Mercer Town Board of Supervisors – December 3rd 2009 – Minutes

Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 3rd of December 2009 at 6:30 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Brandt, and Opal Roberts. Absent: Atty Schellgell.

Motion made by Sendra, seconded by Banaszak, to approve the minutes from the November 19th 2009 town board meeting and the November 23rd Budget/Tax Levy Hearing. Carried.

Open comment: Dianne Keefe and Banaszak had met with the DNR grant representative, Pat Zatopa, on October 19th at Carow Park to review the grant work and determine what remains to be done before we can close the project. The main points were about the walkways and the completion of the sun shelter. Volunteer time needs to be recorded and included in the final submission for reimbursement. Stenberg said the work will be completed next spring as soon as weather permits.

New Business: a) Mercer Lake Association check presentation to Town.
In August of 2008 the Town and the Mercer Lake Association entered into an agreement stating that when the town had completed an analysis and study of the town’s storm water system and runoff treatment alternatives for the 2011 storm sewer project, the MLA would reimburse the town in the amount of $17,700. Doug Knudtson, representing the Mercer Lake Association and its 60+ members, presented the check and expressed the MLA’s appreciation to the town for their support in ending the environmental damage to the lake due to storm water and runoff discharges. The town board’s leadership in making the lake cleaner will be appreciated by future generations. He also recognized the efforts of Doug Chidley, a member of the MLA, who has worked for long hours with the town to come up with some of the engineering solutions for the storm sewer project. Kichak thanked the MLA for their efforts to prevent further damage to Mercer Lake.

b) Discuss/Approve Municipal/DOT agreement.
Anna Wisner, DOT Project Development Supervisor, had emailed two revisions of the agreement. The first included the cost for the standard 36’ pavement on the south end of the project. The second document included the additional cost of $25,113 to be paid by the town for the addition of parking lanes south of Lakeview Avenue. Wisner also stated that work credits cannot be used for the parking lanes.
Motion made by Banaszak, seconded by Lambert, to approve the modified Municipal Agreement (second document) which includes the addition of the parking lanes contingent upon; (1) the review and approval of the cost calculation for the widened road section and (2) the review and approval of the entire document by the town attorney. Carried.

c) Discuss/Approve ATV Ordinance amendment to add Cedar Lake Circle to ATV routes.
Kichak said that County Road J should be added to the amendment.
Motion made by Stenberg, seconded by Lambert, to amend the ATV Ordinance to add County Road J from Long Road to Cedar Lake Circle, and Cedar Lake Circle in its entirety, to the ATV Routes. Carried.

d) Discuss/take action on South Side’s failure to get Design Review for addition to business.
Banaszak asked what can be done about South Side’s failure to submit his commercial building addition plans to the Planning Commission. Kichak suggested we ask Atty Schellgell about this problem. The board agreed that the Planning Commission ordinance needs to be revised to prevent or penalize this in the future.

e) Approve Election Inspectors.
Motion made by Stenberg, seconded by Sendra to approve Mary Vaughn, Darlene Gibbs, Bobbie Baxter, Joyce Brundage, Sandra Falkowski, Linda Gentile, Jan Georgi, Audrey Guild, Betty Hiley-Dietz, Judy Ivey, Mary Ann Klopatek, Jean Koleno, Cheryl Kowaleski, Jan Slivinski, Audrey Springer, Dolores Sullivan, Shirley Thomas, Connie Yeakle and four Mercer High School volunteers. Carried.

Old Business: none.

Legal: none.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, and vouchers.
Motion made by Lambert, seconded by Banaszak, to approve the vouchers and issue the checks. Carried.

Communications: the Iron County Comprehensive Planning/Land Zoning Office is holding a meeting to discuss proposed changes to the Iron County Land Use Ordinance on December 15th at 3:00 pm.
The ancillary health insurance policies are with two different companies. The town’s agent has researched and sent a comparison with another company which could save the town almost $2000 per year from the present cost. The board said this will need approval from the road crew and will be placed on the next meeting agenda.
There are several WISLINE programs coming up in 2010 the members of the board might be interested in.
A 2010 membership application for the Urban Towns Association with dues of $473.25 annually was sent to the Clerk. The board did not feel we need to belong to this organization.
A letter from Mr Dodd stating he is making provisions to give access to his properties this winter but asked the road crew to not windrow across the roads when plowing Three Ten Road.

Treasurer’s Report –Brandt presented the Treasurer’s report. The General Account has a balance of $86,876.63. Total of all funds is $1,127,487.55.
Motion made by Banaszak, seconded by Sendra, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: Country Lane has the trees removed and stumped. The road bed was worked. Swamp Creek and Russell Brothers roads were worked on. Winter work will include the removal of trees on road right-of-ways.

Supervisors: Stenberg – none

Lambert – none

Banaszak – Jay Knoke, of CWE Engineering, would like to give a presentation to the town about the storm sewer project and some of the funding possibilities. This will be scheduled for a meeting in January. She also had a question about when the Tourist Commission would meet. Kichak stated the first meeting will be in January.

Sendra – none

Cemetery Deeds: Transfer of cemetery sites owned by Jean Roamer to her children.

Transfer from Jean Roamer to Jean Ellen Roamer 2 sites in Section 3, Block 17, Plot 3, Sites 1 & 8.
Transfer from Jean Roamer to Ruth Ann Leverson 2 sites in Section 3, Block 17, Plot 3, Sites 6 & 7.
Motion made by Banaszak, seconded by Stenberg, to approve the transfer of the above listed sites. Carried.
