submitted plans may be 1) approved as submitted, 2) approved with conditions or modifications, or 3) denied approval.
9.6 A summary of the project plans, along with the recommendation of the Plan Commission, is prepared for presentation to the Mercer Town Board for final approval at its next regular meeting.
9.7 No permit shall be required for repairs or replacement of existing signs unless the repair or replacement exceeds 50% of the size of the original sign.
Motion made by Stenberg, seconded by Sendra to adopt the above amendment to the Sign Ordinance. Carried.
c) Discuss/Approve “Lazy Ace” sign permit.
The Plan Commission had recommended the approval of this sign application.
Motion made by Banaszak, seconded by Stenberg, to approve the sign permit for the “Lazy Ace” sign for the business located at 1704W Manitowish Road (formerly “Chuck’s Bar”).
d) Discuss requirement for Tourist Rooming House permit.
The Clerk had several questions as to who had to obtain a Tourist Rooming House permit when the properties were located in former resorts that had been converted to condominiums. The board stipulated that if the resort owner still owned the condo site then a TRH would not be needed. If the condo site was sold then the new owner would need a TRH if it is also used as a rental. If several rental units were on one parcel or site then only one TRH was needed. If the rental units were owned by the same person but on different parcels or sites, then a TRH for each would be needed. This was just to clarify the requirements for a Tourist Rooming House permit so no action was needed.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers, and 2009 final budget report.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.
Communications: EMC Insurance will be issuing a dividend to the town for $2,379. There will be a Public Information meeting to discuss the proposed bicycle/pedestrian trail system at the Town Hall on Wednesday, January 13th at 6:30 pm. Someone called and stated that a property owner on Stafford Point has an air filtration system by his pier to keep the water open but it is not marked and is a danger to snowmobilers or skiers, especially at night. Kichak said this would be a concern for the DNR. Sheryl Sell from Nicolet College had been in the office today and asked what Nicolet can do for the town of Mercer. Vilas County sent a CD of their Comprehensive Plan adopted November 10th 2009. The Turtle-Flambeau Flowage & Trude Lake Property Owners Association sent their newsletter and a copy or the results of their 2009 membership survey.
Treasurer’s Report – Brandt presented the Treasurer’s report. The General Account has a balance of $1,472,003.02. Total of all funds is $2,909,933.40.
Motion made by Sendra, seconded by Banaszak, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: Roads are looking good. The Clerk had received an email requesting that Cedar Lake Circle not be plowed so well to make for better snowmobiling. Kichka will talk to the crew to see what can be done. The roads in the Moose Creek, Lake Six area will be plowed as needed. New wheels will be ordered for the Oshkosh.
Supervisors: Stenberg – having a problem with the furnace at the Community Center again. Quality Heating found the problem and with the help of our custodian got it working again. The town should put the cost of a new furnace or furnaces for the CC in the budget for 2010, plus insulation for the furnace room.
Lambert – Last weekend he had a call from the Sheriff’s office requesting that Cutoff Road and Pierpont Drive at the intersections be salted.
Banaszak – Atty Schellgell had emailed her about the DOT/Town agreement. It looks good except for some language in several paragraphs that isn’t consistent. He and Anna are still at odds about consulting the town to justify cost overruns of more than 5%, but Anna says 10%. Blake Theisen and Doug Chidley met to discuss the landscape design south of Lakeview to make it consistent with the downtown plan. One of the questions was about taking out the sidewalk by the Great Northern, making it asphalt, and creating a multi-use path. This would later become part of the Bike/Hike plan.
Sendra – she had an individual asking about the poor condition of the road in the tubes area on Popko Circle West. People do park on the road there and maybe the town should post “No Parking” signs.
For Consideration and Approval: a) Liquor license for new operators of the Heart of the North Bar.
Motion made by Banaszak, seconded by Stenberg, to approve the liquor license application for Jennifer Geiszler (Northern Heart LLC), dba Heart of the North Bar and Grill located at 5262N Lakeview Avenue to become effective January 25th 2010. Carried.
