Mercer Town Board of Supervisors – April 15th 2010 – Minutes

Chairman Kichak called the meeting of the Town of Mercer Board of Supervisors to order Thursday April 15th at 6:30 pm in the Haines Civic Building (Town Hall).

Re-elected Supervisor Jim Lambert and newly elected Supervisor Charles Schroepfer were sworn in. Kichak thanked Toni Sendra for her two years of service on the Town Board. She was not present but Kichak said he had called and talked to her.

Roll Call: Jim Kichak, Jim Lambert, Jeff Stenberg, Charles Schroepfer, Opal Roberts, and Christan Brandt. Absent: Bonnie Banaszak and Atty Schellgell.

Motion made by Lambert, seconded by Schroepfer, to approve the minutes from the April 1st 2010 Town Board meeting. Carried.

Open comment: Rick Clem, the County building inspector, was present to explain why he also will be inspecting new dwellings in Mercer. The Town of Mercer had opted out of the County ordinance and was under the impression that a state inspector would be issuing the state building inspection permits. When Clem contacted the state about this he discovered there was confusion among the state officials as to who was responsible for the permits in the Town of Mercer. It was finally officially acknowledged by the state that Clem will be the sub-contracted dwelling inspector for Mercer until further notice. This will only be for new dwellings and garages with plumbing using the price list established by the County ordinance.
Kathy Tutt wanted to remind the board about her plan for placing picnic tables outside her business on Loon Day. She has talked with the post master and he stated he will be closing the Post Office at noon on Loon Day and had no objection to the tables.

New Business: a) Discuss Business Park Policies.
Stenberg isn’t asking for any decisions on the BP policies tonight. He had contacted other business parks to compare their policies. Most of the towns considered the sale of the lots on a case by case basis. Most of the parks built without Federal funds set aside an area to be divided into lots for contractors who would be using them as offices and not necessarily create jobs in the park. These are higher priced lots and follow strict rules controlled by the town. Some towns “build to suit”. The town has to guard against companies purchasing a lot, building in it, and then selling it for a profit. Maybe, instead of selling the lots outright, they could be sold on a contract and if a business isn’t there in a certain length of time the town takes the lot back. Maybe the present lots are being sold too cheap. Lots with only shop or storage buildings are not using the water and sewer system that much and part of the reason for the Business Park was to increase usage of the Sanitary District services.
Maybe the board can think about this for the next couple of weeks and come up with ideas for the BP. Lambert said a job in the BP is a job in the town and Stenberg agreed. Schroepfer asked Stenberg to meet with him at the park sometime to discuss what the town can do to dress up some of the unsold lots. Lambert stated he had talked to Malone about purchasing the land the trailer park is on several years ago. The town should get an appraisal on the property and make Malone an offer.
The Evergreen Energies pilot plant is running well and is producing two or three different types of gas. The Australians are involved in this and the government there has been so cooperative that the main plant may end up being built in Australia before one is built here.
Keefe said she will call Jay Knoke, from the engineering company for the BP, and ask him about the jobs creation report the town will need to file in another three years.
Stenberg said the entrance to the Business Park needs to be cleaned up. The board has talked around this for years and something needs to be done.

b) Discuss community options.
Schroepfer, in the interests of keeping this meeting shorter, will give the board the information after the meeting for them to consider at a later date.

c) Discuss Cramer Lake Road bridge
Schroepfer asked if Kichak was aware that the town has to do something about the Cramer Lake Road Bridge. Kichak said we do not have to do anything yet, but that by the next bridge inspection we will be close to needing it replaced. Schroepfer said the upside facing is breaking away and if we had had heavy rains it would have been in the river. The paperwork will not happen overnight and the town should get started on it soon. He suggested someone talk to Jay Knoke of CWE to ask about preliminary plans about the bridge replacement. Kichak said he will contact Knoke and that if Knoke does the Cramer Lake bridge, the town should also get him to do the Trude Lake tubes. Schroepfer said he will ask the utility companies for a preliminary utility survey for the bridge area. Schroepfer said he hopes we can get some other source of funding other than the county because the town pays half the county taxes and any project half funded by the county means the town actually pays for three quarters of the costs.

