Mercer Town Board of Supervisors – December 4th 2008 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 4th of
December 2008 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Opal Roberts, Christan Manners/Brandt, and Atty Schellgell.
Motion made by Sendra, seconded by Banaszak, to approve the minutes from the November 19th 2008 Budget Hearing, the November 20th board meeting and the December 2nd meeting with the garage crew and Labor Union, with a correction under Old Business c) to change the word “reapply” to “apply” on the November 20th meeting minutes. Carried.
Open comment: Mike O’Brien, representing the Mercer SnoGoers Snowmobile Club, asked if the Town would allow the club to purchase a new trail groomer tractor by going through the town accounts. The town has done this with previous equipment purchases. The loan would be for $69,000. This will be placed on the next meeting agenda.
O’Brien also asked if the board would consider a snowmobile route from the lake through Carow Park at the side of the swimming area. The board stated the club would have to fence an area for this purpose so other people using the hill would not be endangered by snowmobile traffic. This will be placed on the next meeting agenda.
New Business: a) Natural Gas service to Rescue Barn.
A gas line is installed to the Rescue Barn. The Clerk will notify WE Energies for the installation of the meter. Adam Kussard will contact Thompson to convert the appliances from propane to natural gas.
Motion made by Banaszak, seconded by Sendra, to approve the natural gas service to the Rescue Barn. Carried.
b) Revise Telecommunications Policy to include radios.
The words “Radio Communication Devices” was added to the Section III heading.
Motion made by Lambert, seconded by Banaszak, to approve the revision of the Telecommunications Policy and all town employees and officials who use these communication devices must sign the use agreement. Carried.
c) Letter of support for Flowage/Trude Lake Association grant application.
Banaszak had reviewed the draft grant application and had called Terry Daulton with several suggestions for the association concerning the grant as written.
Motion made by Banaszak, seconded by Sendra, to approve the letter of support for the Flowage/Trude Lake Association grant application. Carried.
Old Business: a) Sale of Business Park property to Gene Taylor.
Mr Taylor had the property surveyed and submitted copies of the survey to the board. The area under consideration comprises 3.23 acres and is not a usable building site since most of it is wetlands.
Motion made by Lambert, seconded by Stenberg, to approve the sale of Lot 11, part of Outlot 3, and the west 60’ of Lot 10 to Gene Taylor consisting of 3.23 acres for $3,000 with a closing date on or before March 3, 2009. Mr Taylor to pay all legal fees involved in the purchase of this property. Carried.
b) Resolution to abandon alley.
Gene Organist had obtained a document signed by all the parties with property adjoining the alley. The town has never maintained this alley. It leads from Statehouse Circle to the swamp, a distance of approximately 158’. The Public Hearing date will be February 5th 2009.
Motion made by Lambert, seconded by Sendra, to pass the Resolution to abandon the Alley adjoining the properties of Gene Organist on the west, and John Malone and the Nazarene Church on the east. (see attached) Carried.
c) Bill of sale for transfer of Sewer/Water in Business Park to Sanitary District.
This had been discussed at the last meeting.
Motion made by Stenberg, seconded by Lambert, to approve the Bill of Sale for the transfer of the Sewer and Water facilities as reflected in the Plat filed in the Register of Deeds Office, Iron County, WI. Carried.
d) Open/Award Gravel Crushing Bids
Two bids were received. Brackett & Son bid $4.00 per cubic yard for 20,000 cubic yards of ¾” aggregate and $2.00 per cubic yard for 1,000 cubic yards of sand. Meverden Materials Inc bid $3.18 per cubic yard for 20,000 cubic yards of ¾” aggregate and $2.00 per cubic yard for 1,000 cubic yards of sand.
Motion made by Lambert, seconded by Stenberg, to award the Gravel Crushing bid to Meverden Materials for the crushing of 20,000 cubic yards of gravel, and 1,000 cubic yards of sand at the Mercer pit on Fierick Road. Carried.
Legal: Atty Schellgell spoke on the subject of the letter from the lawyers for South Side Auto addressed to Chairman Kichk’s home address. The documents asked for in the letter are in the Town Hall and this letter should have been addressed to the Clerk as were two previous letters asking for copies of documents. Atty Schellgell will consult with the Clerk on how to reply to the letter addressed to Chairman Kichak.
Atty Schellgell had talked with Mike Stoffel of Ayres about the additional areas for storm modeling listed in the Amendments to Agreement for an additional $4,700. Some of the areas listed may come under the original agreement but several others do not. He will discuss this again with Stoffel.
Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers, and budget report.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.
Communications: The first Thursday in January is New Year’s Day. The board decided not to hold the first Thursday of the month meeting in January 2009.
A representative from MSA Engineering dropped off materials for the board and asked to be considered for any future projects that require an engineering firm.
Treasurer’s Report – Treasurer’s Report – Manners presented the Treasurer’s Report. The General Account has a balance of $338,966.74. Total of all funds is $780,985.48.
Motion made by Banaszak, seconded by Sendra, to approve the Treasurer’s report. Carried.,
Board Reports: Chair/Garage reports: Bruce Brunell would like to trade the town a V-plow for the old pumper truck the town is scrapping. The board agreed to this trade. Several of the crew are taking vacation time. The streets and curbs have been cleaned. Jim Funk has ordered the fans for the garage and the insulation will be delivered soon.. Logging is to begin on Belding Road. Banaszak asked about the repairs to Shay Dam. Kichak explained that he had called Terry Cummings of the DNR. Cummings said the paperwork had been filed with his office but the work on Lake Delton in southern Wisconsin has slowed down the process.
Supervisors: Stenberg – asked Kichak if Midland would reduce the contract price for propane. Kichak said he had called Midland and they said they couldn’t reduce the price per gallon.
Coleman had sent in the revised survey map showing the new walkway down to the shelter and the location of the shelter. This information will be sent to the County for a Board of Adjustment for a hearing for the revised location of the shelter.
Lambert – none.
Banaszak – she had requested information on the 25 By 25 grant for energy conservation. The application would need to be in by December 15th and asks for data five years prior to the current year. There is not enough time to get the required information by the deadline so the town will consider applying in 2009.
Sendra – she attended the Sanitary District meeting on the 2nd where they approved their budget and tax levy. The new rates for the district were also approved. The SD expressed several concerns with the Highway 51 project. It was suggested the SD direct these concerns to the WI-DOT. Banaszak said she would ask Ayres if several of these concerns could be covered by the EPA grant/Highway 51 project.
