Public Hearing – August 7th 2008 – Minutes

Chairman Jim Kichak called the meeting of the Public Hearing to Amend the Comprehensive Plan to order on Thursday the 7th of August 2008 at 6:15 pm in the Haines Civic Building.

Roll Call: Kim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Opal Roberts and Atty Schellgell. There were eight residents of the township in attendance.

This public hearing was to discuss changes to the Future Land Use Map in the Comprehensive Plan. These changes were to land in Forest Crop, which would not have a designation if removed from this program. The designation of “Forest” would include lands in Forest Crop, Forest Tax Law Program (Industrial), and Managed Forest Lands. The designation of “Forest Residential” would be for property that may become residential in the future.

Gary Theisen had comments on the Comprehensive Plan in general and brought up some valid questions. The Planning Commission will address these comments at their next meeting.

Motion made by Stenberg, seconded by Banaszak, to approve Resolution 2008-07 Amendment of the Town of Mercer Future Land Use of the Ordinance 2005.2 Comprehensive Plan. (see attached) Carried.

Motion made by Lambert, seconded by Sendra, to adjourn the Public Hearing at 6:35 pm. Carried.


Mercer Town Board of Supervisors – August 7th 2008 – Minutes

Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 7th of
August 2008 at 6:35 pm in the Haines Civic Building.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Opal Roberts and Atty Schellgell. Christan Manners was absent due to a medical problem.

Motion made by Banaszak, seconded by Sendra, to approve the minutes from the July 17th 2008 board meeting. Carried.

Motion made by Banaszak, seconded by Sendra, to deviate from the agenda as posted. Carried.

Old Business: a) Transfer Sewer/Water in Business Park to Sanitary District.
Attorney Schellgell explained the process for transferring the sewer and water lines to the Sanitary District. The concern about the Bill of Sale was addressed. Schellgell explained that the transfer of property, which is not real estate, is done with a Bill of Sale. Schellgell stated he would attach a list of the actual equipment and property being transferred to the District.
Motion made by Lambert, seconded by Stenberg, to approve the documents for transfer of the sewer and water lines to the Mercer Sanitary District with a list of equipment and property to be included with the Bill of Sale. Carried.

Legal: Atty Schellgell said he had talked with Doug Chidley, of the Mercer Lake Association, about the agreement between the town and the association regarding the town’s responsibilities as part of the grant the lake association has received. The concerns of the lake association were addressed and the final document will be ready for the next board meeting. Banaszak complimented Schellgell on how well he handled this complicated matter.

Motion made by Banaszak, seconded by Sendra, to return to the original agenda order. Carried.

Open comment: Jim Schmitt presented a letter from John Mette of 6540W Flambeau Dam Road that stated hiscomplaints with the occupants of the property owned by Craig Trenkamp. Kichak read the letter to the board. A copy of this letter will be placed in the Tourist Rooming House file.
John Sendra asked why there are so many applications for Tourist Rooming Houses. The Tourist Rooming House process was explained by several members of the board.

New Business: a) Discuss/Approve State Trust Find Loan application.
Discussion was held about the equipment being purchased and the amount to be borrowed. A portion of the funds for the equipment will be paid out of the Equipment Reserve account.
Motion made by Lambert, seconded by Banaszak, to approve the application to the State Trust Fund for a loan for $360,000 for five years at 3.25% interest to purchase a Pierce-Kenworth T370 Rescue Apparatus ($234,850), a 2009 7400 SFA plow truck ($68,925), and a 928 HZ CAT loader ($122,065). Carried.

b) Discuss payment for Ambulance due August 15th.
$139,000 was budgeted for the purchase of the ambulance. The total to be paid is $143,750.
Motion made by Lambert, seconded by Stenberg, to approve the payment of $143,750 to MedTec Ambulance Corporation with the $4,750 balance, not in the budgeted amount, to be taken from the Contingency account. Carried.

c) Change road name from Dodd Court to Bradley Court (Dodd subdivision).
Kathy Tutt stated that Mr Dodd agreed to the name change requested by a prospective purchaser of property on this road.
Motion made by Stenberg, seconded by Lambert, to approve the road name change from Dodd Court to Bradley Court in the Dodd subdivision. Carried.

Officer Reports: Clerk’s Report - Roberts presented the receipts list and vouchers.
Motion made by Lambert, seconded by Sendra, to approve the vouchers and issue the checks. Carried.

Communications: Received a complaint by e-mail from Michael Pritchard about ATV’s being run on a Tourist Rooming House property on Wallace Road. The board requested the clerk to send a copy of the complaint to the owner and to the WI-DNR.
A letter from Richard Grant with a complaint about a rude recycling attendant. Adam Kussard was present and said he had talked to both parties. A copy of the complaint will be placed in the recycling employees file.
The Zoning Administrator had supplied the clerk with a copy of all 2008 permits issued by his office for the Township of Mercer.

Treasurer’s Report – no report.

Lambert had contacted Joyce Olson at Associated Bank. She stated that the bank couldn’t match the interest paid by Wells Fargo. Placing the reserve funds in a CD will bring more interest. The Treasurer will be instructed to research CD rates.

Board Reports: Chair/Garage reports: The crew has removed the trees for the Wilson Lake Road project and will be stumping next week. The blasting company charged $2,551 for the blasting of rock on Weber Road. The crew has graded a number of the gravel roads. The roadside mowing is being completed sooner than last year due to the new mower. The old mower can be sold. An employee for the Hadley Pit needs to be hired. Maybe the pit can be closed until fall yard clean-up in September. Bids will need to be advertised for the attachments for the new plow truck. The town will keep the old truck as backup. The storm sewers were cleaned and the manhole on US 51 by the dentist’s office was rebuilt. The contractor did a very good job on the manholes and will be hired if more work of this type is needed. The state is surveying and marking the sewer lines along US 51. Lambert had received a complaint about a tree limb on Gade Road that needs to be cut down.

Supervisors: Stenberg – Asked if Kichak had heard anything about the appraisal of the Malone property. No correspondence has been received. Kichak will contact that company and also the company who did the testing for the salt shed site. Pitlik & Wick needs to send a quote for the work in Carow Park for the grant. Mr DeCherrie on Moricolli Road had told him that his road has not been graded and is in bad shape.

Lambert – He had received comments about the phone numbers of the supervisors not being listed in the phone book this year. The clerk explained that each number listed under Mercer Government costs the town $4.00 a month on the phone bill. The town web site has all the contact numbers listed. The supervisors want their numbers listed in next year’s phone directory.

Banaszak – She had received a call from Senator Jauch’s office and was told that the grant application scored high but not to get our hopes up too high. She asked if Kichak has planned for any maintenance work to be done on the garage for the winter. He will check to see about the feasibility of placing foam board on the exterior walls to help conserve heat. The cemetery grounds are looking well kept.

Sendra – The library building committee met but no architect was chosen for the expansion project.

For Consideration and Approval: a) Liquor/Operators Licenses: Liquor License for Deadhorse Bar owned by Sandra Pischer; Operator Licenses for Sadie Holtz and Cathleen Kempf.
Motion made by Stenberg, seconded by Sendra to approve the Liquor License for Deadhorse Bar at 4104N Popko Circle West. Lambert abstained. Carried.
Motion made by Banaszak, seconded by Sendra, to approve the Operator Licenses for Sadie Holtz and Cathleen Kempf. Carried.

b) Cemetery Deeds: Motion made by Banaszak, seconded by Sendra, for the purchase of two cemetery sites located in Section 4, block 28, Plot 8, Sites 6 & 7 by Ralph Tremmel for $400. Carried.