d) Set date for Board of Review (Adjourned)
The board set the date for the Board of Review for May 20th 2010. This will need to be adjourned until sometime in August due to the Tax Roll not being complete.

e) Discuss/approve amendment to ATV Ordinance to add Goettsche Road
Kichak said he had also been asked to open Circle Lily Road from the Vilas County line to County Road J. Schroepfer suggested the town board open all the town roads as ATV routes instead of doing it road by road like this. This will be placed on the next regular meeting agenda. Lambert said we can make exceptions for the roads that should not be included.
Motion made by Schroepfer, seconded by Lambert, to add Goettsche Road to ATV route Ordinance. Carried.

f) Conditional Use for a 32x32 garage at 4928N Popko Circle E owned by Mike Baxter
Motion made by Schroepfer, seconded by Lambert, to approve the Conditional Use for Mike Baxter for a 32x32 garage at 4928N Popko Circle East owned by Mike Baxter oin the consition it not be used for human habitation or a commercial business without proper permitting. Carried.

g) Conditional Use permit for a 32x48 Accessory building at 5866N Branch Road owned by D Bormann/J Matchefts
Lambert stated that there was a question about the public access that had been moved to the south lot on which this structure would be placed. The County Zoning Administrator is out of town and Lambert would like his opinion on whether or not this building meets the requirements for distance from the side lot line taking into account the possible location of the easement. Jeanne Matchefts said the setback requirements have been met. Schroepfer suggested the board approve the application with the condition that Bergman approve the setback. After further discussion the board decided to postpone this item.
Motion made by Lambert, seconded by Schroepfer, to postpone the Conditional Use for Daniel Bormann/Jeanne Matchefts until the next regular board meeting. Carried.

h) Tourist Rooming House for 3156N Popko Circle W owned by Glen Rondebush
Motion made by Schroepfer, seconded by Stenberg, to approve the Tourist Rooming House permit for Glen Rondebush at 3156N Popko Circle W. Lambert abstained. Carried.

i) Tourist Rooming House for 5127N US Hwy 51 owned by Keith Davisson
Motion made by Stenberg, seconded by Schroepfer, to approve the Tourist Rooming House permit for Keith Davisson at 5127N US Hwy 51. Lambert abstained. Carried.

j) Tourist Rooming House for 5313N Goettsche Road owned by Thomas Conrad
Motion made by Schroepfer, seconded by Stenberg, to approve the Tourist Rooming House permit for Thomas Conrad at 5313N Goettsche Road. Lambert abstained. Carried.

k) Tourist Rooming House for 5315N Goettsche Road owned by Nathan Bruns
Motion made by Stenberg, seconded by Schroepfer, to approve the Tourist Rooming House permit for Nathan Bruns at 5315N Goettsche Road. Lambert abstained. Carried.

l) Tourist Rooming House for 5309N Goettsche Road owned by Noel Bruns
Motion made by Schroepfer, seconded by Stenberg, to approve the Tourist Rooming House permit for Noel Bruns at 5309N Goettsche Road. Lambert abstained. Carried.

m) Tourist Rooming House for 4093N & 4153N Pine Road owned by John Jagodzinski
Motion made by Stenberg, seconded by Schroepfer, to approve the Tourist Rooming House permit for John Jagodzinski at 4093N & 4153N Pine Road. Lambert abstained. Carried.

n) Tourist Rooming House for 3409N, 3410N & 3416N Tutt Road owned by James Way
Motion made by Schroepfer, seconded by Stenberg, to approve the Tourist Rooming House permit for James Way at 3409N, 3410N & 3416N Tutt Road. Lambert abstained. Carried.

o) Tourist Rooming House for 6510W Flambeau Dam Road owned by Dave Sherwood
Motion made by Stenberg, seconded by Schroepfer, to approve the Tourist Rooming House permit for Dave Sherwood at 6510W Flambeau Dam Road. Lambert abstained. Carried.

p) Tourist Rooming House for 6300W O’Mearas Road owned by Kathleen Grubba
Motion made by Stenberg, seconded by Schroepfer, to approve the Tourist Rooming House permit for Kathleen Grubba at 6300W O’Mearas Road. Lambert abstained. Carried.

q) Tourist Rooming House for 2964N Hiawatha Road (unit 6) owned by John Younger
Motion made by Schroepfer, seconded by Stenberg, to approve the Tourist Rooming House permit for John Younger at 2964N Hiawatha Road (unit 6). Lambert abstained. Carried.

