Mercer Town Board of Supervisors – August 5th 2010 – Minutes

Chairman Kichak called the meeting of the Town of Mercer Board of Supervisors to order Thursday August 5th 2010 at 6:30 pm in the Haines Civic Building (Town Hall).

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Charles Schroepfer, Christan Brandt, Atty Schellgell and Opal Roberts.

Motion made by Banaszak, seconded by Lambert, to approve the minutes from the July 15th 2010 Town Board meeting with a correction under Supervisor Banaszak’s report concerning the zoning classifications. Carried.

Open comment: Dianne Keefe stated that the benches in the park have to be placed on the paved bump-outs before she can submit the bills for the park grant. Also she needs the updated plan with the change in the paved path.
Jim Schmitt thanked the town for getting the old dump site open for the disposal of trees and brush from the tornado. The road crew did a great job of removing the debris in the days after that.

Motion made by Stenberg, seconded by Banaszak, to deviate from the agenda and move to Legal. Carried.

Legal: No Tourist Rooming House citations need to be issued due to those not obtaining a town permit have conditional uses and are in violation of the provisions in the CU permit. The County Zoning Administrator will address this issue. Lambert asked if the town had any recourse with the paving of the roads in the Mazol subdivision if the developer has filed bankruptcy. Atty Schellgell will research this and report back at the next meeting.

The Board returned to the original agenda.

New Business: a) Conditional Use permit for 32x40 accessory building at 5373N Paul Road owned by Miles Enger.
Motion made by Lambert, seconded by Stenberg, to approve the Conditional Use permit for a 32x40 accessory building at 5373N Paul Road owned by Miles Enger on the condition that the building not be used for human habitation or commercial use without proper permitting. Carried.

b) Conditional Use permit for a 40x60 accessory building at NE-NE Sec. 10, T43N, R2E owned by Gene Waite.
Motion made by Schroepfer, seconded by Banaszak, to approve the Conditional Use permit for a 40x60 accessory building at NE-NE Sec. 10, T43N, R2E owned by Gene Waite on the condition that the building not be used for human habitation or commercial use without proper permitting. Carried.

c) Revised Conditional Use permit for a 30x54 accessory building on Forest Crop land owned by Five Brothers.
At the July 1st 2010 board meeting the property owner decided to forgo the dwelling construction and only build the 30x40 accessory building. He now would like to enlarge to accessory building to 30x54.
Motion made by Schroepfer, seconded by Banaszak, to approve the conditional Use permit for the 30x54 accessory building for the property located at NE-SW Sec. 31, T42N, R2E owned by Five Brothers on the condition that the building not be used for human habitation or commercial use without proper permitting. Carried.

d) Discuss/Approve purchase of equipment for new International plow truck.
Central WI Body and Hoist quoted a total package price for the equipment and installation at $52,954.
Motion made by Lambert, seconded by Stenberg, to approve the purchase of the equipment for the new International plow truck at $52,954. Carried.

e) Discuss construction and paving of side streets in conjunction with the DOT-EPA project.
Schroepfer had suggestions for work on various side streets that could be included in the Highway 51 project:
Richardson St – the 28’ width for this street could be narrowed and the length shortened to reduce costs.
Garnet St (from Lakeview Avenue to Hwy 51) – could possibly be widened to 24’.
Lakeview Ave – need to determine the final design of the end of Lakeview Ave between Garnet St and the boat landing. A boat turn around is needed there. Need a polymer costing on the snowmobile/ATV crossing between Railroad St and Margaret St.
Veterans Memorial Parkway – present width is only 20’ and probably could be wider. Bridge needs to be inspected and a weight limit sign installed. The access lane from the Parkway to Hwy 51 could be designed for handicap access.
Margaret St – the entire street should be paved from Lakeview Avenue to County Road J.
Harper St – needs polymer coating at the recreational vehicle crossing.
State House Circle – need to talk with the church about how to construct the sidewalk and curb in front of the church.
The SLAMM modeling for the runoff into Mercer Lake after this project is complete was discussed

f) Approve Municipal Disaster Proclamation for tornado damage sustained on July 27th 2010.
Motion made by Lambert, seconded by Stenberg, to approve the Municipal Disaster Proclamation for tornado damage sustained on July 27th 2010 in the Flambeau Flowage area. Carried.

Old Business: Lambert asked about the yellow bag costs for Mercer when Hurley is paying a dollar a bag.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, and vouchers.
Motion made by Lambert, seconded by Schroepfer, to approve the vouchers and issue the checks. Carried.

