Mercer Town Board of Supervisors – February 18th 2010 – Minutes

Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 18th of February 2010 at 6:30 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, and Opal Roberts. Atty Schellgell arrived at 6:48 pm. Absent: Christan Brandt

Motion made by Sendra, seconded by Banaszak, to approve the minutes from the February 4th 2010 Public Hearings and town board meeting, and the February 8th Public Hearing. Carried.

Open comment: none

New Business: a) Amend Citation Enforcement Ordinance 2003-02.
After discussion about an objection by Lambert as to the listed enforcement officials for the Accommodations Tax Ordinance, it was decided to table this until Atty Schellgell was present to offer his legal opinion.
Motion made by Lambert, seconded by Stenberg, to table this until Atty Schellgell is present. Carried.

b) Amend Rooming Houses Ordinance 2006-01.
Proposed amendments include the renumbering of Section 4 to Section 3 and adding the word “License” to the Section 3 title. The addition of: “1. An applicant must notify adjacent property owners of the time and date of the meeting at which the permit requested herein shall be voted upon by the Town Board. 2. This requirement is deemed fulfilled if said notice is published as a Class 1 notice in the Iron County Miner prior to said meeting.” to subsection (h). The addition of subsection (i) “Such permits shall expire on December 31. Permits must be renewed annually.” Renumber Section 3 Prohibited Conduct to Section 4. Add to Section 6 Enforcement: “The Town Attorney shall be authorized to serve the appropriate legal process against any alleged violators of the above noted ordinances.”
Motion made Sendra, seconded by Lambert, to amend the Rooming House Ordinance as stated above. Carried.

Old Business: Discuss/Approve Uniform Dwelling Code Non-Enforcement Resolution #2010-01.
This had been postponed until after the Public Hearing held on February 8th on the subject of the County UDC Ordinance.
Motion made by Banaszak, seconded by Sendra. Stenberg called for a voice vote:
Kichak “no”, Lambert, “no”, Stenberg “no”, Banaszak “yes”, Sendra “yes”. Motion failed.

Legal: none.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers, and February budget report.
Motion made by Lambert, seconded by Banaszak, to approve the vouchers and issue the checks. Carried.

Communications: E-mail from Stephanie Christensen with maps of choices for the walking path along the Highway 51 project. Letter from EDA with a form asking for results of investment in the Business Park. Email from the town’s liability insurers stating several options for liability for the Mecca Ski Club’s trail across state land. A copy was mailed to Gary Mears. A letter from Waste Management offering $20 if the town signs a 3-year contract for the garage dumpster. An invitation to the Gogebic-Iron County Airport Open House on March 10th at 11:30 am.

Atty Schellgell arrived at 6:48 pm.

Motion made by Banaszak, seconded by Sendra, to return to New Business a). Carried.

Lambert’s question about the enforcement of the Accommodations Tax Ordinance was explained to Atty Schellgell. Lambert stated that no one from the town was going to come in and audit his books if it was determined that he may have not paid the correct tax amount. Schellgell explained that the town may appoint an auditor to inspect the books of anyone suspected of filing an incorrect amount. After discussion it was decided to check with other towns to see how they enforced their Accommodations Tax Ordinance.
Motion made by Lambert, seconded by Banaszak, to postpone this item until the next board meeting. Carried.

Atty Schellgell wanted to make a comment of the amendment to the Rooming House Ordinance. He suggested that under Section 3 subsection (f) that “or is zoned appropriately” after “validly issued conditional use permit.”
Motion made by Banaszak, seconded by Sendra, to return to item 6 (b). Carried.

Motion made by Banaszak, seconded by Sendra, to add the words “or is zoned appropriately” to Section 3 (f) of the Rooming House Ordinance. Carried.

Treasurer’s Report – Roberts presented the Treasurer’s report. The General Account has a balance of $78,370.30. Total of all funds is $3,306,013.49. The February tax settlement checks to the various taxing entities (totaling $1,487,637.73) are in tonight’s vouchers.
Motion made by Banaszak, seconded by Sendra, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: the truck that had just been repaired in Wausau, and picked up last Thursday, has a fuel injection problem again. The company warranted their work and will be sending up their service people to check it out. One of the garage crew is out sick and another one will take a day off, so the remaining crew will be cleaning up snow around town. The continuing Flambeau Dam Road/snowmobile problem will need to be discussed this spring with the snowmobile club to see if an agreement can be reached on show to resolve this complaint and several other issues. Lambert stated that the snowmobile clubs do not get reimbursed for grooming the roads.

Banaszak – the suggested path designs had been emailed to the Clerk’s office and included in the board packets. The board needs to decide whether to choose the straight, typical path or the meandering path. She had talked to Knoke about the increased costs for a meandering path and he said the increase would be miniscule. The board decided to choose the meandering path for esthetics and safety. She had talked to Joyce from Associated Bank and Joyce did not think that directing the path “behind” the bank on bank property would be approved by the bank board. She met with representatives from WISCAP this morning to discuss finding grants for the town’s portion of the matching funds needed for the storm sewer project. Teresa Schmidt, the Library Director, was in attendance to discuss possible grants for the library expansion project. They were told by the representatives that as much as 50% of the expansion costs for the library might be provided by grants. On the subject of Tourist Rooming Houses, she stated that by state statute the Sheriff’s office can mail out citations to property owners who fail to obtain TRH permits from the town. Hopefully, the sending out of letters to the rental property owners advising them of the permit requirement will be sufficient. She had been approached by a town employee about a wage question and a Closed Session should be placed on the next agenda to discuss this.

Sendra – Xcel Energy now has an online system for reporting street light problems 24/7. She has used this over the weekend to report several light outages.

For Consideration and Approval: a) Temporary Beer permits for the Mercer Lions Club for the Ice Fishing Jamboree at Carow Parkon Febrauary 20th 2010; and St Isaac Church for a Pizza Party on March 6th 2010.
Motion made by Stenberg, seconded by Lambert, to approve the Temporary Beer Permits for the Lions Club and St Isaac Church. Carried.