Old Business: a) Discuss/Approve amendment to Citation Enforcement Ordinance.
Lambert explained to Kichak about updating the town ordinances and including the Citation Enforcement Ordinance when the ordinances are updated. Banaszak, by email, asked the board to approve the paragraph listing the enforcement for Rooming Houses with the Town Chairman or a designee as the enforcement officer. Lambert said the town should have legal council on this matter
Motion made by Stenberg, seconded by Lambert, to postpone this item until the next regular board meeting. Carried.

Officer Reports: Clerk’s Report - Roberts presented the receipts list, vouchers and budget reports.
Motion made by Lambert, seconded by Stenberg, to approve the vouchers and issue the checks. Carried.

Communications: The draft master plan for the Flambeau River State Forest was sent to the Clerk’s office and is available for review. The WTA called and asked if any town supervisors will be attending the highway workshop in Minocqua. Schroepfer will attend and Kichak if he has no conflicting meetings. A newsletter was received from the Turtle Soup Times, an informational newsletter from the Rice Lake Association. A letter from the DNR officially awarding the Targeted Runoff Management grant the town had applied for last year. Ads for bids for the mowing of the cemetery and possibly the park will be placed in the Miner. Someone had called about when the benches will be placed around town. Vic Ouimette said this will be done May 1st.

Treasurer’s Report – Brandt presented the Treasurer’s report. The General Account has a balance of $114,585.48. Total of all funds is $1,655,541.70.
Motion made by Stenberg, seconded by Lambert, to approve the Treasurer’s report. Carried.

Board Reports: Chair/Garage reports: He and Brunell drove to Waterford MI yesterday and looked at a 2004 Peterbilt truck with 124,000 miles for $51,000. Schroepfer said the board should take into consideration that when purchasing from a private individual there is no warranty. He would prefer the town go to local dealers and possibly lease with an option to purchase so the town would have recourse if there is a problem. An ad will be placed in the Miner asking for truck bids. This will be placed on the next agenda. Road weight limits were lifted this morning except for a few gravel and dirt roads. Work will begin on County Lane with tree and stump removal. Murrays Landing will be next. Nokomis Road will also be worked on this spring. Kichak had talked to Carl Fink who will give him a quote on the cost for chipping and hauling out the shrub in the Hadley Pit. There will be a posting for a mechanic at the town garage. The topsoil for the park has been placed and seeded. Stenberg said a few walks in the park need stone, or whatever materials the plans are to use for this purpose. Schroepfer said the old doors for the pavilion need to be removed from where they are stored at the back of the building and some low hanging branches removed. Street sweeping is being done.

Lambert – There is an ATV/Speed limit sign down on Ball Landing. The library sidewalk is in dire need of repair or replacement. One local contractor had given an estimate of the cost to replace the sidewalk. An ad will be placed in the Miner asking for bids for this work.

Banaszak – none

Schroepfer – He asked if Kichak has designated someone to attend the invasive species seminar to be held in Hurley. Kichak replied that he will send Carl Hertel. Schroepfer had talked to Jack Marasch and Marasch had said a good job had been done on the brushing on Mercer Lake Circle. He [Schroepfer] asked if he could have the board’s permission to give the road garage crew a road survey form for the roads on their routes. They will input the condition of the surfacing on the roads. The board agreed.

Motion made by Lambert, seconded by Stenberg, to go into Closed Session per WI Stats. 19.85 (1)(c) to discuss hiring and personnel at 7:48 pm. All Aye. Carried.

Motion made by Stenberg, seconded by Lambert, to return to Open Session at 8:11 pm. All Aye. Carried.

Action on closed Session: Motion made by Schroepfer, seconded by Lambert, to post for the position of mechanic and road foreman at the town garage. Carried.

Motion made by Stenberg, seconded by Schroepfer, to adjourn the board meeting at 8:20 pm. Carried.