Kichak called Waste Management and asked why we were still receiving bills on the Fire Department dumpster. They replied that the Clerk had not sent a “registered letter” canceling the contract last fall so it automatically renewed. They had received the letter but since is was not sent by registered mail they do not consider the contract ended. We can either keep paying for the dumpster or cancel the contract by paying $400 and the bills we haven’t paid. The board chose the payment of the $400 and any other associated costs to end the contract. Our clean-up week cost the town $1,073.69. A letter from Horton about our insurance coverages on Dam Failure and excess uninsured motorists. The board decided not to have Dam Failure coverage or the excess uninsured motorists coverage. Paul Carlson will not have the tax roll notices out by the 17th. He will still hold the Open Book on the 13th and hold another one on the 27th. He and I will meet to hold an adjourned Board of Review meeting on the 17th and set the new date for August 31st. The custodians cleaned up the vandalizism mess at the park restroom and probably should be given a bonus for the work. The board agreed to give them their regular pay and a bonus to equal $150.00. The DNR sent a letter stating that the town has to have a professional engineer inspect Shay Dam every ten years and the next report needs to be completed by 2013.

Treasurer’s Report – Brandt presented the Treasurer’s report. The General Account has a balance of $75,658.04. Total of all funds is $1,470,545.93. The 2nd Quarter Accommodations Tax collections total $9,676.47 to date.
Motion made by Stenberg, seconded by Lambert, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: Kichak thanked the Fire Department volunteers and ambulance crew for the excellent work done after the tornado hit the Flowage area on the 27th of July. Lambert said the town road crew and the Chairman were there until 1:00 am working to get the roads opened and all the departments did phenomenal work. Kichak stated that the town roads were cleared first and then the crew worked on the roads on our end of Sherman Township. People using the old landfill site for the storm debris are keeping it neat and organized. Sherman is working with a chipping company to clean up the debris along their roads and maybe Mercer can do the same. The town can look into renting a mini-excavator with rubber tires to help with the clean-up. Matt Schmidt reported that the Winchester and Manitowish Waters fire departments and ambulance crews were on standby to cover the Mercer area while our crews were at the tornado site. The heavy rains and the tornado have slowed the road work schedule.

Supervisors: Stenberg – does the county give the town a road work schedule? People have been asking him about the work on County H. Does the town own Fisherman’s Landing? If not, who does the grading of the landing? Kichak said the DNR usually requests the road work for the landing from the town. Is the Mecca Ski Club on the Outdoor Recreation Plan? We should have a dedication at the park now that the work is done. We also need signage for the walking path. The major biomass plant will not be built in the Business Park at present. The company is working with the Australian government to build the plant there. They would still like to build the Mercer plant if they can find the backing.

Lambert – he had received a report that a property owner on Little Pike Lake Road was erecting a building. He contacted the county zoning administrator who checked on it and the building is less than 1,000 cubic feet so no county permit is needed. If it looks like it is being used to live in then he will report it to the state dwelling inspector. Lambert suggested that the board appoint the Fire Chief as the town emergency director and that the next budget include a line item for compensation for the extra work. The fire department and ambulance were well equipped for this disaster but the boat used for rescue work is flat bottomed and not very large. If we are doing search and rescue we need a boat capable of holding several occupants and a stretcher, and we need more than one boat. He asked the Fire Chief to check into costs for a larger boat and to present his findings at the budget work sessions in the fall.

Banaszak – The bike grant application came in at half of the estimated costs due to the amount of donated professional work. Senator Jauch is on the review committee for the path grant applications. WISCAP’s income survey results for the Sanitary District residents are low enough to apply for a grant for the storm sewer project. Carolee Russell will also submit a grant application for the library expansion project. The Mercer Lake Association is requesting the moving of the fishing pier to the other side of the fishing pier to allow for the construction of a handicap boat loading area. The Lake Association will be cleaning up the vegetation there. She attended the school board meeting and they are waiting for the Town of Sherman to continue with the process to move the Sherman students to the Mercer school. She talked with someone who volunteered to do the banner design for the downtown area project. She asked about the painting of the crosswalks on Hwy 51. Kichak said a professional company will need to be hired since it is a state highway. She asked if he and Stenberg had talked to Malone about the specifics of cleaning up his property. Kichak said not yet but in the near future.

Schroepfer – he wanted to thank Banaszak and Will Andresen for all the work they have done and time devoted to applying for the Bike/Hike trail grant.

Public Comment: none.

For Consideration and Approval: Liquor License: Application for Beaver’s Resort by James and Lynn Langhoff at 4720N Lake of the Falls Road.
Motion made Stenberg, seconded Banaszak, to approve the liquor license for Beaver’s Resort. Lambert abstained. Carried.

Operator licenses for: June Brunell, Diane Klein, and Marisa Riebe.
Motion made by Schroepfer, seconded by Stenberg, to approve the operators licenses for the above listed. Carried.
