Mercer Town Board of Supervisors – January 5th 2012 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 5th of January 2012 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Charles Schroepfer, Christan Brandt, Atty Schellgell, and Opal Roberts. Absent: Bonnie Banaszak.
Motion made by Lambeert, seconded by Schroepfer, to approve the minutes from the December 15th Public Hearing and the December 15th board meeting. Carried.
Open comment: none.
New Business: a) Discuss/Approve Employee handbook.
After a short discussion it was decided that this was too involved to review at a regular board meeting. The board will hold a separate meeting for drafting and approving the employee handbook.
Motion made by Schroepfer, seconded by Stenberg, to postpone this item until a future meeting of the board. Carried.
b) Discuss/Approve Conditional Use for a Tourist Rooming House at 2161W Leisure Lane owned by Rich Maki.
The town Tourist Rooming House application for this property had been approved at the December 15th meeting.
Motion made by Stenberg, seconded by Lambert, to approve the Conditional Use for a Tourist Rooming House at 2161W Leisure Lane owned by Rich Maki. Carried.
c) Discuss/Approve Resolution #2012-01 to adopt County Comprehensive Zoning in the Town of Mercer.
This revision was adopted by the county on December 13th 2011 and is known as the Title 9, Zoning Code. This revision sets development standards and land use regulations for the unincorporated areas of Iron County and is effective in any town that passes a resolution adopting the comprehensive revision and then files such resolution with the County Clerk.
Motion made by Lambert, seconded by Schroepfer, to adopt Resolution 2012-01 to adopt County Comprehensive Zoning in the Town of Mercer. Carried.
Old Business: Lambert stated he would like to make a comment here about the composition of the Iron County Aging Unit committee. He has talked to John Urban, Jack Prospero and Dennis DeRosso about appointments to the Aging Unit. He feels the town should suggest the names of several people who might serve on the committee. This item will be placed on the next regular meeting agenda.
Legal: Atty Schellgell pointed out that the Comprehensive Plan is a guideline only and is not enforceable by the town. He still has a problem with the “back screen” requirement in the garage job description. He will check with another attorney on this. He is still looking for a survey of the property the town sold to the Sanitary District for the treatment plant. The clerk asked how she was to pay the “Discretionary Stipend” to the town employees. He replied that he will discuss this with her in the near future.
Officer Reports: Clerk’s Report - Roberts presented the receipts list and vouchers. Property taxes collected in December totaled $1,456,997.90.
Motion made by Lambert, seconded by Schroepfer, to approve the vouchers and issue the checks. Carried.
Communications: Letter from Bob Hanson and Laura Baxter expressing their appreciation to the Fire department for their immediate response and the care given to their son when he fell out of a second floor window. A Thank you from Action Floors for the load of sand/salt. Sanitary District sent a letter asking the Fire Department inform them when using water for the ice rink. There will be no charge but they need to know when the water is being used.
Treasurer’s Report – Brandt presented the Treasurer’s report. Balance forward was $42,013.94. Receipts were $169,507.28, disbursements were $78,166.13, with an ending General account balance of $1,419,941.44. Total of all funds is $3,301,910.21. Lambert pointed out that the Town loan from a number of years ago at Associated Bank is now paid down to about $90,000.
Motion made by Stenberg, seconded by Schroepfer, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: all roads are cleared and streets are cleaned from the week-end snowfall. There are logging operations in the Lake Six area so Moose Lake Road will be kept cleared. Lambert reported he had the crew out at 5:00 am on New Year’s Day.
Supervisors: Stenberg – the county had the hearing for the Dollar General parking variance and it was approved. The construction will start in spring. There will be eight to ten employees and hopefully some of those will be from Mercer.
Lambert – the bill for the lights at the skating rink was submitted and the town will pay half the cost. There is a wood burning issue between several homes on County J. The Health Department has attempted to address this problem but it continues.
Banaszak – none.
Schroepfer – The Bike path committee had a meeting and a method for crossing wetlands was one of the subjects discussed. He and Banaszak asked Blake Theisen for advice on what type and the possible location of lights for the library parking lot since Blake had done the Streetscape plans for that area.
Public Comment: the PECFA program is on hold by order of the governor.
For Consideration and Approval: Liquor/Bartender: Motion made by Lambert, seconded by Stenberg, to approve a Temporary Beer permit for the Justin Donner Memorial Fisheree to be held on January 28th at Donner’s Bay Resort. Carried.
Motion made by Schroepfer, seconded by Stenberg, to approve an Operator’s License for Gary LaRock. Carried.

Motion made by Lambert, seconded by Schroepfer, to adjourn the meeting at 7.04 pm. Carried.
