Mercer Town Board of Supervisors – August 20th 2009 – Minutes
Chairman Jim Kichak called the meeting of the Mercer Town Board of Supervisors to order on Thursday the 20th of August 2009 at 6:30 pm in the Haines Civic Building.
Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Bonnie Banaszak, Toni Sendra, Christan Manners/Brandt, Opal Roberts, and Atty Schellgell.
Motion made by Banaszak, seconded by Sendra, to approve the minutes from the August 6th 2009 town board meeting and the August 17th 2009 Adjourned Board of Review meeting. Carried.
Open comment: Jennifer Couch, sales representative for Veolia Solid Waste, asked the board to reconsider their decision not to change waste pickup providers for the Fire Department. Stenberg gave a rather heated comment about his experiences with the services provided by Veolia. Kichak said the board will discuss this at another meeting.
New Business: a) Discuss and/or adopt Room Tax Ordinance.
Vic Ouimette, Chairman of the Room Tax committee, gave an explanation of how the committee had arrived at the draft presented to the board. He had asked Atty Schellgell to review the draft and to recommend any needed changes. Atty Schellgell had given the board his revision of the draft several minutes before the board meeting. He explained several of the changes to the draft. Lambert had several questions about the sharing of the revenues from this tax with the Flowage Association. Ouimette stated that if the ordinance specifically stated that the funds would be shared with that association then any association in the township could ask for a share. The Chamber and the Flowage Association can agree to a shared amount if they so choose. Lambert also asked about who would determine how the funds were to be expended. Ouimette stated that the Mercer Chamber would have control of the funds as contracted by the Tourism Commission. Lambert stated his adverse opinion of the Mercer Chamber. Kichak said the board needed time to study the draft and the revisions and asked that this be postponed until the next town board meeting. Schellgell wanted a correction made on page 5 under section B to include “as defined under Section 66.0615 (1) (fm) of the WI Statutes”.
Motion made Lambert, seconded by Stenberg, to postpone the adoption of the Room Tax Ordinance until the next town board meeting on September 3rd 2009. Kichak, Lambert, Stenberg voted yes. Banaszak, Sendra voted no. Carried.
b) Conditional Use permit to rezone from F-1 to RR-1 property in the SW ¼ NW ¼ Sec 1 T42N R2E owned by Peter Eisner.
Stenberg stated that the Planning Commission had reviewed the application and recommended the town board approve the rezone.
Motion made by Lambert, seconded by Banaszak, to approve the rezone from F-1 to RR-1 for property in the SW ¼ NW ¼ Sec 1 T42N R2E owned by Peter Eisner. Carried.
c) Discuss road paving in Mazol Subdivision.
Atty Schellgell stated that the board’s action on this matter is that the town will not accept the roads in the subdivision until they are paved. Several property owners had contacted Schellgell and asked about bringing action against Mr Mazol. He asked the board if they would have any problem with him representing the property owners if he chooses to help them with this problem. He will contact the state to see if there is any conflict of interest involved.
d) Discuss Request for Proposals for Assessor.
The town had not asked for RFPs for an assessor for a number of years. They hadn’t received any responses from that request. Due to the need to cut costs for the next budget it was decided to try again.
Motion made by Banaszak, seconded by Stenberg, to advertise for a Request for Proposals for an Assessor. Carried.
Old Business: a) Conditional Use permit for a 36x50 building in The Meadows Plat, Lt 7, owned by Elaine Wickline.
The Iron County Zoning Administrator has determined that there is enough of room to build a dwelling near this proposed building. The county allows a camper on a property for three months, then the owner has to apply for a camper permit. This is not compatible with the town’s dwelling ordinance. He recommends that the County and Town work together on a uniform camping ordinance because, as it is, he can’t enforce our ordinance.
Stenberg asked if the County Zoning Administrator checks conditional uses after they have been issued to see if they have been used for other purposes. Discussion followed as to how to address this problem. The Clerk will ask Rick Clem, the state building inspector, to attend the next board meeting.
Motion made by Banaszak, seconded by Stenberg, to approve the Conditional Use permit for a 36x50 building in The Meadows Plat, Lt 7, owned by Elaine Wickline, on the condition that this building not be used for a commercial business or for human habitation without proper permitting and inspection. Carried.
b) Appoint Consultant Committee for Safe Routes to School/Downtown Development grants.
