Mercer Town Board of Supervisors – February 4th 2010 – Minutes
Chairman Jim Kichak called the Public Hearing to order on Thursday the 4th of February 2010 at 6:05 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, and Opal Roberts. Atty Schellgell arrived at 6:10 pm. There were thirteen members of the public in attendance.
This Public Hearing is for the proposed amendment to the Mercer Comprehensive Outdoor Recreation Plan to include the Northern Highlands Regional Alternate Transportation Plan. This amendment needs to be included in the Recreation Plan for the proposed regional hike/bike path project. This needs to be in our outdoor plan in order to apply for various grants to implement the plan or portions of the plan. Will Andresen explained that the town is the preferred applicant for the grants. The first grant application would be to the Dept of Transportation to help fund the design work. The second grant would be to the Dept of Natural Resources. This grant would help provide matching funds for the project. Banaszak stated that there is only $500,000 available for the northern tier of WI. Shari Younger informed the board that the Lupine Junefest has $4,000 available to donate to the Hike/Bike project to help with the initial cost estimate and design phase of the grant application. Pam Davies hoped the town would do everything possible to pursue this project for the benefit of local residents and to draw new visitors to our area.
Motion made by Lambert, seconded by Sendra, to adjourn the Public Hearing at 6:17 pm. Carried.

This Public Hearing is for the town to abandon Moricoli Road.
(No one was present who wanted to discuss the abandonment of this road so Chairman Kichak suggested the board go into the regular town meeting to allow more time for anyone who would like to comment on the subject to arrive.)
At 6:33 pm Chairman Kichak returned to the Public Hearing on Moricoli Road. Robert DeCherrie, the only property owner abutting Moricoli Road, had contacted the Clerk’s office to ask if he needed to be present at the Public Hearing. No verbal or written objection had been received by the Clerk since the Class 3 publication in the Iron County Miner and posting at five places in the Town of Mercer. All legal requirements have been met.
Motion made by Lambert, seconded by Stenberg, for the Town of Mercer to legally abandon Moricoli Road with the condition that Mr DeCherrie reimburse the Town for legal costs for the abandonment. Carried.
Regular town Board meeting
Motion made by Lambert, seconded by Banaszak, to adjourn the Public Hearing at 6:38 pm. Carried.

Absent: Christan Brandt.
Motion made by Sendra, seconded by Banaszak, to approve the minutes from the January 21st 2010 town board meeting. Carried.
Open comment: none
New Business: a) Adopt the amended Mercer Comprehensive Outdoor Recreation Plan.
Motion made by Sendra, seconded by Banaszak, to adopt the amended Mercer Comprehensive Outdoor Recreation Plan. Carried.
b) Abandon Moricoli Road. (see above Public Hearing)

c) Discuss/Approve Conditional Use for a 30 x 36 accessory building on Lot 1 Delich Subdivision (S1, T42N, R2E) owned by Donald & Cynthia Storck.
There was discussion as to the proposed use of this accessory building. Lambert was concerned that this would become another garage/dwelling problem. He wanted to postpone this item until the board could get more information from the applicants.
Motion made Banaszak, seconded by Stenberg, to approve the Conditional Use application for the above named accessory building on the condition that it not be used for human habitation or commercial use without proper permitting. Lambert voted “no”. Carried.
d) Discuss ordinance enforcement.
Banaszak had contacted the WI Towns Association about town ordinance enforcement. Our Citation Ordinance would need to be amended to include the Tourist Rooming House and Accommodation Tax ordinances. This will be placed on the next regular meeting agenda. She will work with the Clerk, the Treasurer, the Iron County Health Department, the Chamber, and the County Zoning Administrator to coordinate information as to the rental units in the township. Stenberg said the town should do some sort of mailing to let property owners know that, if they plan to rent out their dwellings to tourists, they will need to obtain a town Tourist Rooming House permit.
e) Discuss/Approve purchase of voting machine.
The town had purchased the Vote-Pad to meet the HAVA requirements for a voting system to be used by people with disabilities. Vote-Pad has since gone out of business and the town will need to purchase another type of HAVA voting machine. The system used by the other townships in Iron County is the Edge from Command Central. This will cost approximately $4,800. We have about $3,900 left from the HAVA grant monies to apply toward the purchase of the machine.
Motion made by Banaszak, seconded by Sendra, to approve the purchase of the Edge voting machine. Carried.
f) Drawing for position on April 6th ballot.
First position on the ballot will be Toni Sendra, second position will be Charles Schroepfer, and third position will be James Lambert.
Old Business: a) Discuss/approve the Uniform Dwelling Code Resolution.
The Public Hearing on this subject will not be held until next Monday. Stenberg suggested the board go ahead and vote on the Resolution anyway since the hearing is about the County UDC ordinance.
Motion made by Banaszak, seconded by Sendra, to postpone the vote on the UDC Resolution until the next regular meeting. Stenberg voted “no”. Carried.
Legal: none.
Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers, and budget report. The January PILT payment from the DNR is for $235,966.82. The town made payments from this amount to the State, County, School and College. $47,012.07 remained for the town portion of the payment.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.
Communications: the health insurance premium quote is an increase of 10%. A representative of the WI Deferred Compensation Program gave the Clerk materials to distribute to the town employees. Letter from the Library stating that the school representative to the library board, Sue Benzel, had resigned and that the school administrator had appointed Deb Hohner as her replacement effective January 1st 2010.
Treasurer’s Report – Roberts presented the Treasurer’s report. The General Account has a balance of $$287,101.95. Total of all funds is $3,514,101.55.
Motion made by Lambert, seconded by Stenberg, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: The 1997 plow truck has some serious engine problems so has been hauled to Wausau for repairs which will probably be over $8,000. The purchase of a new plow truck will need to be discussed at the budget sessions this Fall. The ½ ton Ford truck has been repaired. Roads are plowed and the crew will do further clean-up tomorrow. The huge pile of snow on the Town Hall lawn has been moved and the area looks much better. A list of power poles to be moved will be needed in preparation for road construction this summer.
Supervisors: Stenberg – the State is requiring that the portion of the Mecca Ski Trail that is on state land have liability insurance. The Clerk will check with the town’s liability insurance carrier to see if this is, or can be, covered under the town’s policy.

Banaszak – She had talked to the state’s DOT project engineer about the walking/biking path from Harper north to Lakeview Road. The engineer said that from County Road J across the bank parking lot would be a problem. Maybe the path could be run behind the ICO/Marathon station and the bank, then back to US 51. She will contact the bank about the path.

For Consideration and Approval: a) Liquor license application for C Skinner Enterprises dba as “Porky’s” located at 5203N US Highway 51, agent Catherine Davis.
Motion made by Stenberg, seconded by Banaszak, to approve the above Liquor license application. Carried.