Kichak appointed Dr Jeff Nehring, Joyce Olson and himself to the Consultant Committee.
c) Discuss investment of town funds.
Manners reported a bank charge of $41.00 due to the interest on the General Account not being enough to cover the bank fees. The town needs to move funds to other type of accounts to try to obtain more interest.
Motion made by Banaszak, seconded by Sendra, to invest General and Tax account funds as the Town Treasurer recommends. Carried.
Legal: At the meeting where the abandonment of a section of Pierpont Drive in 1994 was discussed, the board determined there was no reason to doubt that the town had abandoned the entire section up to Lake Tahoe Drive. The board can either do the abandonment procedure again or refuse Mr English’s claim that his driveway is still a town road. In which case he may bring a lawsuit against the town.
Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and budget report. The August tax settlement has been received.
Motion made by Lambert, seconded by Stenberg, to approve the vouchers and issue the checks. Carried.
Communications: copy of e-mail from Stephanie Christensen (EMC representative) to Steffanie Crossland (of the EPA) about the options the town has for receiving and making payments of EPA grant funds. Banaszak said this could be complicated and asked Atty Schellgell to review the email.
The Clerk has sent a letter to Dodd Properties asking about the paving schedule for his subdivision.
The Clerk was informed by the WI Towns Association that the town would need a resolution or ordinance to charge a fee for NSF checks.
Notice of Intent from DNR on the Upcoming Critical Habitat Designation Project for Spider Lake. Banaszak will contact the president of the Spider Lake Association to see if they have received this letter.
Several roads signs were reported missing, again!
Quality Heating will do a furnace maintenance program for the three furnaces at the Community Center/Library for $270.00. This will include travel and labor. Any needed parts would not be covered by this agreement. The board decided this maintenance agreement was needed.
The WI Demographic Services Center 2009 estimate of the population of Mercer if 1,925. An increase of 28 residents over 2008.
The 2009 Equalization report from the DOR has Mercer at $494,568,700, an increase of 6.05% from 2008. The next highest increase was Gurney with 4%. Eight towns and one city reported decreases in equalized value.
Hayward Scrap Metal had sent more information on their pick-up program. The question of a year round metal clean up and how to prevent people from dropping off unacceptable items was discussed.
The Census Bureau wants the towns to create Complete Count Committees.
Treasurer’s Report – Manners/Brandt presented the Treasurer’s report. The General Account has a balance of $449,814.16. Total of all funds is $1,488,615.86. Manners gave the board a list of the delinquent Personal Property tax. Discussion followed as to how the delinquent taxes may be collected. Schellgell researched the statutes and the town has the ability to access the liquor license holders for the Personal Property taxes.
Motion made by Lambert, seconded by Sendra, to approve the Treasurer’s report. Carried.
Board Reports: Chair/Garage reports: The town will start hauling gravel out to Fisher Lake Road East. He has contacted several local companies to do the hauling. The Wobble Wheel Packer will be delivered to the Fisher Lake site tomorrow. He contacted Pitlik & Wick about the paving of the path in the park. It has been several years since the town has done crack sealing and he will contact companies for the work that needs to be done this year. Signs and posts for the ATV signs are at the garage and the road crew will be installing these as soon as possible. The crew is having problems with the Mack truck again. Stenberg asked about proposed work on Murray Landing Road. Kichak said he will put one mile of chip sealing on Murray Landing Road in the schedule for the 2010 roadwork.
Supervisors: Stenberg – the businesses that have street dances should be made to clean up after the event. Lakeview Avenue and the side walks were not as clean as they should have been after the last street dance.
Lambert - Who does the wood that has been cut on Fisher Lake Road East belong to? Kichak said it belongs to the loggers doing the cutting. Lambert would like to see the English driveway problem resolved so that it doesn’t keep being brought before the board.
Banaszak – Contrary to Mike Stoffle’s opinion, there is no pre-determined consultant for the Safe Routes to School and Downtown Development grants. She had a pleasant talk with the DNR Secretary, Matthew Frank, at the presentation ceremonies held at the Mercer Community Center this morning. They discussed the TRM grant. He was very helpful.

Motion made by Sendra, seconded by Banaszak, to approve the Operator’s Licenses for the applicants listed above. Carried.
